This Indenture made this sixth day of July in the year of our Lord one thousand eight hundred and fifty three between Mary Smith of Marshall County and State of Virginia of the one part, Thomas Todd and John Hosic of the County and State aforesaid of the other part, Witnesseth that the said Mary Smith for and in consideration of the sum of one dollar, to her in hand paid by the said Thomas Todd and John Hosic at and before the ensealing and delivery hereof, the receipt whereof she does hereby acknowledge, and thereof acquit and forever discharge the said Thomas Todd and John Horsic their heirs executors and administrators by these presents, have granted bargained, sold, aliened, enfeoffed, released and confirmed, and by these presents does grant, bargain, sell, alien, enfeoff, release and confirm unto the said Thomas Todd and John Horsic and their heirs and assigns all my right title and interest in and to a third part of a certain tract or parcel of land lying and being in the County of Ohio and State of Virginia, situate on the Waters of Middle Wheeling Creek and adjoining lands of James Todd Samuel Chambers and others, the said one third part being my dower right in said farm, as devised by William C Smith, deceased, late of Ohio County and State of Virginia, Together with all and singular other the houses, outhouses, buildings, farms, stables, ways, woods, waters, water courses, rights, liberties, privileges, hereditaments, and appurtenances whatsoever thereunto belonging or in any wise appertaining and reversions and remainders, rents, issues and profits thereof, and also all the estate right title interest property claim and demands whatsoever of her the said Mary Smith in law or equity or otherwise howsoever of in to or out of the same. To have and to hold the said interest in and to one third part of said estate as aforesaid, with the rights and privilege hereby granted or mentioned or intended so to be, with the appurtenances unto the said Thomas Todd and John Hosic their heirs and assigns forever.

Ohio Co VA Deeds 38-232, dated 6 Jul 1853:
This Indenture made the sixth day of July in the year of our Lord one thousand eight hundred and fifty three between Thomas Todd John Hosic and William T Smith of the County of Marshall and State of Virginia of the one part and David Hosack and James Todd of the Ohio County and state aforesaid of the other part, Witnesseth that whereas the said parties of the first part in and by a certain bond or obligation duly executed bearing even date herewith, doth stand bound unto the said David Hosack and James Todd in the final sum of seventy four hundred dollars, current money conditional for the payment of twelve hundred dollars current money as aforesaid as the first day of April next ensuing the date hereof, with lawful interest for the same, as in and by the said recited obligation and condition thereof more fully appears. Now this indenture witnesseth that parties of the first part as well for and in consideration of the aforesaid debt, or sum of twelve hundred dollars and for the better securing the payment thereof, with the interest till paid unto the said David Hosack and James Todd their executors administrators and assigns in discharge of the said recited obligation, as of the further sum of one dollar to them in hand paid by the parties of the first part at the time of the execution hereof, the receipt whereof is hereby acknowledged, hath granted, bargained, sold, released and confirmed and by these presents doth grant, bargain, sell, release and confirm unto the said parties of the second part their executors administrators and assigns all that messuage or tract of land (devised by William C Smith, late of Ohio County, and state of Virginia) containing 106 acres more or less lying and being in the County of Ohio and State of Virginia and adjoining lands of James Todd and others, together with all and singular the buildings improvements ways waters water courses rights liberties privileges, hereditaments and appurtenances whatsoever unto the said hereby granted premises belonging or in any wise appertaining and the reversions and remainders thereof, to have and to hold the said messuage or tract of land with the hereditaments hereby granted or mentioned or intended so to be with the appurtenances unto the said parties of the second part, their heirs and assigns to the only proper use and behoof of said parties of the second part their heirs and assigns forever, Provided always nevertheless that if the said parties of the first part their heirs and executors administrators or assigns shall and do well and truly pay or cause to be paid unto the said parties of the second part their executors administrators or assigns the aforesaid debt of twelve hundred dollars on the day and time herein before mentioned and appointed together with lawful interest for the same according to the conditions of the same recited obligation, without pand(?) or further delay, and without deduction defulcation or abatement to be made for or in respect of taxes charges or assessments whatsoever there, as well as this present indenture and the estate hereby granted as the said recited obligations shall become void and of no effect, and thing herein contained to the contrary in any wise notwithstanding. State of Virginia, County of Marshall to wit, I John Jefferson a Justice of the Peace for the County aforesaid in the State of Virginia do certify that John Hosick Thomas Todd, Elizabeth N Smith and William T Smith whose names are signed to the deed hereto annexed, bearing date on the nineteenth day of April 1854, have acknowledged the same before me in my County aforesaid. Given under my hand this 26th day of July 1854, eighteen hundred and fifty four. John Jefferson, J.P.
State of Virginia, County of Marshall, to wit, We John Jefferson and William Keys Justices of the Peace for the County of Marshall in the State of Virginia do certify that Dorcas M Hosac the wife of John Hosic and Susan Todd the wife of Thomas Todd whose names are signed to the deed hereto annexed, bearing date on the nineteenth day of April 1854,personally appeared before us in the county aforesaid, and being examined by us privately and apart from their husbands and having the deed aforesaid fully explained to them, they the said Susan M Hosic and Susan Todd acknowledged the said deed to be their act and declared they had willingly executed the same and do not wish to retract it. State of Ohio, Miami County SS. Be it remembered that on this 12th day of July 1854 before me a Notary Public in and for the County of Miami and State of Ohio, personally came John A Smith and Mary Ann his wife, two of the grantors in the above conveyance, who acknowledged the signing and sealing of the same as their voluntary act and deed for the use and purposes therein mentioned. The said John A Smith executing the same both in his own behalf and as executor of the will of Wm C Smith, late of Ohio County Virginia, decd.
And the said Mary A Smith being at the same time examined by me separate and apart from her said husband, and the contents of the said instrument being by me made known and explained to her, then declared that she did voluntarily sign, seal and acknowledge the same and that she is still satisfied therewith.
