Will, dated Apr 9 1873:
In the name of God, Aman. As I George Adam Zettelmoyer of Greenwich
Township, Berks County, Pennsylvania yet in good health and my bodily and
mental judgement is and are good and right so I make this my Last Will and
Testament, namely
First I command that after my death, my lifeless body shall be buried,
christianlike, and the funeral expenses shall be paid by my son William or by
the occupand of the farm.
Second I command and bequeath to my beloved wife Esther that as her dwelling
place, if she should survive me, as follows: the two rooms or apartments which
she like or pleases her best, in the house where we now reside, also the right
or regress or ingressing in and through the house, as also the right in the
garden, for to raise her means of substance, as she wishes and needs it, and
free regress and ingress thereto, as also to the Water, Barnyard, and to the
Apples for her own use. Also my son William or the occupant of the Land or
Farm shall give to her the Apple Butter from one barrel of Cider.
Third I command and bequeath to my beloved wife Esther two cows (her own
choice) for her own use during her natural life, after her death these two
cows or two other cows, shall fall back again to my children, but should it be
the case, that her cows shall not suit her, so she shall have the right to
sell one or both, and buy others at their or in their stead. Also she shall
make choice of two fat hogs for herself from those of the occupant of the
Land, thereafter she shall each as well in every year (if she should survive
me) keep two shoats of the same kind, as he who has the land in possession or
owns it, the cows and the shoats shall have the right to run on the Land or
the Farm and to pasture with his cattle and hogs, who has the Land in
possession. Also they shall and must be fed, with good hay and grain through
the whole and each winter, with the cattle and hogs of him who occupies the
Land.
Also the occupant of the Land or Farm shall and must give her Wheat and
other grain as much as she needs for her own use. Also deliver it at the
mill, as even also the flour & again home and to her in the house, at the
place she wishes to have it. The occupant also shall haul home and deliver
her the firewood (good) as also to make it small and fine for stove use, and
to bring it into the house if she desires it.
Fourth, the owner or occupant of the Land shall furnish a maid and help to
wait upon her, if she does not find herself in good health if she desires it,
and render medical aid, or call a Physician whom she wishes to have and when
she desires it, at his own costs.
Fifth, I bequeath to my wife Esther, a wood stove any one she wishes to
have, also the house clock and the apple butter kettle for her own use, as
long as she lives, and after her death, these three articles shall come again
to my yet surviving children.
Sixth She shall have the right to take potatoes from the heap of the owner
or occupand of the land, as many as she needs during her natural life.
Seventh I bequeath and command to my wife Esther and my son William All
those certain Bees, with the Baskets and Stands. And further the two hundred
dollars ($200) which I have given my wife Esther, she shall retain for herself
forever.
Eighth, I command and bequeath to my son William, All that certain
plantation or farm where I now reside, and upon which the above named shall
ausbehalt or Dower for my wife Esther remains, Adjoining Land of George
Merkel, Jacob Kremer, Joel Stump and others as also the field or piece of
ground which I have purchased from John Frey (nearly 12 acres) containing
together 161 acres more or less.
As also that certain tract of Woodland about 10 1/2 acres with the right or
deed which I still have in my possession, as well as all my other deeds and
hereinbefore mentioned landed property gratuitiously.
I also grant him (William) that certain piece of woodland of about 55 acres
more or less situate in Albany Township adjoining Land of Jacob Borky, Gideon
Sunday, Reuben Miller and others. If he (William) does not wish to have it,
then it shall be sold at public sale nevertheless if he (William) retain it,
he must pay therefor five hundred dollars ($500)
Ninth, my son William shall not stand in the inheritance with my other
children in my remaining property, be it personal or real Excepting if he
(William) does not wish to have the farm or does not take it, then he shall
have his inheritance, like the others through my entire property.
Tenth, I recommand that if my wife (Esther) desires to take the third part,
so it must come out of the farm, and not out of the personal property.
Eleventh, I recommend that all notes or papers against my children as they
are found shall be charged against them (children) or be deducted from their
inheritance.
Twelvth, I grant to my yet living sons Charles and Samuel, and my daughters,
Elizabeth, Rebecca, and Race and Maria, all my other and remaining property in
equal shares, nevertheless I recommend that if my daughter Rebecca has
anything yet remaining after her notes &c are deducted, so the balance, my
son William shall take in hand without interest, and shall give her annually
thirty ($30). But should it be the case, that she die or not survive my son
William, so shall he (William) retain the balance or remainder for himself
forever, if there is yet something here thereof.
Thirteenth, I grant and bequeath to my grandchild Willoughby Rhodes, son of
my deceased daughter Salome, five dollars ($5.00) of my allowed or unallowed
he shall receive nothing.
Fourteenth I order that if one of my children, or that one that receives
anything by this will &c, and is not satisfied and wishes to make expense so
that one shall receive nothing from my property.
Fifteenth I appoint my son William as executor of this my last Will and
Testament, and for his reward or payment he (William) shall receive seventy
five dollars ($75)
Lastly For the execution and true performance I seal this with my hand mark
and seal, as my last Will and Testament in the presence of these witnesses,
today, date the ninth (9th day of April one thousand eight hundred and severty
three (1873))
