This Indenture made this fourth day of March in the year of our Lord one thousand eight hundred and fifty between James Todd of the first part, George W Sights of the second part, and Rev John McClusky of the third part, the two first parties of the County of Ohio in the State of Virginia and the third party of Alexandria in the County of Washington State of Pennsylvania, whereas the said party of the first part is justly indebted to the said party of the third part in the sum of five hundred dollars and payable in two years from the date of this Indenture with legal interest thereon from date which interest is payable annually, said debt being evidenced by a certain note or bond given by said party of the first part and payable to said party of third part and whence said party of first part is willing and desirous to secure the payment of said debt and interest when the same shall become due and payable aforesaid, Now this indenture witnesseth that said party of the first part for and in consideration of the promises and for the additional consideration of one dollar to him in hand paid by said party of the second part the receipt of which is hereby acknowledged has granted bargained and sold and by these presents does grant bargain sell and convey to the party of the second part his heirs and assigns all the following described tract of land lying and being on the waters of Middle Wheeling Creek in Ohio County and State of Virginia and bounded as follows, Beginning at a stone corner at John Smith's line thence north forty five and three fourth degrees west one hundred and fifty four rods to a large white Oak thence south one half degree west twenty rods to a stone at William Todd's line thence South sixty five and a half degrees east one hundred and fifteen rods to a stone thence North twenty six and a half degrees east twelve rods to the beginning, containing twenty eight acres sixty eight perches more or less, together with all and singular the hereditaments and appurtenances rights and privileges belonging or in any wise appertaining to said hereby granted premises and any part thereof and all the estate right title and interest of said first party in and to said premises or any part thereof to have and to hold the same unto the said second party his heirs and assigns for his and their only proper use and behoof, said first party for himself his heirs executors and administrators by these presents to covenant with said second party his heirs and all and singular the premises hereby conveyed or intended to hereby convey unto said party of the second part his heirs and assigns shall and will warrant and defend against the of all persons [note the right margin of the second page of this deed was apparently tightly bound and not filmed, and approximately 1/2 inch of writing is missing from the film. Best guess follows] upon towit nevertheless that said party of the second part shall permit said party of the part to remain quiet and peaceably possessed of the hereby granted premises and to take the rents issues and profits thereof to his until default be in and in the payment of the said sum of five hundred dollars and the interest thereon either whole or in part and afterwards until regranted by said party of the third part by a written notice to that affect, And then tract, that so soon after the happening of such a of payment as he the said second party shall be there as aforesaid shall enter upon and take possession hereby granted premises and proceed to sell the same auction to the highest bidder for cash or memorand of credit offer ready money in part and on reasonable terms credit for the residue unto the trustee shall seem expedie proper and out of the proceeds of such sale shall first pay of writing and recording this deed secondly all mandatory and nable costs and charges attending the examination of the trust incl a reasonable compensation, so himself for his trouble and bility in the premises or not exceeding three per cent upon ment of said sale, Thirdly shall pay off and discharge all the aforesaid with its interest to the said party of the third part executors administrators or assigns, but before selling at at least thirty day notice of the time place and terms sale shall first be given by advertisement published in so newspapers printed in said city of Wheeling but the may adjourn such sale from time to time if to him shall seem expedient in order to obtain paid and ate price for the property by giving of a proclamation ther the terms and plans therefore last appointed for said and lastly if any balance is remaining in said trust after ho after paying the debt and interest last aforesaid he s pay the same to the party of the first part his leg representatives and assigns. But if the whole of said debt expenses incurred in giving notice of sale or that may be ily in and said about this to wit, before selling as aforesaid the indenture to be void else to remain in full force and . Witnesseth that the said party of the first part for and in consideration of the sum of two hundred and thirty two dollars and fifty cents to them in hand paid the receipt whereof is hereby confessed and acknowledged have granted bargained sold remised released aliened and confirmed and by these presents do confirm unto the said party of the second part and to his heirs and assigns forever all that certain tract or parcel of land situate and lying in the County of Ohio aforesaid adjoining certain lands owned by the said James Todd, Silas McDonald and Samuel Morris containing thirteen acres and a half acre to the same more or less owned and possessed by the said Thomas Myers at the time of his decease, together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining and the reversion and reversions remainder and remainders rents, issues and profits thereof and all the estate right title interest claim and demand whatsoever of the said party of the first part either in law or equity of in and to the above bargained premises with the said hereditainments and appurtenances to have and to hold the said premises above described to the said party of the second part his heirs and assigns to the sole and only proper use benefit and behoof of the said party of the second part his heirs and assigns forever and the said party of the first part for themselves their heirs executors and administrators do covenant, grant, bargain, and agree to and with the said party of the second part his heirs and assigns that at the time of the ensealing and delivery of these presents they were well seized of the premises above conveyed as of a good sure perfect absolute and indefeasible estate of inheritance in the law in fee simple. Ohio Co WV 84-604, dated 26 Apr 1890:
