Know all men by these presents that we Mary Cowen late Mary Hamilton, James Dinsmore and Esther his wife, John Hamilton and Margaret his wife, Thomas Byers and Margaret his wife, John Miller and Mary his wife, John Ramsey and Amie his wife of Washington County Pennsylvania, Robert Hamilton and Elizabeth his wife and William Hamilton of Wheeling, Virginia, and James Hamilton of Medena State of New York heirs to the estate of Robert Hamilton deceased late of Canton Township Washington County Pennsylvania in consideration of the sum of twelve hundred and seventy eight dollars and seventy five cents to us in hand paid by Alexander Hamilton (also one of the heirs to the aforesaid estate) of the township County and State last aforesaid, the receipt of which is hereby acknowledged, Have bargained sold aliened and confirmed and by these presents do bargain sell alien and confirm to the said Alexander Hamilton his heirs and assigns all our interest right title and claim in and to a certain tract of land in Canton township Washington County Pennsylvania bounded by lands of Philip Hester heirs, John Wishart, John Miller, Ebenezer McLower and others (late the estate of the aforesaid Robert Hamilton deceased), containing one hundred and thirty acres more or less with allowances etc, it being part of land granted by Patent from the Commonwealth of Pennsylvania dated the twenty second day of August A.D. one thousand seven hundred and eighty eight to Robert Hamilton, and by him willed to the aforesaid by will bearing date the 17th December A.D. 1813, Together with all and singular the ways waters water courses and water rights hereditaments and appurtenances thereunto belonging or in any wise appertaining, To Have and to hold their interest and claim in the above tract of land to the said Alexander Hamilton his heirs and assigns to their only proper use and behoof of him the said Alexander Hamilton his heirs and assigns forever, and the aforesaid heirs for themselves their heirs executors and administrators do hereby covenant with the said Alexander Hamilton his heirs and assigns that their interest and claims in the above described tract of land to the said Alexander Hamilton his heirs and assigns will warrant and forever defend against all just claims whatsoever. She the said Elizabeth and Margaret separate and apart from their said husbands by me examined and the full contents of the said Indenture unto them made known whereupon they did declare that they did voluntarily and of their free will and accord seal and as their act and deed deliver the same without any coercion or compulsion of their said husbands whatever. Washington Co PA Deeds 4Y-476, dated 29 Oct 1873:
This Indenture made the twenty ninth day of October A.D. 1873 between Mrs Margaret Byers in her own right as life tenant and as surviving executrix of her husband Thomas Byers, late of Washington Pennsylvania of the first part and John P McNary of the second part, Whereas the said Thomas Byers in and by his last will and testament duly proved and admitted to probate in the Reigsters office in and for the county of Washington State of Pennsylvania on the eleventh day of September A.D. 1863 devised to the said Margaret Byers the within described property for life and directed that the proceeds should be divided among his children after her death granting her executor therein named power to make a deed or deeds to the purchaser as fully as he would now do and therein appointed his said wife Margaret Byers executrix and Joseph Henderson now deceased, executor thereof. And Whereas by writing dated the 2nd day of September A.D. 1864 the heirs of the said Thomas Byers decd agree that she the said Margaret Byers executrix and Joseph Henderson, now decd executor may sell said estate and vest the money arising from said sale in United States securities. Now this Indenture witnesseth that the said Margaret Byers in her own right as tenant for life under said will and as surviving executrix of the said Thomas Byers decd by virtue of the power and authority aforesaid and in consideration of the sum of six thousand ($6000) dollars to her in hand paid by the said John P McNary the receipt whereof she doth hereby acknowledge hath granted bargained sold and conveyed and by these presents doth grant bargain sell and convey to the said John P McNary his heirs and assigns forever, All that certain lot of ground situate and lying upon the South-West corner of Wheeling and first Streets in the said towns of Washington Pennsylvania, fronting on Wheeling Street sixty feet more or less and extending back along First Street two hundred and forty feet more or less to an alley running parallel to Wheeling Street on which is erected a two story brick house on the front and a one story frame house on the rear end of the lot, To have and to hold the said described premises and hereditaments with the appurtenances unto the said John P McNary his heirs and assigns forever.
