This Indenture made and concluded Between Joseph Stevenson and Sally his wife of the County of Washington and State of Pennsylvania of the one part, and Thomas Byers Senior of the aforesaid County and State of the other part, this twenty sixth day of April in the year of our Lord one thousand eight hundred and nineteen, Witnesseth, that Joseph Stevenson hath granted bargained and sold and by these presents Doth grant bargain and sell unto the above mentioned Thomas Byers his heirs and assigns the following described piece or parcel of land, It being and lying in Donegal Township and being a part of the tract on which said Stevenson now lives granted by the Commonwealth of Pennsylvania to John McPherren by patent bearing date April the seventh one thousand seven hundred and eighty six, and conveyed by John McPherron to Joseph Stevenson by Indenture bearing date March the second one thousand eight hundred and fourteen described as follows viz, Beginning at a dead white oak adjoining land belonging to the heirs of James Stater, thence North forty four degrees West along Starters line one hundred and forty eight poles to a dead white oak, thence North thirty two and one half degrees East ninety four poles to a stone, thence South fifty four degrees and three fourths East fifty seven poles to a stone, thence North forty eight and one fourth East three poles and six links to a stone, thence South fifty one and three fourth degrees East seventeen poles and five links to a hickory stump, thence North twenty seven and one half degrees East nineteen poles and two links to white oak stump, thence South seventy six and one fourth degrees East sixty seven poles to a stone in Charles Mayes line, thence South twenty four degrees west ninety five poles and seven links to a forked white oak, thence South thirty eight and one half degrees seventy three poles to the place of beginning, Containing one hundred and twenty three acres and forty nine perches strict measure, To have and to Hold the same (be it more or less) to him his heirs or assigns forever, to his and their proper use and behoof with all the appurtenances thereunto belonging all the woods waters rights privileges and hereditaments thereunto belonging, the said Thomas Byers has paid to the said Joseph Stevenson for the above described piece of land the sum of one thousand nine hundred and seventy two dollars and ninety cents receipt whereof is hereby acknowledged and Joseph Stevenson by these presents binds himself his heirs assigns Executors and Administrators firmly unto Thomas Byers his heirs and assigns to warrant and defend the above described piece of land in full possession against the lawful claim of all men and manner of persons whatsoever. Whereas Thomas Byers Senior late of East Finley Township Washington County Pennsylvania, deceased, by his last will and testament did bequeath unto his daughters the said Sarah, Jane, Margaret, Anne, Nancy, and Rachel six equal shares the purchase money of a certain tract or parcel of land adjoining land of Thomas Byers Junior and is a part of the same survey for and actual survey to contain ninety eight acres and fifty five perches thirty acres and one hundred and twenty perches of which have been sold by the above named legatees to the said Thomas Byers Junior for the consideration of the sum of five(?) hundred and twenty dollars, current money, the said thirty acres and one hundred twenty perches and divid(?) from the balance by line commencing at a stone on Thomas Byer's line and fence, thence north forty one and a half degrees east one hundred and twenty seven perches and four tenths to a stone pile in May's line, the said land extending from said Davidson's line North westerly and down towards the creek to other lands of said Thomas Byers Junior being a part of a tract of land conveyed to Thomas Byers deceased by Henry McDonough by deed dated on ninth day of January in the year of our Lord one thousand eight hundred and thirteen recorded in the Office for recording deeds in Washington County recourse thereto being had will more fully appear. This Indenture made the twenty second day of August A.D. one thousand eight hundred and fifty three between George Baird administrator of all and singular the goods and chattels rights and credits which was of Rev Nicholas P Murray late of Washington County Pennsylvania who died intestate of the one part and Thomas Byers of the County and State aforesaid of the other part, Whereas the said Rev. Nicholas P Murray in his lifetime and at the time of his death was seized in his demesne and of fee of and in a certain messuage and lot of ground situate in the Borough of Washington County and State aforesaid and whereas administrator of all and singular the goods and chattels rights and estate which were of the said Nicholas P Murray at the time of his death after the death of the said Nicholas P Murray was in due form of law committed to the aforesaid George Baird and