This agreement made and entered into this 26th day of April A.D. 1890 by and between James Todd of the County of Ohio and State of West Virginia of the first part and James A Chambers of the second part, Witnesseth, that the said party of the first part for and in consideration of the agreements herein after mentioned has granted, devised, and let unto the party of the second part, for the purpose and with the exclusive right of drilling and ofrenting(?) for petroleum and gas, all that certain tract of land situate in Triadelphia Township, Ohio County, state of West Virginia, bounded and described as follows, to wit, On the north by lands of James A Chambers, and Chambers and Conter, one the East by lands of McDonald heirs and State line, on the south by lands of said first party, on the West by lands of Joseph P Chambers and Public Road containing one hundred and fifty acres, to the same more or less, Together with the right of way over said premises to the place of operating, the right to lay pipes to convey water oil and gas, and the right to remove any machinery or fixtures placed on said premises by the party of the second part. The party of the second part is to have and to hold the said premises for and during the term of two years from the date hereof, and as m8uch longer as oil or gas is found in paying quantities. The said first party shall fully use and enjoy said premises for farming purposes except such parts as may be necessary for said operations. In Consideration of said grant and promise(?) the said party of the second part agrees to five or pay to the said party of the first part the full equal one-eighth part of all that oil produces or saved from the premises, and to deliver the same free of expenses, into tanks or pipe lines, to the credit of the first party. And should gas be found in sufficient quantities to justify marketing the same, the consideration in full to the party of the first part shall be five hundred ($500) dollars per annum for the gas from each well as long as it shall be sold therefrom, and gas free of cost at the well for household use on this farm, if gas is discovered in marketable quantities and three outside lights. It is agreed that there shall be no wells drilled within three hundred (300) feet of the buildings now on the premises, without consent of the first party.
It is further agreed, that the party of the second part shall commence a well on one of the farms within one mile in the block now being leased within thirty (30) days from execution of this lease, and prosecute the same with due diligence to completion, unavoidable accidents and delays excepted, and a failure to commence such well, or within ten days thereof shall render this lease null and void, and can only be renewed by mutual consent. And no right of action shall, after such failure, accrue to either party on account of the breach of any covenant herein contained. If first well should not be located on this farm, second party agrees to commence a will on the premises within 31 days from completion of said first or test well, providing oil is found in paying quantities in said first well. Second party has no right of way over these premises except for operations on these premises. The said first party receives the sole right to all material one the surface of this farm at commencement of operations, South line commencing at J. P. Chambers south east corner and running a direct lines to south west corner of McDonald heirs. It is further agreed that the second party shall have the right at any time to surrender this lease to the party of the first part, and thereby be fully discharged form his and all damages or claims whatsoever arising from and neglect on non-fulfillment of the foregoing contract. It is understood between the parties to this agreement that all conditions between the parties hereunto shall extend to their heirs executors and assigns. This Deed made the seventeenth day of September A.D. 1892 between James Todd and his wife, Mary Todd, parties of the first part, and George Heil, party of the second part, Witnesseth that whereas the said George Heil this day became the purchaser of about seventy seven (77) acres of land at a sale thereof by B. S. Allison, trustee, by virtue of a deed of trust made to him by Daniel McDonald and Harvey H. McDonald dated January 3rd 1891, and recorded in the Land Records of Ohio County West Virginia in Deed of Trust Book no 31 page 578, and whereas the said George Heil when he presented himself as a bidder declared that he was bidding for himself only, and not for or in pursuance of any arrangement with the makers of said deed of trust, and therefore, and on account of such statement, the said James Todd, in order to encourage bidders and promote a sale of said property, which property taken by itself is without access to a public highway, authorized the announcement, which was made, that he would give free of charge to the purchaser at such sale a right of way such as is hereafter described and conveyed, Now therefore in consideration of the promises, the said James Todd and his wife Mary Todd do grant unto the sid George Heil a right of way from the land so sold by said trust to said Heil over the farm of the said James Todd, for a road twenty (20) feet in width along the line between the line of the said James Todd and that of James B Chambers, to County Road, a distance it is believed of about seventy (70) feet upon condition, however, that the said George Heil shall before using the said right of way, build a good and sufficient fence on the farm of the said James Todd, parallel with and twenty (20) feet from the lines of the farms of the said James Chambers. Dec 23 1893 affidavit of F L Todd filed whereby it appears that James Todd late of West Alexander PA died on the 14th day of December 1893, between the hours of three and four o'clock, P.M.
