This Indenture made the 28th day of November A.D. one thousand eight hundred and sixty eight between Margaret Byers, Executrix and Joseph Henderson, Executor of the last will and testament of Thomas Byers, decd, of the one part and Benjamin M Oldham of the other part, Witnesseth that Whereas, the said Thomas Byers by virtue of divers conveyances and assurances in the law, duly had and executed became in his lifetime lawfully seized in his demesne as of fee of and in a tract of land in Donegal Township, Washington County, Pennsylvania, adjoining lands of Joseph Mayes, Alexander Ruth, James Moss, and Ebenezer Brownlee, and being thereof so seized made his last Will and Testament in writing bearing date the fifth day of July A.D. one thousand eight hundred and sixty two, wherein and whereby, amongst other things, he did authorize his Executors above named to make a deed or deeds to the purchase or purchasers for any real estate he might sell in his lifetime as fully as he could then do, and of his said will appointed the said Margaret Byers and Joseph Henderson the executor, as by the said recited will since his death duly proved, and remaining of record in the Reigster's Office in the County of Washington, Pennsylvania, recourse being thereunto had more fully appear, And whereas the said Thomas Byers did on the 30th day of October 1856 sell at public sale the aforesaid tract of land to the said Benjamin M Oldham for the sum of thirty six Dollars and fifty cents per acre, Now This Indenture witnesseth that the said Margaret Byers and Joseph Henderson Executors for and in consideration of the sum of Four Thousand Three Hundred and thirty six Dollars, to them in hand paid by the said Benjamin M Oldham, at and before the ensealing and delivery of these presents, the receipt and payment whereof is hereby acknowledged, have granted, bargained, and sold, and by these presents, by force and virtue of the power given in the said recited last Will and Testament, do grant, bargain and sell unto the said Benjamin M Oldham, all the following described all that tract of land situate in Donegal Township, Washington County, Pennsylvania, containing one hundred and seventy five acres, more or less, adjoining lands of Joseph Meyers, Alexander Ruth, James Moss, and Ebenezer Brownlee, Together with all and singular the buildings improvements, ways, woods, waters, water courses, rights, liberties, privileges, hereditaments, and appurtenances whatsoever thereunto belonging or in anywise appertaining, and the reversions and remainders, rents, issues and profits thereof, and also all the estate, right, title and interest whatsoever of the said Thomas Byers at and immediately before the time of his decease, in law, equity or otherwise howsoever, of, in, to or out of the same, To Have and To Hold the said described tract of one hundred and seventy five acres of land with the appurtenances, unto the said Benjamin M Oldham his heirs and assigns, to the only proper use and behoof of him the said Benjamin M Oldham his heirs and assigns, forever by the same title, and to all intents and purposes the same as held by him the said Thomas Byers at and immediately before the time of his decease, And the said Margaret Byers and Joseph Henderson for themselves, their heirs, executors and administrators, do covenant, promise, grant and agree to and with the said Benjamin M Oldham his heirs and assigns by these presents that they the said Margaret Byers and Joseph Henderson have not heretofore done or committed, or knowingly or willingly suffered to be done or committed, any act, matter, or thing whatsoever whereby the premises hereby granted, or any part thereof, is are, shall, or may be impeached, charged, or incumbered in title, estate, or otherwise howsoever. In Witness whereof the said Margaret Byers and Joseph Henderson have hereunto set their hands and affixed their seals the day and year first above written. Margaret Byers. Joseph Henderson.

Pennsylvania, Washington County, SS. Before the subscriber, a Justice of the Peace in and for the said County, personally came the above named Margaret Byers and Joseph Henderson and as each acknowledged the above Indenture to be their act and deed for the purpose therein expressed, in order that it might be recorded as such, according to law.
