Last Will of George Gearhart
"In the name of God Amen, I, George Gearhart of the township of Albany,
County of Berks and State of Pennsylvania, yeoman being weak in body but of
sound mind, memory and understanding, do make and publish this my last will
and Testament in manner and form following to Wit....
First, it is my will and I do order that all of my just debts due and
funeral expenses be duly paid and satisfied as soon as conveniently can be
after my decease. Item, I give and bequeath unto my wife, Christina all my
property real and personal during her natural life and immediately after her
decease, I give and devise my plantation and all the lands belonging to me and
all the personal property that may be in possession of my wife at her decease,
to the children of Benjamin Hendric, namely Michael, Jeremiah, George and
Molly and in case Benjamin Hendric should have more children by his present
wife, then they are all to have equal shares of my property, real and
personally and their heirs and assigns, forever. And, lastly, I nominate,
constitute and appoint my said wife and Benjamin Hendric to be the Executors
of this my last will and Testament hereby revoking all other wills, legacies
and bequests by me heretofore made and declaring this and no other to be my
last will and Testament.
In Witness whereof, I have hereunto set my hand and seal the thirtieth
day of March, one thousand, eight hundred & twenty seven. George (his X mark)

Signed, Sealed and Declared by the said Testator as his last will and
Testament in the presence of us Henry Smith Abraham Braucher
Registers Office, Reading, Berks Cty, April 16th 1827, then appeared
Henry Smith & Abraham Braucher, witnesses to the aforewritten will who were
duly qualified according to Law did declare and say that they were present and
did see and hear George Gearhart, the Testator sign by making his mark,
publish, pronounce and declare this writing as and for his last will and
Testament and at the time of the doing thereof he, the said Testator was of
Sound mind, memory understanding to the best of their knowledge & as they
verily believe.
Because Benjamin Hendricks died in 1839 and prior to Christiana, her death in
1851 resulted in the following two actions before the courts in Berks County
during the year following her death. The following is a transcription of a
proceeding on the Estate of John George Gerhart, Deceased that is recorded in
the Orphans Court records (Real Estate) Vol 17, p 412-3-4, Reading, Berks
County, Pennsylvania, April 23, 1851. [Ref: John Hendricks 12/14/1995]
At an Orphans Court held at Reading in and for the County of Berks on the
23rd day of April A.D. 1851 before the Honorable David F. Gorelon, Esq,
President and John Shaeffer and Samuel Bell, Esqs, Associate Judges of Said
Court, Upon the petition of Michael, Jeremiah, George, Mary, Daniel, Hannah,
Sarah and Caroline, being all the children of Benjamin and Rebecca Hendrix.
Said children being the residuary division of George Gerhart, late of Albany
Township, County aforesaid. Setting Forth: That the said George Gerhart,
Many years ago, having by his will duly recorded at Reading, devised among
other things, all his real estate at the death of his widow, Christiana, now
lately died, to your petitioner that the said George Gerhart died ....... in
his demis as of fee of and in the following described real estate to wit: All
those certain three tracts of land in Albany Township aforesaid, one of them
bounded by lands of Englemoyer, George Schwenk, Michael Schmith and Peter
Knepper and containing about two hundred and eleven and one half acres. The
second is bounded by lands of Englemoyer and the first described tract
containing about thirty three acres. The third tract is bounded by the
aforesaid Englemoyer, the second tract and the Blue Mountain containing about
fifty five acres be the same more or less, being the same described tracts of
land conveyed in fee simple by Jacob Gerhart to the above named George Gerhart
by deed dated April 27 A.D. 1793.
Also, All that certain other tract of woodland situated in the Township
aforesaid lying along or under the Blue Mountain containing about fifty acres
more or less adjoining lands of George Reagan, David Heinly and John Miller
for which the said George Gerhart took out and holds a Land Warrant in his own
name. No Partition or valuation of the said real estate having been made.
