This Indenture made this seventh day of September eighteen hundred and twenty nine between John McCoy Administrator of the estate of Alexander McCoy deceased of Washington County and State of Pennsylvania of the one part and Elizabeth Todd of Ohio County State of Virginia of the other part, Witnesseth that the said John McCoy Administrator for and in consideration of two hundred dollars to him in hand paid by the said Elizabeth Todd the Receipt whereof the said John McCoy doth hereby acknowledge hath granted bargained sold released and confirmed unto the said Elizabeth Todd her heirs and assigns forever all the right title claim and demand whatsoever of in and to a certain tract of Lot of land lying and being on the waters of Wheeling Creek in Ohio County and State of Virginia and bounded as followeth, Beginning at a Stone corner to John Smith's line thence North forty five and three fourth degrees West one hundred and fifty four rods to a large White Oak thence South one half degree West seventy Rods to a Stone at William Todd's line, thence South sixty five and half degrees East one hundred and fifteen rods to a Stone thence North twenty six and half degrees East twelve rods to the Beginning, Containing twenty eight acres sixty eight perches be the same more or less, together with all and singular the rights liberties privileges improvements and whatsoever thereunto belongs or in any wise appertaining, To have and to hold the said described piece of land with the appurtenances unto Elizabeth Todd her heirs or assigns forever and the said John McCoy Administrator of the estate of Alexander McCoy deceased doth for himself and the heirs of said Alexander McCoy and against all and every other person or persons lawfully claiming or to claim will forever warrant and defend. This Indenture made this sixteenth day of March A.D.. eighteen hundred and thirty between Edward Coulter and Mary his wife of Ohio County and State of Pennsylvania of the one part and Elizabeth Todd of the aforesaid County and State of the other part, witnesseth that said Edward Coulter and Mary his wife for and in consideration of a sum of five dollars and twenty five cents to them in hand paid by the said Elizabeth Todd before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hat given granted bargained sold aliened and confirmed and by these presents do give grant bargain sell alien and confirm to the said Elizabeth Todd and her heirs a piece of ground in Ohio County and State of Virginia and situate on the waters of Middle Wheeling containing one acre and 36 1/2 perches and bounded as follows viz, Beginning at a stake thence North 81 1/2 East Seven poles to a White Oak thence North one degree West 33 poles to a White Oak thence South 18 1/2 degrees West 34 p and 7 L to the Beginning with its appurtenances the said Elizabeth Todd and her heirs to the sole use and behoof of the said Elizabeth Todd and her heirs and the said Edward Coulter and Mary his wife do covenant with the said Elizabeth Todd and her heirs that the said Edward Coulter and Mary and their heirs the said parcel of land with its appurtenances unto the said Elizabeth Todd and her heirs executors Administrators and assigns against all manner of persons claiming or hereafter to claim the same shall warrant and forever defend by these presents. Now as to a little history on Grandmothers side. Neelys' were all home in Ireland at a place known as Milltown on account of its natural water-power advantages and is the greatest flax growing and producing section in Ireland. Large flax industries are operated continuously by water power. A large landed estate surrounding this linen manufacturing little city as well as all of the site of the city was bequeathed to my grandmothers sister Mary on the day of her infant baptism, and was thus recorded in the archives of the church (Presbyterian), where a faithful record of every child born in the church was kept, and also recorded by the same hand in the family bible, so the two would correspond and corroberate, neither being of any value without the other. The language was "that she and hers were the heirs as long as grass grew and water ran". Now when she became a young woman and all she loved on earth and was dearer to her than all else besides, was to be parted from her to come to America, she could not be persuaded to remain behind, although a millionaire if she had. She came with the rest, and married a noble Christian man; raised a lovely and respected family of five, two sons and three daughters on a farm adjoining ours. Where Uncle and Aunt died, and their boys and girls went to Kansas about 50 years since. All dead except the descendant, my name-sake.
But you ask about the inheritance. Well, that is dead also. Sometime after coming to America, the family bible containing a-fore-said record, misteriously disappeared; never was or could be found. Agents went and traced the whole business up but nothing doing unless first producing the bible with corresponding record as that in the church record. After so many years had elapsed according to their law, it passed into Chancery, was sold and deposited in Bank of England, London, to nation's credit. I guess England needs it now worse than we do; it will help then to run down the Germans. It would amount now to several millions. So our people have contributed (I won't say willingly) a reasonably good share to help on the right side of this awful un-godly war. [Ref: William Todd 4/1916]

soon after her arrival in Washington Co, PA, attempts were made to have the estate settled in her favor; even as late as 1920 some descendants were trying to re-open the case. Terms were that when she became a young woman the legacy was to be hers and her heirs, but the family Bible in which the bequest was recorded was lost. The will is said to be recorded along with the baptism in the archives of the Presbyterian Church, but the law of the time required that the Church records and the family Bible entry be written "in the same hand" and the estate could not be settled without the Bible to prove identity. The case of the legacy was settled in court; the decision was that there no proven legal heirs, and the estate reverted to the Crown [Ref: Shields SAWHILL p11]
