Know all men by these presents that I Laben Johnson of Washington Township
and County of Fayette in the State of Pennsylvania for and in consideration of
the sum of thirty three pounds ten shillings money of Pennsylvania to me in
hand paid at or before the sealing and delivery of these presents by Joseph
Patton of the Township and County aforesaid, the receipt of which I do hereby
acknowledge, have bargained and sold and by these presents do bargain and sell
alien and confirm unto the said Joseph Patton his heirs and assigns for ever
all that my two undivided eighth parts of the messauges, barns and of that
piece or parcel of land whereof my father Jonathan Johnson was possessed of
before his death situate in Washington Township and County of Fayette as,
bounded by lands of John Richardson Joseph Patton Benjamin Harris Jun and
others containing containing two hundred acres be the same more or less, and
also the said Joseph Patton his heirs or assigns to have quiet and peacable
possession of that part occupied and in the tenure of Isaac Vannastrond at the
expiration of said damish(?) and to continue the property of the J Patton his
heirs or assigns until the youngest of said Jonathan Johnson's children come
to age to enjoy the same, and all the estate right title interest claim and
demand whatsoever of him the said Laben Johnson of in and to the two eighth

that Wheraas Jonathan Johnson in his lifetime did sell and give a Bill of Sale
to John Richardson for one hundred and six acres out of the above bounded and
described Tract of Land he the said John Richardson being in Possession
thereof and therefore not belonging to the Heirs of the said Jonathan Johnson
deceased, And whereas the above mentioned Jonathan Johnson being a Son and
Heir in part of the said Jonathan deceased's Estate, Now this Indenture
further witnesseth that the said Jonathan Johnson for and in Consideration of
the Sum of Fifteen Pounds money of this State to him in hand paid or Secured
to be paid have hereby Bargained Sold Aliened Conveyed and confirmed unto the
aforesaid Joseph Patton one undivided eighth Part of the Remaining above
described Tract of Land, And by these Presents doth grant Bargain Sell and
confirm unto him the said Joseph Patton his Heirs and Assigns to the only
proper use and behoof of him the said Joseph Patton his Heirs and Assigns
forever, Subject to the Reservations made by the State as Also to what the Law
allows to Rachel Caldwell Relict of said Jonathan Caldwell Deceased and the
said Jonathan Johnson for himself his Heirs Executors and Administrators the
said undivided Eighth part hereby granted or mentioned to be granted to the
said Joseph Patton his heirs and Assigns, from him the said Jonathan Johnson
his Heirs Executors and Administrato, Do Warrant and Defend from him them or
any other Person laying lawful Claim thereunto (except as above accepted)
shall and will Wararnt and forever defend by these presents. In Witness

Witnesseth that whereas the supreme executive council of the Commonwealth of

one hundred and six acres of the above bounded and described tract of land he
the said John Richerton being in possession thereof and therefore not
belonging to the heirs of the said Jonathan Johnson deceased and whereas the
first above mentioned William Bradford being son-in-law of the said Jonathan
Johnson deceased estate, now this indenture further witnesseth that the said
William Bradford for and in consideration of the sum of seventeen pounds of
money of the state to him in hand paid or to be paid hereby bargained sold
aliened conveyed and confirmed unto the party Joseph Patton one undivided
eighth part of the remaining above described tract of land and by these
presents doth grant bargain sell and confirm unto him the said Joseph Patton
his heirs and assigns to the only proper use and behoof of him the said Joseph
Patton his heirs and assigns forever subject to the reservations made by the
State as also to whatever laws bear to estate of the said Jonathan Johnson
deceased and the said William Breadford for himself his heirs executors ___
the said undivided eighth part hereby granted or intended to be granted to the
said Joseph Patton, the said William Bradford his heirs executors and
administrators do warrant and ___ from saying lawful claims thereunto, except
as excepted shall and will warrant and defend forever and by these presents in