Your Petitioners pray the Court to order and approve Henry Mull, Christian
Miller, Jacob Bohler, Samuel M. Kistler, Henry Smith, William B. Decker & John
Zettlemoyer, who were chosen by your petitioners for that purpose to make
partitions or valuations of the said premises according to the laws of this
Commonwealth in such case made and provided and to make report of their
proceedings herein at the next Orphan Court after they shall have so valued
the same. Whereupon the Court on due consideration order and appoint Henry
Mull, Christian Miller, Jacob Bohler, Samuel M. Kistler, Henry Smith, William
B. Decker and John Zettlemoyer to make partition of the premises to and among
the heirs and legal representatives of the said Will in such manner and
proportions as by the laws of this Commonwealth .... is ......., if such
partition cannot be so as aforesaid made then to value and appraise the same
and make report of their proceedings herein to the next Orphans Court after
they shall have so valued the same. At an Orphns Court held at Reading in and
for said County of Berks on the 8th day of August A.D. 1851 before the
Honorable David F. Gorelon, Esq., President and John Stauffer and Samuel Bell
Esqs, Associate Judges of Said Court. We the Subscribers appointed by the
accompanying order of court to make partition of the real estate therein
mentioned of which George Gerhart died Siesee therein names, if such partition
could be made without prejudice to the whole. Otherwise to value and appraise
the same.
Do Report: That in pursuance of the said order we have viewed the
premises therein mentioned or described and finding that the same could not be
separated and divided to and among all the parties in the said order mentioned
without prejudice to or ........ the whole, have valued and appraised the same
as follows to wit: The Tract No. 1 Described in the said order, we appraised
into three parts or tracts as follows:
No. 1-A part of the described certain tract in the said order mentioned
as part of the same three tracts conveyed in fee simple by Jacob Gerhart to
George Gerhart by deed dated April 27 A.D. 1793. Bounded and described as
follows; adjoining by lands of Henry Smith, George Schwenk, John Miller and
others, containing two hundred and forty three acres forty four perches more.
We have valued and appraised at the sum of three thousand six hundred forty
nine dollars and twelve and half cent--($3649.12).
No. 2-A Part of the aforesaid tract, Bounded by land of the aforesaid No
1 Henry Mull, Jacob Kneffer and Peter Knepper. Containing 53 A. 30 P. more or
less. We have valued and appraised at the sum of five hundred thirty one
dollars and eighty seven and half cent--($531.87).
No. 3-Also a part as two lots of the aforesaid No. 1 tract, one lot
containing 15 A. 123 P. clear and 4 A. 124 P. of woodland together 20 A and 87
perches, bounded by lands of No. 1, Jacob Knepper, Henry Smith, John Miller,
and others, we have valued and appraised at the sum of four hundred fifty one
dollars and ninety six and a quarter cent ($451.96).
No. 4-All that certain remaining tract of woodland in the aforesaid order
describes No. 2 and mentions containing seventy seven acres, bounded by lands
of George Reagan, D. Heinly, John Miller and Peter Kline. We have valued and
appraised at the sum of three hundred eighty five dollars. ($385.00).
Witness our hands and Seals this 28th day of July A.D. one thousand eight

Now to Wit, Aug 8, 1851, the Court, all the Judges present, confirm the
written proceedings and give judgement that the same remains firm and stable
forever and that the costs be paid by the parties concerned. Same day
appeared personally in open Court all the parties: Michael Hendrix, Jeremiah
Hendrix, George Hendrix, Mary & Daniel Hendrix and Hannah Hendrix, Sarah
Hendrix and Caroline Hendrix by their Guardian, George Genser, and severally
refuses to accept of the within real estate or any part thereof at the
valuation thereof & severally desire that the same might be sold whereupon the
court grant an order of sale, and order the said Michael Hendrix to sell the
same.