whereas the petition of the said George Baird to the Orphans Court setting forth that the personal estate of the said Rev. Nicholas P Murray was not sufficient to pay his debt a Schedule of which together with an inventory of said debt and also a statement of all the real estate of the said Rev. Nicholas P Murray was thereunto attached and praying said Court to allow him to make sale of so much of the real estate as the said Court should judge necessary for the purpose aforesaid and thereupon it was considered and ordered by the said Court that the above mentioned messuage and lot of ground be sold on the twenty eighth day of August one thousand eight hundred and fifty three, the premises according to the prayer of the said petition as by the records and proceedings of the said Court reference thereunto being had will more fully appear. And Whereas in pursuance of the said order and by force and virtue of the laws of this State in such case, made and provided afterward to wit on the twenty eighth day of August one thousand eight hundred and fifty three at the premises by the said George Baird did close to sale at public vendue or outcry the hereinafter described messuage and lot of ground after duly advertising the same according to last and then and there did sell the same to the said Thomas Byers for the consideration of two thousand one hundred and twenty six dollars being the highest and best bidder for the same which sale on report thereof made to the Judges of the said Orphans Court on the twenty second day of August one thousand eight hundred fifty three was confirmed by the said Court and it was considered and adjudged by the said Court that the same shall be and Confirm and stable forever as by the records and proceedings of the said Court reference therein to being had will more fully appear. Now this Indenture Witnesseth that the said George Baird for and in consideration of the said sum of Two Thousand one hundred and twenty six Dollars to him in hand paid at and before the ensealing and delivery hereof the receipt whereof he hereby acknowledge and thereof acquit and discharges the said Thomas Byers his heirs executors and administrators by these presents, hath granted bargained sold aliened released and confirmed and by these presents doth grant bargain sell release and confirm unto the said Thomas Byers his heirs and assigns All that messuage and lot of ground situate in the Borough County and State aforesaid bounded and described as follows to wit, a lot of sixty feet in front on Bell Street and two hundred and forty feet back bounded by said Bell Street on the North and extending sixty feet on the same on the West by Front Street on the South by Strawberry Alley on the East by lot of Mrs Eliza Donley, Being Lot number sixty five in the plan of the said Borough of Washington, being the property owned and occupied by Robert Knox Deceased having been sold by said Robert Knosx Executors under the will of the said Robert Knox by John H Wilson his said Executor to L. P. Hitchcock and conveyed by the said L. P. Hitchcock and wife to Levi Baldwin by deed dated the twenty first day of March A.D. one thousand eight hundred and forty eight and conveyed by the said Levi Baldwin and wife to the said Rev. Nicholas P. Murray by deed dated the sixth day of April A.D. one thousand eight hundred and forty nine, Together with all and the houses, out houses buildings rights liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and also all the estate right title interest property claim and demand whatsoever the said Rev. Nicholas P. Murray in his lifetime at and immediately before the time of his decease or of him the said George Baird by law equity or otherwise howsoever of in to or out of the same, To Have and to hold the said messuage and lot of ground hereditaments and premises hereby granted or mentioned so to be with the appurtenances unto the said Thomas Byers his heirs and assigns to the only proper use and behoof of the said Thomas Byers his heirs and assigns forever. In the name of God, Amen. I Thomas Byers of Washington Pennsylvania, being of sound mind memory and understanding do make and publish this my last will and Testament in manner and form following, to wit, Item 1st I order and direct that all my just debts and funeral expenses be paid as soon after my decease as may be convenient and practicable. Item 2nd I will and bequeath to my wife Margaret Byers all my household and kitchen furniture books etc which property is not to be appraised. I also leave to my wife during her natural life my house and lot in the Borough of Washington situate on the corner of Wheeling and First Streets. I also give and bequeath to my said wife the sum of ten(?) hundred dollars. Item 3rd I authorize and empower my executors hereinafter mentioned to sell my farm in Donegal Township in this County containing about one hundred and seventy five acres adjoining lands of Mayes, Mop, and others and make a deed