To All People to whom these Presents Shall come Valentine Probst of Albany Township in the County of Berks in the province of Pennsylvania Yeoman sends Greeting. Whereas the Honorable Thomas Penn and Richard Penn Esquires the Proprietaries and Governors in Chief of this Province etc in and by their Patent or Grant under the Hand of the Honorable John Penn Esquire Lieutenant Governor and the said Proprietaries Commissioner of Property in that behalf duly constituted and Great Seal of the Said Province bearing date the eleventh day of May in the year 1764 did for them the Said Proprietaries their Heirs and Successors for the consideration therein mentioned give grant release and confirm unto the said Valentine Brobst his Heirs and Assigns A certain tract of land situate in Pine Creek in the said County of Berks by meets and bounds in the same Patent particularly set forth and described containing thirty two acres and a half being the customary allowance of six acres Pcent for Roads etc Together with the Appurtenances To hold to him the said Valentine Brobst his Heirs and Assigns forever And on the yearly quit rent of one half penny Sterling for every acre thereof or value thereof in Coin current etc as in and by the said Recorded Patent Recorded at Philadelphia in Patent Book AA Vol 5 pages 540 etc relation thereto had at large appears, And Whereas the said Valentine Brobst and Catherine his Wife by their Indenture bearing date the last(?) day of September last past for the consideration therein mentioned did grant and confirm msh(?) certain one hundred and twenty eight acres and sixty five perches granted three hundred and thirty two Acres and a half unto Henry Reichelsderfer of Albany Township aforesaid Yeoman in fee, And Whereas the said Henry Reichsderfer actually paid a proportional part of the purchase monies for the whole tract and they the said Valentine Brobst and Henry Reichelsderffer having erected a Saw Mill on the remaining part of the said tract, agree to hold and occupy the same as Tenants in Common, And to the end and intent that an undivided Moiety of the Said saw Mill and remaining part of the said tract of land and of the rents issues and profits thereof may be effectically(?) sunres(?) to the said Henry Reichelsdorffer his Heirs and Assigns, Now Know Ye that the said Valentine Brobst doth by these Presents declare and agree that he and his Heirs will from henceforth stand seized of one full equal amount and Moiety of the said Saw Mill and two hundred and four acres and fifteen perches of land and Warrants residue of the said three hundred and thirty two acres and a half and of all and Singular other the Buildings thereon erected or to be erected and of all and Singular the rents issues and profits thereof In Trust for the said Henry Reichelderfer his Heirs and Assigns to and for the only proper use benefit and behoof of the said Henry Reichelderfer his Heirs and Assigns forever, And the said Valentine Brobst and his Heirs doth hereby covenant to and with the said Henry Reichelderfer his Heirs and Assigns that he the said Valentine Brobst and his Heirs at the proper Cost and charges in the Law and upon the reasonable request and demand of the said Henry Reichelderffer his Heirs or Assigns Shall and will grant and convey in due form of Law the aforesaid Moiety of the said Land Mill and two hundred and four acres and fifteen perches with the Appurtenances to such Person or Persons and to and for such use as the said Henry Reichelderfer his Heirs or Assigns shall direct and payment. Remonstrance of Inhabitants of Berks County
To the Honourable Representatives of the Freemen of the State of Pennsylvania in General Assembly met:
The following remonstrance of a number of the inhabitants of Berks County Sheweth,
That we are not a little surprised to find that a Resolve has passed the Honourable House at your last sessions calculated to throw the State into a new convulsions and revive the animosities which, we have reason to believe, are well nigh allayed, namely, that the sentiments of the People might be taken respecting a new Convention to alter or abolish certain articles of our happy constitution. As it is our undoubted privilege to have our sentiments respecting this resolve laid before your Hon'ble Body, we are bold to say that they come fro men who have the most tender regard for the Honour and Reverence for the dignity and authority of our Representatives acting in a legal and constitutional manner.