Know all men by these presents that we Joseph Patton and Thomas Patton both
of the county of Fayette State of Pennsylvania are held and bound unto Morris
Harris Benjamin Harris and Amey Voorhies formerly Amy Harris Children and
heirs of Benjamin Harris late of Somerset County New Jersey deceased in the
sum of Five Hundred dollars money of the United States of America to be paid
unto the said Morris Benjamin and Amy their heirs executors or administrators
which payment will and truly to be made we bind ourselves our heirs executors
and administrators jointly and severably finally by these presents Sealed with
our seals dated the twenty fourth day of May A.D. eighteen hundred and
fifteen. Whereas by a ___ in the lands of Jacob Harris bearing date the
eighth day of January seventeen hundred and eighty seven executed by Benjamin
Harris ___ until Rachel Johnson purporting that the said Benjamin Harris would
when thereunto against and on the payment of ___ perches money expenses etc
convey unto the said Rachel Johnston her heirs or representatives ___ one
tract or lot of land situate in the said County of Fayette and described in
the aforesaid bond which said lot of land it is ___ by the said Benjamin
Harris Patent and Whereas by ___ tract bargain of sale or ___ the said lot of
land has fallen into the possession of the aforesaid Joseph Patton and hath so
continued for many years back, And whereas the said Joseph Patton being
desirous the more fully to accomplish his title ___ the conveyance of said
Benjamin Harris and being willing to comply with the stipulated agreement on
the part of the said Rachel Johnston as contained in the bond of performance
aforesaid, Whereupon Andrew Howell the Acting executor of said Benjamin Harris
decd being duly authorized by the last will of the deceased hath this day
conveyed unto the said Joseph Patton the said thirty acre lot for the
consideration therein named. Now the Condition of the foregoing obligation is
such that if the above bound Joseph Patton his heirs and representatives shall
___ and fully and ___ indemnify the said Morris Benjamin and Amey their heirs
and assigns of and from the face and effect of said performance bond and from
all claims demands costs and charges damages or injury which the said Rachel
Johnston her heirs or assigns or the heirs of Jonathan Johnston shall can or
may have a claim on account or in virtue of the said performance bond, Then
the foregoing obligation to be void otherwise to be and remain in full force

This Indenture made the twenty fourth day of May in the Year of our Lord
Eighteen hundred and fifteen between Andrew Howell of the County of Somerset
and State of New Jersey Executor of the last Will and Testament of Benjamin
Harris decd of the first part and Joseph Patton of the County of Fayette State
of Pennsylvania of the second part, Whereas Benjamin Harris late of Somerset
County aforesaid deceased in and by his last Will and Testament having date
the fifth day of December Eighteen Hundred and ten amongst other things
therein named did order his Executors, namely Samuel Swan Andrew Howell and
Anders Harris to sell and Convey all his Real Estate Situated in the County of
Fayette State of Pennsylvania and whereas the said Samuel Swan and Morris
Harris two of the Executors aforesaid having in writing announced the
appointment as Executor the said Andrew Howell did on the twenty fourth day of
April eighteen hundred and Eleven before the Surrogate of the County of
Somerset at Somerville in the County aforesaid take upon himself the matter
and execution of said last Will and Testament then and there proceeded to
prove and act on the Same all which proceedings on the Records of the Orphans
Court for Said County of Somerset will fully appear. Whereas the Said
Benjamin Harris in his lifetime to wit on or about the year Seventeen Hundred
and eighty Seven did take out a patent for Certain lands situate in
Washington, Fayette County Pennsylvania by Which Patent was covered a certain
thirty acre lot adjoining Claimed by the heirs of Jonathan Johnston and it
appearing by performance Bond having date the Eighth day of January Seventeen
hundred and eighty seven duly Executed by Benjamin Harris and Rachel Johnson
obligatory on said Benjamin Harris to Rachel Johnston to convey unto her the
said Rachel her heirs Executors or administrators the aforesaid thirty acre
Lot of Land at such time as she the said Rachel Should pay or bound to be paid
her proportion of the Patent ___ purchase money and Whereas at some Period
since the date of the above named performance Bond the said Joseph Patton
party of these presents hath procured the possession of the aforesaid Lot
thirty acre lot by arrangement purchase and bargained with the said Rachel
Johnson her heirs and Representatives assigns and the said Joseph Patton has
so held and Occupied the possession aforesaid for more than Eighteen Years,
Now for the more fully and amply vesting the said Joseph Patton in his title
This Indenture Witnesseth that the said Andrew Howell for and in consideration
of the said Joseph Patton having duly executed to the heirs of Benjamin Harris
decd a bond of Indemnity against all and all manner of claims damages which
may shall be exhibited against them their heirs or Representatives by the said
Jonathan Johnston Rachel Johnston their hers or Representatives or any of them
on account of or in balace(?) of the aforesaid Performance Bond and for and in
further consideration of the sum of Seventy Five dollars money of the United
States of America to the Said Andrew Howell paid at or before the ensealing
and delivery hereof the Receipt whereof is hereby acknowledged and himself
therewith fully satisfied contented and paid and the said Joseph Patton being
thereof and thereupon and from every part and parcel thereof forever Released
Exonerated and discharged by virtue of these presents hath granted bargained
aliened released enfeoffed conveyed and confirmed and by these presents do
grant bargain sell alien release enfeoff convey and confirm unto the said
Joseph Patton his heirs and assigns all that lot of land Situated in
Washington Township Fayette County State of Pennsylvania and which by said and
draught laid down by John Shaver Esquire Begins at a Black Oak Stump in
Frederick How lot line running north fifty degrees East seventy perches to a
Stump or tree thence north forty four degrees East sixty six perches and a
half perch to a post thence South eighty three and a quarter degrees West one
hundred twenty four perches to a post thence South sixteen degrees East eighty
perches to the place of Beginning, Containing thirty and a quarter acres of
land adjoining lands of the said Frederick Humbat Rev James Power Edward
Chamberg and other lands of the said Joseph Patton, together with all and
singular the buildings improvements ways woods underwood water watercourses
rights liberties privileges heridatements and appurtenances to the herein
described premises belonging or in any way appertaining and also all the
Estate Right title claim and demands of him the said Benjamin Harris in his
lifetime and at the time of decease or of the said Andrew Howell acting
Executor assigned at law and in Equity of in and to the premises within
described with the appurtenances to every part and parcel thereof To Have and
To Hold the premises hereby granted as above mentioned with the appurtenances
unto the said Joseph Patton his heirs and assigns to the only Purpose use
benefit and behoof of the sid Joseph Patton his heirs and assigns forever and
the said Andrew Howell being executor as aforesaid doth for himself his heirs
executors and administrators covenant grant and agree to and with the said
Joseph Patton his heirs and assigns and with each and every of them by these
presents that the said Andrew Howell hath not done committed or suffered any
act or acts thing or things whereby the herein Conveyance presented now or
hereafter may be impeached or Inembered in title charge or otherwise, In