or deeds to the purchaser or purchasers as fully as I could now do. I also authorize and empower my said executors after the death of my wife to sell my house and lot in Washington aforesaid and make a deed or deeds to the purchaser as fully as I could now do. Item 4th The money arising from the sales of the real estate aforesaid I will and bequeath to be equally divided amongst my eight children, to wit, the Reverend Robert H Byers of Texas, Thomas S Byers, John W Byers, Samuel Byers, Alexander Byers, Mary Todd, Margaret Oldham, and Betty Jane Byers, my said children to account for the following advancements made to them as follows, viz, the Rev Robert H Byers four hundred and eighty three dollars, Thomas S Byers five hundred and fifty four dollars, John C Byers four hundred and fifteen dollars, Samuel Byers one hundred and eight dollars, Alexander Byers two hundred and fifty dollars, Mary Todd one hundred and sixty eight dollars, Margaret Oldham one hundred and seventy five dollars, and Hetty Jane Byers one hundred dollars. The proceeds of my house and lot in Washington is not to be divided amongst my children aforesaid until after the death of my said wife. Item 5th I will and bequeath any personal estate remaining at my death not heretofore bequeathed to my said wife Margaret Byers. Item I authorize and empower my executors to make a deed or deeds for any property I may sell in my lifetime and for which no deed has been made. Lastly I nominate and appoint my said wife Margaret Byers my executrix and Joseph Henderson my executor of this my last will and testament. Witness my hand and seal the 5th day of July 1863. Be it remembered that on the 11th day of September 1863 Before me John Pelvy Dep Register for the probate of wills and granting letters of administration in and for said County came Thomas Hodgens and John McClelland witnesses to the within will of Thomas Byers late of the Borough of Washington decd and after being duly qualified according to law depose and say that they were present at the execution of this same will, and saw the testator sign his name thereto, that at his request in his presence and in the presence of each other they subscribed their names, that they heard the testator publish pronounce and declare the within as for his last will and testament, and at the time of so doing he was of sound and disposing mind memory and understanding to the best of their knowledge observation and belief. This Indenture made the 28th day of November A.D. one thousand eight hundred and sixty eight between Margaret Byers, Executrix and Joseph Henderson, Executor of the last will and testament of Thomas Byers, decd, of the one part and Benjamin M Oldham of the other part, Witnesseth that Whereas, the said Thomas Byers by virtue of divers conveyances and assurances in the law, duly had and executed became in his lifetime lawfully seized in his demesne as of fee of and in a tract of land in Donegal Township, Washington County, Pennsylvania, adjoining lands of Joseph Mayes, Alexander Ruth, James Moss, and Ebenezer Brownlee, and being thereof so seized made his last Will and Testament in writing bearing date the fifth day of July A.D. one thousand eight hundred and sixty two, wherein and whereby, amongst other things, he did authorize his Executors above named to make a deed or deeds to the purchase or purchasers for any real estate he might sell in his lifetime as fully as he could then do, and of his said will appointed the said Margaret Byers and Joseph Henderson the executor, as by the said recited will since his death duly proved, and remaining of record in the Reigster's Office in the County of Washington, Pennsylvania, recourse being thereunto had more fully appear, And whereas the said Thomas Byers did on the 30th day of October 1856 sell at public sale the aforesaid tract of land to the said Benjamin M Oldham for the sum of thirty six Dollars and fifty cents per acre, Now This Indenture witnesseth that the said Margaret Byers and Joseph Henderson Executors for and in consideration of the sum of Four Thousand Three Hundred and thirty six Dollars, to them in hand paid by the said Benjamin M Oldham, at and before the ensealing and delivery of these presents, the receipt and payment whereof is hereby acknowledged, have granted, bargained, and sold, and by these presents, by force and virtue of the power given in the said recited last Will and Testament, do grant, bargain and sell unto the said Benjamin M Oldham, all the following described all that tract of land situate in Donegal Township, Washington County, Pennsylvania, containing one hundred and seventy five acres, more or less, adjoining lands of Joseph Meyers, Alexander Ruth, James Moss, and Ebenezer Brownlee, Together with all and singular the buildings improvements, ways, woods, waters, water courses, rights, liberties, privileges, hereditaments, and appurtenances whatsoever thereunto belonging or in anywise appertaining, and the