To All Whom these presents shall come, greeting. Know ye that I Robert Hamilton of Canton Township Washington County and State of Pennsylvania being in a declining state of health but under the divine indulgence of sound mind and memory, and calling to mind the mortality of human creations and the uncertainty of life and considering that it must tend eminently to promote the peace and composure of mind necessary to support us in the trying moment of the dessolution of nature to be entirely unincumbered with the concerns of the present world do in the following form and manner make this my last will and testament viz, after burying my body decently and paying what just debts I leave unsatisfied my will is that the property I possess be disposed of by the following arrangement viz, I give and bequeath firstly to my beloved wife Mary Hamilton the third of all my property real and personal to be at her own disposal provided nevertheless that if she marry again she only enjoy the interest of her third during life and at her decease dispose of the principal to our children as she sees best. Nextly I give and bequeath to my daughter Esther Dinsmore the sum of fifty dollars and to my son John Hamilton I give and bequeath the sum of one hundred dollars. Also I give and bequeath to my son Robert Hamilton the sum of eighty dollars. Also I give and bequeath to my daughter Margaret Ryan the sum of fifty dollars. Moreover I give and bequeath to my daughters Mary and Anne the sum of two hundred dollars each. And then my will is and I give and bequeath to my three youngest sons Alexander James and William the remains of my estate to be equally divided among them, provided that nevertheless that if all of my said sons go to trades they are to get only the sum of eighty dollars each and the remains of their shares to be equally divided among all my heirs including themselves, but if only one of the two eldest of them goes to a trade my will is the remains of his share above eighty dollars be given to the one that stays and works the place. And further my will is that my beloved wife Mary Hamilton keep the place and farm it for the benefit of raising and schooling my said younger children, and to have the disposal of the produce thereof after paying the expence of farming for that purpose until the youngest becomes of the age of twenty one years at which time my will is that the place be sold to raise the funds necessary to discharge the above recited legacies which are not to be paid my wearing apparel my best hat be given to my son John and my best coat to my son and the remainder to the rest of my sons as their mother shall find most suitable. And as my wife Mary Hamilton may marry before my youngest son comes of age my will is that my executors to be hereinafter named be empowered in that event to regulate who will have the farming of the place for the purposes above mentioned until he comes of age. And I do hereby institute and establish the above as my last will and testament revoking all former wills and testaments and I do hereby constitute and appoint my wife Mary Hamilton Executrix and my son John Hamilton and my son-in-law James Dinsmore Executors of this my will and testament. Be it remembered that on the tenth day of May in the year of our Lord one thousand eight hundred and fourteen before me Isaac Kerr, Register for the probate of Wills and granting Letters of Administration in and for said County came Walter Maxwell and Ebenezer McClane the subscribing witnesses to the aforegoing last Will and Testament of Robert Hamilton late of the County aforesaid deceased, who being duly sworn as the law directs do depose and say that they were personally present, and did see the Testator therein named sign this Will, and did hear him publish pronounce and declare the same to be his last Will and Testament, That at the time of his so doing he was to the best of their apprehensions of sound and disposing mind, memory and understanding, and that they respectively subscribed their names as witnesses to this Will in the presence and at the request of the Testator, and in the presence of each other. Know all men by these presents that we Mary Cowen late Mary Hamilton, James Dinsmore and Esther his wife, John Hamilton and Margaret his wife, Thomas Byers and Margaret his wife, John Miller and Mary his wife, John Ramsey and Amie his wife of Washington County Pennsylvania, Robert Hamilton and Elizabeth his wife and William Hamilton of Wheeling, Virginia, and James Hamilton of Medena State of New York heirs to the estate of Robert Hamilton deceased late of Canton Township Washington County Pennsylvania in consideration of the sum of twelve hundred and seventy eight dollars and seventy five cents to us in hand paid by Alexander Hamilton (also one of the heirs to the aforesaid estate) of the township County and State last aforesaid, the receipt of which is hereby acknowledged, Have bargained sold aliened and confirmed and by these presents do bargain sell alien and confirm to the said Alexander Hamilton his heirs and assigns all our interest right title and claim in and to a certain tract of land in Canton township Washington County Pennsylvania bounded by lands of Philip Hester heirs, John Wishart, John Miller, Ebenezer McLower and others (late the estate of the aforesaid Robert Hamilton deceased), containing one hundred and thirty acres more or less with allowances etc, it being part of land granted by Patent from the Commonwealth of Pennsylvania dated the twenty second day of August A.D. one thousand seven hundred and eighty eight to Robert Hamilton, and by him willed to the aforesaid by will bearing date the 17th December A.D. 1813, Together with all and singular the ways waters water courses and water rights hereditaments and appurtenances thereunto belonging or in any wise appertaining, To Have and to hold their interest and claim in the above tract of land to the said Alexander Hamilton his heirs and assigns to their only proper use and behoof of him the said Alexander Hamilton his heirs and assigns forever, and the aforesaid heirs for themselves their heirs executors and administrators do hereby covenant with the said Alexander Hamilton his heirs and assigns that their interest and claims in the above described tract of land to the said Alexander Hamilton his heirs and assigns will warrant and forever defend against all just claims whatsoever. In Testimony whereof we have hereunto set our hands and seals this sixth day of February in the year of our Lord one thousand eight hundred and twenty nine. Before me the subscriber a Justice of the Peace for said County personally came Mary Cowen, James Dinsmore and Esther his wife, John Hamilton and Margaret his wife, James Hamilton, John Miller and Mary his wife, John Ramsey and Amie his wife, and William Hamilton, part of the grantors in the foregoing instrument and acknowledged the same to be their act and deed to the intent that it should be recorded as such, the seaid Esther Margaret Mary and Amie being first by me examined apart from their husbands and the contents thereof made known to them declared that they executed the same of their own free will and accord. Given under my hand and seal the sixth day of February, A.D. one thousand eight hundred and twenty nine. John White, J.P.
Washington County Pennsylvania SS. Before the subscriber a Justice of the Peace in and for said County personally came Thomas Byers and Margaret his wife, Robert Hamilton and Elizabeth Hamilton wife part of the grantors in the foregoing instrument and acknowledged the same to be their act and deed to the intent that it should be recorded as such might be recorded according to law. She the said Elizabeth and Margaret separate and apart from their said husbands by me examined and the full contents of the said Indenture unto them made known whereupon they did declare that they did voluntarily and of their free will and accord seal and as their act and deed deliver the same without any coercion or compulsion of their said husbands whatever.