that Whereas the Commonwealth of Pennsylvania by Patent dated on or about the
year of our Lord seventeen hundred and Eighty seven did grant and confirm unto
Benjamin Harris Junior a tract of land situate in said Washington Township
Containing about two hundred and seventy two Acres and three quarters and
allowances, There being Included in said Patent about thirty Acres of land
belonging to the Heirs or legal representatives of Jonathan Johnston deceased
which appears by a performance bond bearing date the eight day of January
seventeen hundred and eighty seven duly executed by said Benjamin Harris
Junior deceased to Rachel Johnston, obligatory of the estate of Jonathan
Johnston decd Obligatory on said Benjamin Harris Junior to convey unto her the
said Rachel her heirs Executors or Administrators the aforesaid thirty Acres
of land Beginning at a post corner of the Rev James Powers land thence by
other land of the heirs of Jonathan Johnston South eighty three degrees and a
quarter West one hundred and twenty four perches to a post and South sixteen
degrees East eighty perches part by the same and part by the land of Joseph
Patton to a Black Oak thence by land of said Benjamin Harris North fifty
degrees East seventy perches to a White Oak and North East sixty six perches
and a half to the place of Beginning, At such time as the said Rachel should
pay or cause to be paid her portion of the Patent expenses purchase money etc,
Whereas the said Joseph Patton having obtained possession of the said thirty
Acres of land in conveyance of a purchase made of the Heirs of the said
Jonathan Johnston decd, therefore Andrew Howell Esquire acting Executor of the
last will and Testament of the said Benjamin Harris Junior decd by Indenture
dated the twenty fourth day of May in the year of our Lord eighteen hundred
and fifteen did convey and confirm unto the said Joseph Patton his heirs and
assigns the said thirty Acres of land on his paying a price agreed on as
contained ___ in procuring the office right of the same agreeably to the
aforesaid Bond of Obligatory etc. Now this Indenture witnesseth that the
aforesaid Joseph Patton and Sarah his wife for and in consideration of the sum
of Seventy Five Dollars current lawful money of the United States in hand paid
by the said Thomas Patton at and before the ensealing of these presents the
receipt whereof is hereby acknowledged, hath granted bargained and sold and by
these presents grants bargains sells aliens enfeoffs release convey and
confirm unto the said Thomas Patton his heirs and assigns all that the said
thirty Acres agreeably to the butts and bounds aforesaid the same more or
less, Together with all and singular the rights and privileges liberties
hereditaments and appurtenances whatsoever thereunto belonging, the reversions
and remainders rents issues and profits To have and to hold the said thirty
Acres granted presents to the said Thomas Patton his heirs and assigns to the
only proper use and behoof of him the said Thomas Patton his heirs and assigns
forever, freely and already exonerated from the affect of any claim prior
thereto which may lawfully be brought the complete lawful title to the same or
any part thereof, the reservations in the Original Patent relative to the use
on behalf of the State and of aforementioned ___ by his ___ accepted. In
Testimony thereunto the said Jospeh Patton and Sarah his wife granted to these
presents have set their hands and seals in the twenty fourth day of June in
the year of our Lord eighteen hundred and fifteen. Joseph Patton. Sarah

Received the day of the date of the foregoing Indenture of Thomas Patton the
Sum of Seventy Five dollars, being the consideration money therein mentioned

Fayette County, Commonwealth of Pennsylvania By me the Subscriber one of the
Justices of the peace in and for the said County personally appeared Joseph
Patton and Sarah his wife who acknowledged the foregoing Indenture to be their
Act and Deed and desired the same to be recorded as such. She being of lawful
age and examined separate and apart from her husband as the law directs.