reversions and remainders, rents, issues and profits thereof, and also all the estate, right, title and interest whatsoever of the said Thomas Byers at and immediately before the time of his decease, in law, equity or otherwise howsoever, of, in, to or out of the same, To Have and To Hold the said described tract of one hundred and seventy five acres of land with the appurtenances, unto the said Benjamin M Oldham his heirs and assigns, to the only proper use and behoof of him the said Benjamin M Oldham his heirs and assigns, forever by the same title, and to all intents and purposes the same as held by him the said Thomas Byers at and immediately before the time of his decease, And the said Margaret Byers and Joseph Henderson for themselves, their heirs, executors and administrators, do covenant, promise, grant and agree to and with the said Benjamin M Oldham his heirs and assigns by these presents that they the said Margaret Byers and Joseph Henderson have not heretofore done or committed, or knowingly or willingly suffered to be done or committed, any act, matter, or thing whatsoever whereby the premises hereby granted, or any part thereof, is are, shall, or may be impeached, charged, or incumbered in title, estate, or otherwise howsoever. This Indenture made the 26th day of August A.D. one thousand eight hundred and seventy Between Margaret Byers Executrix and Joseph Henderson Executor of Thomas Byers decd of the one part and William Workman President of the Hempfield Railroad company of the other part, Witnesseth that Whereas the said Thomas Byers by virtue of divers conveyances and assurances in the law duly had and executed, became in his lifetime lawfully seized in his demesne as of fee a certain lot of ground in the township of Washington in the County of Washington Pennsylvania, containing about five acres and fifteen perches and described by courses and distances as herein after mentioned, and being thereof so seized made his last will and testament in writing, bearing date the fifth day of July A.D. one thousand eight hundred and sixty two, wherein and whereby amongst other things, did authorize his Executors to make a deed or deeds for any property which he might sell in his lifetime and for which he made no deed, and of his said will appointed the said Margaret Byers Executrix and Joseph Henderson Executor the executors, as by the said recited Will, since his death duly proved, and remaining of Record in the Registers Office in the County of Washington, Pennsylvania, recourse being thereunto had, more fully appear, And Whereas, the said Thomas Byers did in his lifetime, to wit, on the 31st day of May 1853 enter into an Article of Agreement with William M Kernan and C W Reed Esqs, a committee of the Hempfield Railroad, by which he agreed to sell, for the consideration of three thousand dollars, to the said company, a lot of ground containing about five acres and fifteen and a half perches situate in said Borough, founded as hereinafter described. This Indenture made the twenty ninth day of October A.D. 1873 between Mrs Margaret Byers in her own right as life tenant and as surviving executrix of her husband Thomas Byers, late of Washington Pennsylvania of the first part and John P McNary of the second part, Whereas the said Thomas Byers in and by his last will and testament duly proved and admitted to probate in the Reigsters office in and for the county of Washington State of Pennsylvania on the eleventh day of September A.D. 1863 devised to the said Margaret Byers the within described property for life and directed that the proceeds should be divided among his children after her death granting her executor therein named power to make a deed or deeds to the purchaser as fully as he would now do and therein appointed his said wife Margaret Byers executrix and Joseph Henderson now deceased, executor thereof. And Whereas by writing dated the 2nd day of September A.D. 1864 the heirs of the said Thomas Byers decd agree that she the said Margaret Byers executrix and Joseph Henderson, now decd executor may sell said estate and vest the money arising from said sale in United States securities. Now this Indenture witnesseth that the said Margaret Byers in her own right as tenant for life under said will and as surviving executrix of the said Thomas Byers decd by virtue of the power and authority aforesaid and in consideration of the sum of six thousand ($6000) dollars to her in hand paid by the said John P McNary the receipt whereof she doth hereby acknowledge hath granted bargained sold and conveyed and by these presents doth grant bargain sell and convey to the said John P McNary his heirs and assigns forever, All that certain lot of ground situate and lying upon the South-West corner of Wheeling and first Streets in the said towns of Washington Pennsylvania, fronting on Wheeling Street sixty feet more or less and extending back along First Street two hundred and forty feet more or less to