Will of Jacob Wertman, in Ashland County, Ohio, Probate Box 1446:
In the name of the Benevolent Father of All I Jacob Wertman of the County of
Ashland and State of Ohio do make and publish this my last will and Testament
as follows: It is my will that my funeral expenses and all my just debts be
fully paid. It is my will that my beloved wife Magdalena Wertman in lieu of
her dower, shall have during her natural life the one third of all the wheat,
rye, oats corn barley & potatoes raised on that portion of my farm in the
County of Ashland Ohio, which lies in the Township of Clear Creek in said
County to be delivered in the bushel each year at the barn in said premises,
and also my said beloved wife shall each year the one third of the hay raised
on said premises including clover & timothy, to be delivered & put in the barn
on said premises for my said wife; I also give and devise to my said beloved
wife in lieu of her support allowed by law, a horse, buggy and harness and as
many cows, sheep & hogs as she may see proper to select and all my household
furniture, beds & bedding and every thing in and about my house including a
copper kettle & two iron kettles to her and her heirs forever; It is my will
that my said beloved wife shall have her firewood cut & hauled to the house
where she may reside and cut up ready for the stove during her natural life
and my executors hereinafter named shall see to & cause the same to be done to
be paid for out of my real and personal estate and in case the said horse
bequeathed to my said wife shall die, then it is my will that my said
executors shall buy another suitable horse and give the same to my beloved
wife and pay for the same out of the proceeds of my real and personal estate;
It is my will that said wife shall reside during her natural life in the house
where I now reside and my executors shall see that my said wife has everything
in addition to what I have heretofore willed her, which shall comfort and
convenience may require. I also give and bequeath to my daughter in law wife
of my son Jesse Wertman & the children of my said daughter in law by the said
Jesse Wertman their heirs and assigns forever sixty six acres of my land off
the south side of that portion of my real estate situate in the Township of
Orange in said Ashland County free from any debt or incumbrance by this will
or otherwise. It is my will that there shall be a road along the north line
of said sixty six acres a rod wide & thence in a straight line to the east
side of my Clear Creek farm.
I also give devise and bequeath to my son William Wertman his heirs and
assigns forever all my farm in the said Township of Orange except the said
sixty six acres and fifteen acres out of the North east corner of the same in
a square form, & subject to the incumbrance of said road through the same. It
is my Will also that all my real estate situate in the Township of Clear Creek
of which I shall die seized and the said fifteen acres in the north east
corner of my Orange Township farm foresaid shall be sold and conveyed by my
executors hereinafter named by good and sufficient deed or deeds upon terms
such as my executors shall think proper after the death of my said beloved
wife, except that the deferred payments shall not extend beyond the period of
three years from the time of sale, and the proceeds of the sale of my said
lands, after paying all expenses & other payments out of the same that may be
directed by the provisions of this will, shall be equally divided between my
children, Enoch Wertman, Elizabeth Grotz, Perry Wertman, & Isaac Wertman their
heirs and assigns forever; I give and devise and bequeath son Jesse Wertman
the sum of one hundred & sixty seven dollars or thereabouts, which I have
paid for him within the last two years & I direct that the same shall not be
collected back from him but this is all that I allow him to receive out of my
real and personal Estate; My son Enoch Wertman owes me sixty five dollars for
a horse, which, without interest, shall be divided between the said Enoch,
said Elizabeth, said Perry & said Isaac my children equally. Also it is my
will that my said wife shall have all her doctor Bills and expenses during her
sickness paid out of the proceeds of the said real estate ordered to be sold
as aforesaid; It is my Will that my executors shall rent or lease my said farm
in Clear Creek Township & the said fifteen acres in Orange Township to
themselves or some other good man, who shall give the share of the grain hay
etc specified in this will to my said wife and shall also pay the taxes, this
shall be done until her death when the farm shall be sold with the fifteen
acres aforesaid. It is also my will that my said wife shall have the
exclusive use of the house and garden where I now reside during her natural
life & what ever stock my said wife shall have & her horses shall be pastured
on said premises in clear creek Township in good pasture free of charge. It
is my will that whatever money or notes or claims & Noses in action that I may
have at my death shall belong to my said wife her heirs and assigns forever &
the horse of my said wife shall be fed and attended without charge. I mean
that the land bequeathed to my son William shall be free of all incumbrance by
the provisions of this will as for debts but that all expenses that may not be
met & debts & provisions of this will shall come out of the land ordered to be
sold by my executors aforesaid unless I may have sufficient personal property
not otherwise disposed of in this will to pay the same. I do hereby nominate
and appoint my two sons Enoch Wertman & William Wertman executors of this my
last will and Testament. I do hereby revoke all former will by me made
ratifying and confirming this and no other, in Testimony whereof I have
hereunto set my hand and seal this 14th day of January A.D. 1862. Jacob