Thus ends the first proceeding in the Berks County court. [Ref: John

The following is a proceeding on the Estate of George Gerhart, Deceased
that is recorded in the Orphans Court records (Real Estate) Vol 17, p 463-4,
Reading, Berks County, Pennsylvania, August 8, 1851. [Ref: John Hendricks

At an Orphan's Court held at Reading in and for the County of Berks on
the 8th day of August A.D. 1851. Before the Honorable David F. Gorelon, Esq.,
President and John Stauffer and Samuel Bell, Esqs, Associate Judges of Said
Court. Whereas Henry Mull, Christian Miller, Jacob Bohler, Samuel M. Kistler,
Henry Smith, William B. Decker & John Zettlemoyer were appointed by said court
to make partition or valuation of the real estate of George Gerhart, and that
they did make partition and valuation of the real estate as set forth in their
return which proceeding was at an orphans court held at Reading on the 8th day
of August 1851 wherein after due consideration the Court confirmed and gave
judgement that the same be and remain firm and stable forever and that the
costs be paid by the parties concerned. Same day all the parties appeared in
open court: Michael Hendrix, Jeremiah Hendrix, George Hendrix, Mary & Daniel
Hendrix, Hannah Hendrix, Sarah Hendrix and Caroline Hendrix, by their
guardian, George Gensen, and severally refused to accept of the within real
estate or any part thereof, and further, Severally requested that the same
might be sold, whereupon the court gave an Order of Sale for the within
described real estate to wit: A certain mesurage Tenement and tract of
land situate in Sacai, Albany Township, Berks County, bounded by lands of
Henry Smith, George Swenk, John Miller and others, containing two hundred and
forty three acres and forty four perches more or less. The improvements are a
log dwelling house and kitchen attached, Schweitzer barn and also a good
orchard on the premises and a well of water near the door. Also a tract of
land situate in the same township and county bounded by lands of No. 1, Henry
Mull, Jacob Knepper and Peter Krepper, containing fifty three acres and thirty
perches more or less. Also a part of two lots of the aforesaid No. 1 tract,
one lot containing 15 A. 123 P. clear and 4 A. 124 P. of woodland together 20
A. and 87 Perches, bounded by lands of No. 1, Jacob Knepper, Henry Smith, John
Miller, Adam Glase and others. Also, all that certain remaining tract of
woodland bounded by lands of George Reagan, D. Heinly, John Miller, and Peter
Kline, containing seventy seven acres: Whereupon the Court on due
consideration approved of the security in the bonefide and ordered and
directed Michael Hendrix, Administrator of Saier George Gerhart, deceased, to
dispose the within described real estate to public sale or outcry on Friday
the 3rd day of October A.D. 1851 at ten o'clock in the forenoon on the
premises in said Albany Township and County aforesaid, he to give due public
and timely notice of the time and place of sale, and sell the same for the
best price that can be had for the same and make a report of his proceedings
herein at the next States Orphan Court. At an Orphans Court held at Reading in
and for the County of Berks on the 7th day of November A.D. 1851, before the
Honorable David F. Gorelon Esq, President, and his associate Judges of Said
Court. The Petition of Michael Hendrix showeth that under and by virtue of
the annexed order of Sale having given due and timely notice of sale by hand
bills shown in more than five of the most public places near the place of Sale
and by advertisments in two newspapers published in the County, more than
three weeks before the day of sale he did on Friday October 3rd offer the real
estate in the said order described to public sale at auction and sold the same
as follows to the following named persons, they being the highest and best
bidders and these prices being the highest and best prices bid for the same:
No. 1 Mesurage and tract of land containing 243 acres more or less sold
to George Bolick for four thousand three hundred and ten dollars. One hundred
dollars paid down, the balance to be paid April 1, A.D. 1852 when deed is to
be made. No. 2. Tract of land containing 53 acres more or less sold to
Charles & William Dreher for seven hundred and fifty dollars, twenty five
dollars paid down, balance April 1, 1852 when deed is to be made. No. 3.
Mesurage and tract of land described as containing 15 acres, 123 p. clean and
4 acres 124 p. woodland, sold as containing 20 acres more or less to Samuel
Loy for eight hundred and fifty dollars, twenty five dollars paid down,
balance April 1, 1852 when deed is to be made. No. 4. Described as containing
77 acres sold in 3 parcesl, First: twenty five acres sold to George Bolich for
one hundred and ninety eight dollars, Second, twenty five acres sold to Jesse
Miller and Daniel Hendrix for one hundred dollars; third, twenty seven acres
more or less sold to George Bolich for fifty six dollars. In each case ten
dollars paid down and in each case balance to be paid April 1, 1852 when deeds
are to be made, wherefore your petitioners prey that your Honor confirms said
sales.
Same day the Court orders & decrees that the sales made as within
reported to be final and confirms that the premises so sold be and remain to
the within named purchasers, their heirs and assigns, firm and stable forever.