an alley running parallel to Wheeling Street on which is erected a two story brick house on the front and a one story frame house on the rear end of the lot, To have and to hold the said described premises and hereditaments with the appurtenances unto the said John P McNary his heirs and assigns forever. This Indenture made the first day of April in the year of our Lord one thousand Eight hundred and Eighty one Between John P McNary Administrator de bonis non cum testamento annexo of the Estate of Thomas Byers late of Washington Pennsylvania deceased and John W Donnan of Washington Pennsylvania of the second part, Whereas the said Thomas Byers by virtue of diverse good conveyances and assurances in law duly had and executed became in his lifetime seized in his demeasne as of fee amongst other land of and in a certain messuage lot or tenement and tract of land situated in the Borough of Washington in the County of Washington and State of Pennsylvania fronting 60 feet on Wheeling Street, and extending back along Franklin Street 240 feet to an alley and hereinafter more fully described and being so thereof seized made his last will and testament in writing bearing date the 5th day of July 1862 wherein and whereby amongst other things he authorized and empowered his said Executors after the death of his wife to sell his houses and lot in Washington and to make a deed or deeds to the purchaser or purchasers as fully as he the said Thomas Byers could do of which said will he appointed Joseph Henderson executor and wife Margaret Byers Executrix, as in and by the said recited will since his decease duly proved and remaining in the Registers Office of Washington Pennsylvania recourse being thereunto had more fully appears, And whereas the said Joseph Henderson on the 19th day of September 1872 and the said Margaret Byers wife and Executrix of the said Thomas Byers died on the 15th day of January 1881, and letters of administrators of all and singular the goods and chattels rights and credits remaining unadministered which were of Thomas Byers decd with a copy of deceased will annexed were on the 12th day of February 1881 in due form of law committed by the Register of Wills of the County aforesaid to the said John P McNary, and whereas by force and virtue of the laws of the Commonwealth of Pennsylvania in such case made and provided and under and by virtue of the power and authority given in the said will the said John P McNary administrator as aforesaid sold the said lot or parcel of ground with the dwelling house erected thereon to the said John W Donnan, Now this Indenture witnesseth that the said John P McNary Administrator as aforesaid for and in consideration of the sum of six thousand ($6000) Dollars lawful money of the United States to him in hand paid by the said John W Donnan at and before the sealing and delivery hereof the receipt whereof is hereby acknowledged, has granted bargained sold aliened released and confirmed, and by these presents by force and virtue of the power and authority given in the said last recited will doth grant bargain sell alien release and confirm unto the said John W Donnon and to his heirs and assigns forever All that certain lot of ground situate upon the South East corner of Wheeling Street and Franklin Street in the said borough of Washington in the County of Washington, Pennsylvania, fronting sixty (60) feet more or less on Wheeling Street and Extending back along Franklin Street the same width two hundred and forty (240) feet to Newberry Alley on which is erected a two story brick dwelling house on the front and a one story frame house on the rear of said lot, Together with all and singular the buildings ways waters water courses rights liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining, and the reversions and remainders rents issues and profits thereof and also all the estate right title interest use trust property possession claim and demand whatsoever of the said Thomas Byers at and immediately before the time of his decease in law equity or otherwise howsoever of in or out of the same, To Have and to hold the said lot messuage or tenement and the hereditaments and premises hereby granted and released or mentioned and intended so to be with the appurtenances unto the said John W Donnan his heirs and assigns to and for the only proper use and behoof of him the said John W Donnan his heirs and assigns forever, And the said John P McNary for himself his heirs executors administrators doth personally warrant promise and agree to and with the said John W Donnon his heirs and assigns the said above mentioned and described lot hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said John W Donnon his heirs and assigns, against him the said John P McNary and his heirs and against all and every other person and persons whomsoever lawfully claiming or to claim the same or any part or parcel thereof shall and will warrant and forever defend by these presents.
