Will of Robert Patton, Fayette County Will book 4 p153:
Be it remembered that I Robert Patton of Fayette County and State of
Pennsylvania being well in body and sound disposing mind memory and
understanding and calling to mind the uncertainty of life do make and publish
this my last will and testament hereby revoking and making void all former
wills at any time made. First, I will my soul to the Father of all spirits
who gave it. Second, I direct that my body be decently intered in the burying
ground at Rehoboth Church according to the rights and ceremonys of the said
Church and that my funeral expenses be conducted in a manner corresponding
with my estate and situation in life. Third, and as to my worldly goods and
estate as it hath pleased a bountiful and wise providence to entrust me with I
dispose of in the following manner. I direct that all my just debts and
funeral expenses be paid as soon after my decease as convenient out the first
money. Fourth, I will and bequeath to my daughters Mariah Patton and Sarah
Patton all that portion of my real estate described as follows (except a
reasonable interest in the same for my daughter Elizabeth as will appear
after) beginning at the northeast corner of my orchard fence adjoining the
land of John Brown Esq, thence in an easterly direction to a mulberry tree at
a gate and continuing on to a second mulberry tree and fence thence up said
fence in a northerly direction so as to take off or leave six acres of land in
the upper field for the home place thence in an easterly direction to the land
of Thomas Patton thence following the line of the old survey of my father's
deed to the place of beginning suppose to contain eighty acres more or less,
and it is also my wish and desire that my said daughters Mariah and Sarah
should hold and keep the above described 80 acres more or less for their own
mutual and equal benefit, but in case some unforseen circumstance should
occur, that it became necessary for one or both to sell then I desire that
they give my son William Patton the preference. Fifth, I will and bequeath to
my son William Patton the residue or balance of my real estate and his heirs
and assigns forever (except a reasonable provision for the maintenance of my
daughter Elizabeth). Sixth, my will and desire is and I do direct that my
daughter Elizabeth Patton have a comfortable living and home together with
food and raiment her natural life from the proceeds of my entire farm.
Seventh I will and bequeath unto my son Joseph Patton one thousand dollars to
be paid in the following manner - say five hundred dollars in two years and
five hundred dollars in five years after my decease. Eighth I will and
bequeath all moveable and house hold goods that I may have on hand at my
decease in the following manner. Say Mariah Patton, Sarah Patton, Elizabeth
Patton and William Patton to mutually agree and divide as near equally as they
can among themselves. Ninth, and lastly, I appoint John Brown Esq and my son
William Patton my executors. Robert Patton.
Signed, sealed and declared by the said Robert Patton for his last will and
testament in the presence of us, who have at his request hereunto subscribed
our names as witnesses thereto, in the presence of the said testator and of
each other November the Seventeenth one thousand eight hundred and sixty.

I do hereby decline to act as one of the executors of Robert Patton deceased
Sep 3, 1866. John Brown.
Fayette County. Be it remembered that on the third day of September 1866
before me George Morrison Register for the probate of wills and granting
letters of administration in and for the said county personally came John
Brown and John McClain Jr, two of the subscribing witnesses to the foregoing
instrument of writing purporting to be the last will and testament of Robert
Patton dec'd who being duly affirmed according to law did dispose and say,
John Brown saw him sign and seal, John McClain heard him acknowledge it to be
his signature and seal and both heard him declare the same as and for his last
will and testament when of sound and disposing mind and memory that they
signed as witnesses thereto by request of the testator, in his presence, and
in the presence of each other, that they knew of no undue influence used or
later will made. In witness whereof I have hereunto set my hand and seal of
the said Office, this 3rd day of September A.D. 1866. George Morrison,