It has been our Study to promote order by supporting your authority when just raising its head against the confusion and licentiousness of the times, and that virulent opposition it met with from a factious and disappointed party. Be assured, then, that it is with the utmost reluctance we either complain of your proceedings or call in question your power.
Yet, as we regard the future Tranquility and Safety of the State, we cannot, in Justice both to ourselves and Representatives, avoid sending up to the Honourable House the warmest remonstrance against a resolve in every point of light fraught with danger and mischief to the State, and praying that at your next session it may be wholly rescinded.
We are at a loss to know what could have induced the Hon'ble House to pass a resolve of such an extraordinary nature, when there was neither a call of the people, nor yet any embarrassment in the way to obstruct the execution of your laws. If such opposition and embarrassment had subsisted, it must doubtless have been first felt by the Executive branch, who doubtless would have represented the incompetency of the constitution in its present form for the purposes of good Government, and concurred with you in taking the sense of the people upon the proposed amendments. But no such representation has been made by the Hon'ble Council, and therefore we presume no such incompetency has been found. Nay, so far from this, we are informed, on good authority, that the measure was reprobated by the council as calculated to produce the most pernicious effects. We think it would have been but common decency to have taken the council with you in a matter not belonging to you in a legislative capacity and in which they were equally the Representatives of the people with yourselves.
But we can trace the rise of your Resolve no further than your own House. Had you been elected to sit a s a convention, there would have been strict propriety in your Conduct: but considered as an assembly, chosen and appointed to act upon a Constitution already formed to your hands, you have exceeded your power, have violated the purposes of your election, and exposed the Constitution to the risque of a single election, of which you were the appointed Conservators and Guardians, and which you had plighted your faith to preserve inviolate. Had you declared that you would not hold your seats Under the Constitution, there would have been found Persons, doubtless, who would. But to profess to hold them, and proceed to transgress the purposes for which you were chosen to fill them, of no other alternative but either resigning your Seats or Rescinding your resolve. We cannot but judge that you have Strangely neglected the Constitution in your hasty Resolve, when no sudden necessity pressed you, and that the State of the votes appointed to be taken is both absurd and ensnaring, by doubling it so that persons must vote both for and against the same thing at one and the same time.
However, the Hon'ble House may reconcile their proceedings with their own solemn Oath to preserve the Constitution inviolate, we cannot help thinking that they meant either to tempt those of their Constituents who have taken the same solemn Oath to violate their faith, or to shut them entirely out of the proposed election. We are truly surprised at the Hon'ble House in holding up for the consideration of the proposed Convention propositions that lie at the very foundation of our Constitution, and makes us conclude that the house have a very low opinion of that dignity and independence to which we have raised them, by subjecting themselves to the precarious determination of a Convention whether another house should be created and set over their head to check and control their proceedings. We wish to see no power above you but that of the people, and however you may be determined to sport with your privileges, we are determined not to part with ours. We choose to retain the reins of Government in our own hands, and as the power is radically with us, resolve that no Particular body of men, whatever wealth, influence or Talents they may possess, shall check or control you otherwise than as members of the community at Large.
When we consider this and the subsequent Articles, all calculated to draw the power out of the hands of the people and to vest them in the hands of a few, we have just grounds to apprehend that the Resolve in question has originated from some discontented and ambitious spirits in your house, as the former opposers of our independence and Servants of the Propriatary have been in general the foremost in opposing the Constitution and embarrassing and enfeebling the government established thereon.
As the Constitution appears to have made the amplest provision for securing the liberties of the people, we persuade ourselves that those in your house or elsewhere who would either weaken or overthrow it have other ends in view than the Liberties of the people, namely, the gratification of their insatiable lust after Power and Domination, accounting it better to approve themselves to a Governor and Council of overgrown and dangerous Citizens, than to their fellows, by whose free suffrage their pride disdains to hold an office.