Will of Joseph Patton, Fayette County Will Book vol 1 p761:
This the fifteenth day of October in the year of our Lord one thousand eight
hundred & twenty two I Joseph Patton of Fayette County, Washington, and
Commonwealth of Pennsylvania, being far advanced in years but of sound mind
and memory therefore calling to mind the mortallity of my Body and Knowing
that it is appointed for all men once to Die, Do make and ordain this my last
will and testament, first of all I order that my body after my decease be
buried in a Christian and decent manner at the discretion of my Executors and
as touching such worldly estate wherewith it hath pleased providence to
bless me with in this life. I give devise and dispense of in the following
manner and in form. Imprimis it is my will and I do order that by the first
plas all my just debts and funeral charges be paid and satisfied. Item I give
and bequeath unto my Beloved wife Sarah two beds and bedding and bedstead with
all the kitchen and dresser furniture belonging to me at my decease. Six
sheep the choice of all the above and further I do allow and order my son
Robert to give and provide a compleat maintenance in all respects to my wife,
which encumbrance and bear on his share of land so long as she lives.
Item I give and bequeath unto my Daughter Mary Wilson one hundred Dollars
exclusive of what I give her before. Item I give and bequeath to my daughter
Rebeckah Free one hundred dollars exclusive of what I give her before. Item I
give and bequeath unto my son John Patton the plantation that he now lives on
surveyed by John Shrevel to him his heirs and assigns forever, by here the
said John paying to my Executors the sum of forty five dollars. Item I give
and bequeath unto my son Joseph Patton sixty dollars exclusive of what I give
him before. Item I give and bequeath unto my son Thomas Patton four dollars
exclusive of what I give him before. Item I give and bequeath unto my son
Robert Patton the plantation that I now live on, or the part discribed here
beginning two perch north of the corner of a field next Andrew Brown, on the
line between the said Andrew and my self and a straight line from thence to
the upper corner of my orchard thence down the meddow fence to the lane by my
barn, thence along the meddow fence to the east corner thence along said fence
to a mullberry tree in the big field and on a straight line past a second
Mulberry tree to a petition fence running near a north course and after coming
to said Petition fence to go along said fence in the direction of Henry Rist
which a straight line, strikes the line of the said Rist to have and to hold
the aforesaid parcel of land which is called my old place to him his heirs and
assigns forever. Item I give and bequeath unto my son John Thomas and Robert
the balance of my land the part that my son Robert now lives on being the
northwest corner of my plantation agreeable to the lines described to Robert
in Trust for use of my son James Patton and family to be and gave by my three
sons John Thomas and Robert for the sole benefit of the said James and family
as they may see proper and at the death of my son James the said parcel to be
and enjoyed by the lawful issue of the said James as tenents in Common yet it
is to be remembered that it is my will that my son James should reform and
become sober so far that my three sons namely John, Thomas and Robert think or
at majority of them that the same will be safe in hands of the said James then
and in that case I do allow them or a majority of them to execute a title to
the said James his heirs and assigns forever, agreeable to this. Item I give
and order my Executors to pay out of my money to my grandson Joseph son of my
son David when he arrives to the age of twenty three years old $100. I
likewise give unto my grandson Peter Free Patton when he arrives to the age of
twenty three years each the sum of one hundred dollars. Item I will and
bequeath all the residue of my money that is the proceeds of my personal
property and my assets outstanding debts unto my four grandsons namely Joseph
Patton son of my son John Patton, Joseph Patton son of my son Joseph, Joseph
Free son of my daughter Rebeckah Free, Joseph Wilson son of my daughter Mary
Wilson, all to share and share alike of said surplus if any after paying the
before described debts and legacys. I likewise beseech make and ordaine my
only and sole Executor of this my will and Testament my trusty and will
beloved friend John Gamble and my son Robert Patton and I do herewith utterly
disannul and revoke all and every other former will and Testament. In witness
whereof I have hereunto set my hand and seal the day and year first above

Subscriber Register for the Probate of wills and granting Letters of
Administration in and for said County, personally came Thomas Coon and John
Cathue two of the signing witnesses to the foregoing last will and Testament
and on their solumn attestation did severally declare that they saw the
Testator when of disposing mind execute the same as and for his last will and
testament that they signed the same as witnesses thereof in his presence and
that they know of no undue influence used or later will made by him. In