The Last Will and Testament of James Todd., Ohio Co West Virginia.
Realizing the uncertainty of life and the necessity of having my worldly affairs arranged while I am in sound mind I make this my last will and Testament.
I. I direct after my decease that all my debts be paid as soon as may be without the sacrifice of property. To do this if it is necessary I direct a part of my real estate to be sold but the time and manner of its Sale is left to the discretion of my executors.
II. After the payment of my debts, I bequeath all my property personal and real to my wife Mary Todd if she survives me, without inventory or appraisement to be used by her for her maintainance and support. If the use of my property does not give her a comfortable support, she may use so much of the principal as well afford this support.
III. I give to my Son Thomas Milton the money he has already received in his education. I give to my son Hamilton the money he has received in his education and Three hundred dollars in addition to make him equal with my son Milton. I give to my son Frank L Todd the money he has received from me for his education. I give to Frederick, Grace, and Bessie children of my daughter Caroline One Hundred dollars each, to be paid after the decease of my wife. I give to Eva Arthur and Todd, children of my daughter Margaret, One hundred dollars each to be paid after the decease of my wife. The legacies given to my grand children mentioned above are to be paid by the executors in no case until they have attained their majority of 21 years. I give to my son Joseph four hundred dollars, to be paid after the decease of my wife and the settlement of my estate.
IV. When the above legacies have been paid after the decease of my wife Mary I direct my property to be divided into eight equal shares of which my son William shall receive one share my son John one share, my son Joseph one share, my son Alexander Renick one share, and my daughter Laura two shares and my daughter Emma wife of Elijah Moore two shares. If my daughter Laura should decease before the provisions of this will become operative she has from me the privilege of disposing of her share (by will) of my property as she may see fit and I direct my executor or executors to carry out her wishes.
V. I direct my executors to erect in the West Alexander Cemetery (in my lot) a suitable stone or monument not exceeding in cost Five Hundred dollars.
VI. I appoint my wife Mary and my son Frank to be executors of this my last will and testament and direct the Legal percent for the settlement of estates be reserved by him, as his compensation.

Newspaper obituary:
TODD - Died, in West Alexander, Pa., Dec. 14, 1893, of pneumonia, James Todd, aged 83 years and 10 months.
He was born of Scotch-Irish, pious parents, in Washington CO, PA., Feb 14, 1810. He was married to Mary Byers, Oct. 14, 1836, with whom he lived in happy wedded life 58 years, and who survives him. Twelve children were born to them. Three of these - T. Milton, I. Hamilton in Cal., and Frank L., in Allegheny - are physicians. Two daughters deceased - Caroline was the wife of Rev. H. G. Blayney, and Margaret, the wife of Rev. John Scott. All the children were members of the Church.
In 1829 he united with the Presbyterian church of W. A., and at his death was its oldest living member. In 1847 he was made ruling elder, and though in the latter part of his life he was nearly blind, he omitted no duty of his office.
His Christian character was marked by love for the Church and a conscientious faithfulness to its interests. He cherished with tenacity the old doctrines of grace, and opposed every effort to weaken or tone them down. He was a man of stalwart faith and rested fully on the Rock of salvation. Not long before his death he remarked to a friend: "God's mercy and love have been very great to me, all my life. He has been to me a convenant-keeping God, for which I am thankful." "As the sun sets in the evening sky, so he peacefully fell asleep in Jesus," and is at rest. [Ref: ClaysvillePA Recorder 12/1893]

The Board of Trust of the College Endowment Fund of the Synod of Wheeling do hereby certify that James Todd has paid two hundred dollars which entitles him the Laids [?] of James Todd to a Perpetual Scholarship or the right to send one student at any time to any department of the college; the said student to be subject, however, to the regulations and discipline of the Institution. Transferrable by assignment or by will.