To put the good people of this State to the Trouble and expence of a new Convention to unhinge their Government, to divide them into parties and irritate their minds for the sake of certain supposed inconveniences in the present Constitution and form of Government, said to be suggested by divers petitions presented to former assemblies, altho', as the Hon'ble House observes in their address to the inhabitants of this State, they were confronted by a vastly superior number, and even those Petitioners not renewing their Request, was beneath the wisdom of the legislative Body and inconsistent with the Goodness of heart which they should always manifest, with that Harmony, good order and universal benevolence which they should always cultivate in every part of the State; and we would beg leave further to observe that the invasion of the State, the resolution of a former assembly being dropped, and for good reasons never taken up until your Hon'ble House thought proper to revive it in a manner very different from theirs, and with an Artifice of which they were incapable, wore the true Causes why Remonstrances of a similar nature to this were not generally presented against the measure.
Upon the whole, we cannot but apprehend that the Hon'ble House have come into the Resolve with precipitation, have gone beyond the line of the power delegated them, laid the foundation for anarchy and confusion to reign throughout this State, and therefore require the Honourable House to retract said resolve, and never attempt carrying into execution a measure pregnant with the greatest evils, and which we cannot think of without Horror. In the name of God the father, and of the son, and of the holy Ghost, Amen. I Henry Reichelderfer the elder, in Albany Township, Berks County, in the State of Pennsylvania farmer, am on account of age, weak as to my body, but yet of sound mind and memory, God be praised, who brings to my recollection the mortality of my body, and knowing that it is appointed for all men once to die, do make and order this my last Will and Testament, that is to say, Principally and first of all, I give and commend my Soul into the Hands of Almighty God who has given the same, and my body I commend to the earth, to be buried, in a decent christian burial place according as my executors think proper, not doubting, but in the general resserection I shall receive the Jesus again through the mighty Power of God, and to making just ___ of property, whose wish it hath pleased God to bless me in this Life, I give and bequeath of the farm in the following mannor and form.
1. The executor, that he shall here in this his last Will elect, shall get a Tombstone made for Henry Reicheldorffer, and put the same on his grave, and the payment for the same, they shall take out of the estate.
2. My five daughters shall have one hundred pounds first of all, which shall be twenty Pounds to each, or to their heirs, but in the remaining property the five daughters shall inherit as well as the other sons.
3. I Henry Reichelderfer say, that I have land on the little Schulkill in the Township, if he does not sell this piece of land in his lifetime, then the executor shall sell that piece of land after his decease, or at public vendice.
4. Another piece of land adjoining the Blue mountain and George Boones Line, lying in Albany Township Berks County, this piece of Land is about two hundred and twenty acres, now when the Children survey it, they shall from George Boone's Line out through to the Blue, in order that every child or heir may get his if he wants the land, but if they don't want the land the Executor shall sell it at public vendice.
5. Another piece of land, to wit, the Company Land, which he hath sold to his son Harry, the money which he is to pay to his father, to this his Son Henry shall be an heir as the others.
6. The Wind mill shall be or stand, where it is, and also the stove in the house; and Michael shall have his father's guns; and my son Henry shall have the father's part of the saw mill; and the father's clothes these three sons shall divide among them, as well as they can, and if there should remain any linen, the daughters shall divide the same among them, as well as they can.
7. And what I give as father to one or the other of my children, there shall be no objection or dispute about from the others, but shall be satisfied.
8. But should any or one of all my Children attempt to reject this my Last Will, or make the same null, he or they shall each for this offence, have for his inheritance out of all my estate only one shilling sterling and no more. Aid I order as executor Simonn Wertman and my son Michael Reicheldorffer of this my last Will and testament and I do hereby recall and declare as null and void all and every by me heretofore made bequest, Wills, and Testament, certify this and no other to be my Last Will and Testament. In Witness thereof I have hereto set my hand and seal, the seventeenth day of September in the year of our Lord one thousand seven hundred and ninety five.
