The lot set apart for and occupied as a buriel place lying on the north bank of the brook passing through the farm and on the east line of same and believed to be about thirty one perches south of the north east corner of the farm and staked out supposed to be one half acres be the same more or less which I will and bequeath to the citizens of the neighbourhood that may wish the same reserving family and relative privileges for a burying place and for no other purpose or as forever upon condition that the inhabitatnts who desire the same, put a good rail or post fence around the same and keep it inclosed, and on failing so to do and perform allowing two months from the recording of this my will that then I enjoin it on my executors to inclose the same and that it shall be continued and kept as a burying place. Last will and Testament of Henry W Collins late of North Shenango Township decd, Registered 27 th August 1842
In the name of God amen. I Henry W Collins of North Shenango County of Crawford and State of Pennsylvania being of sound mind but inform in body do make and constitute this my last will and testament.
Imprimis first I devise and desire that my soul may return and be received by god and secondly that my body after my decease may receive a decent and Christian burial.
Thirdly after paying and discharging all just and lawful debts which are but few, I then will and bequeath to my dear and beloved wife Mary Collins one third of the rent or income of my farm after all necessary expenses is liquidated together with one bed and beding one cow and two sheep which bequest is to be of her own choice with the privilege of keeping and feeding the same on the farm and all other household furniture commonly called kitchen furniture the mansion house now occupied by myself and family including the garden house yards and water privilege with the right of using the timber necessary for fuel in such a manner as will do the least possible injury to the value of the farm and I further will and devise that if consistent with her feeling that she together with our dear children would remain in the personal possession and occupancy of their bequeathed rights
to my second child and only son John William Collins I will and bequeath all my real estate except so much as has been transferred by conveyance or by contract or such means as may hereafter be made and described which rights descended to me by deeds from James Mason and wife and from Catherine Mason and James Mason one of which is recorded, the lot set apart for and occupied as a burial place lying on the north bank of the brook passing through the farm and on the east line of same and believed to be about thirty one perches south of the north east corner of the farm and ??? to be one half acre be the same more or less, which I will and bequeath to the Citizens of the neighborhood that may with the same reserving family and relative privileges for a burying place and for no other purpose or use forever upon condition that the inhabitants who desire the same put a good rail or post and fence around the same and keep it enclosed and on failing so to do and perform allowing two months from the recording of this my will that then I enjoin it on my executors to enclose the same and that it shall be contained and kept as a family burying place
and to my eldest daughter Martha Ann Collins I will and bequeath one sheep the choice of which may be made by herself of by her mother or other friend for the benefit of my executors I here note that a certain calf was put in my possession in trust as a present or donation to my eldest daughter Martha Ann which property is at this date in my possession but never claimed any right to the same the above referred calf was donated by her grandmother Catherine Mason
and to Mary Catharine my second daughter I will and bequeath one sheep the choice to be made in the same manner.
It is further my will and order that my son John William Collins shall pay to each of his sisters one hundred and seventy five dollars and to be paid within eight years from the time that he shall become of age he being five years old the thirteenth day of this instant and to be paid in eight equal annual payments the one half in store pay the other half in cash or meat stock
it is further my will that all the beds and beding that has not heretofore been disposed of and remain in and for the common use of the family so long as they continue in a family capacity or situation and if the dissolve as to their family situation then that part used in common is to be added to that part of the rent (viz) the two thirds that has not heretofore been disposed of which I will and order and set a part as an assistant fund to be used and apply in the maintenance and support of the children before named in this my will
being sensible of the uncertainty of life and the certainty of death in case of the death of either of my children named as legatee that is if my son John Wm Collins should not live to inherit his portion by lawful age then his part shall be equally divided between his two sisters as above named and each of them shall pay to their mother if living thirty seven dollars and fifty cents and if either of my daughters as above named should decease in a state of minority then their mother my beloved wife shall have one third of the amount which she would have been entitled to out of the real estate the other two thirds to be equally divided between the brother and remaining sister and if both my daughters should depart this life then their brother shall have and retain their legacies and be holding to pay to his mother one hundred dollars as a part of what would have been due to the deceased if they had lived.
I further I devise authorize and impose my executors to sell and dispose of so much of my personal property that I may die seized of as will be sufficient to discharge my debts that may be unsatisfied at the time of my decease having respect in their judgment and giving a preference to the preserving such part as will be most useful to my family interest if any part thereof can be saved for their use.
By this my last will and testament I constitute and appoint James Mason John Williams of South Shenango and Mary Collins my executors of this my will in full faith and confidence and do further enjoin upon them that they justly faithfully religiously and in the fear of god execute this my will and desire in the same manner that your judgments in law and justice shall direct you that I would if present this my will being your general guide. Personally appeared before me Register &c in and for said County Joseph Wilson and Patterson Espy the subscribing witnesses to the annexed instrument purporting to be the last Will and testament of Henry W Collins late of North Shenango township, decd, who being duly sworn according to law deposeth and saith that they were present and saw the testator therein named sign his name thereto declaring it to be his lat wil and testament and desired them to sign the same as witnesses at which time he appeared to be of sand and disposing mind and memory to the best of our judgements and belief.
