This Indenture made the nineteenth Day of October Anno Domini One thousand Seven Hundred and Sixty Two Between David Herbster and Gottfried Stumpf both of the Township of Lebanon in the County of Lancaster and Province of Pennsylvania Yeoman of the one part and John Seller of Tulephocken Yeoman of the other part, Whereas the said David Harpster and Godfried Stumpf in and by a certain Obligation or Writing Obligatory under their hands and Seals bearing even date herewith Standeth bound unto the said John Seller and George Seller in the sum of one hundred and Sixty Pounds Lawful Money of Pennsylvania Conditioned for the Payment of Eighty Pounds Lawful Money aforesaid on the Eighteenth Day of October Anno Domini one thousand Seven Hundred and Sixty Three Together with Lawful Interest for the Same as in and by that Said recited Obligation and Condition thereof Relation being thereunto respectively had more at large appear, Now This Indenture Witnesseth that the Said David Harbster and Godfried Stumpf for and in Consideration of the aforesaid Debt of Sum of Eighty Pounds for the better Securing the Payment thereof with its Interest unto the said John Seller and George Seller or their Several and Respective Executors Administrators and Assigns in discharge of the said recited Obligation and for and in Consideration of the further sum of five Shillings Lawful money aforesaid with the said David Harbster and Godfried Stumpf in hand paid by the said John Seller and George Seller at the Sealing and Delivery hereof the receipt whereof is hereby Acknowledged, Have granted bargained sold released and confirmed and by these presetns do Grant bargain Sell release and Confirm unto the Said John Seller and George Seller a Certain Improvement Lying and being in the Township of Lebanon in the County of Lancaster and Province aforesaid Adjoining on the Lands of Peter Heacher Peter Wolff and John Bennett Containing above one hundred acres being the same more or less, Together with all and Singular the Buildings Improvements Ways Water Water Courses Rights Liberties Privileges Hereditaments and Appurtenances whatsoever thereunto belonging and the Reversions and Remainders thereof, To Have and to hold the said described premises hereby granted or mentioned to be granted with the Appurtenances unto the said John Seller and George Seller their Heirs and Assigns forever, Provided always nevertheless that if the said David Harbster and Godfried Stumpf their Heirs Executors Administrators or Assigns Shall and do well and truly Pay or Cause to be Paid unto the said John Seller and George Seller their Several and respective Executors Administrators or Assigns the aforesaid Debt or Sum of Eighty Pounds on the Day and time herein before mentioned and Appointed for Payment thereof together with lawful Interest of the Same According to the Conditions of the Such recited Obligation without fraud or further Delay and without any Deficiency or Abatement to be made of any thing preferred of any Taxes Charges or Assessments whomsoever that then and from thenceforth as well this present Indenture the Estate hereby granted as the said Recited Obligation Shall become void any thing herein before contained to the Contrary in any wise notwithstanding. This Indenture made the twenty sixty day of May in the year of our Lord one thousand seven hundred and seventy two Between David Herbster and Barbary his wife of the one part and George Heine of the other part witnesseth that the said David Herbster and Barbary his wife for and in consideration of the sum of pounds lawful money of Pennsylvania unto them or one of them in hand well and truly paid by the said George Heine at and before the execution hereof the receipt and payment whereof is hereby acknowledged, Have and both of them Hath and by these presents they the said David Herbster and Barbary his wife Do and each of them doth Grant bargain Sell alien release enfeoff and confirm and the said George Heine and to his heirs and assigns all that Tract of land situate lying and being the the County of Northumberland (formerly the County of Cumberland) in the Province of Pennsylvania aforesaid in a settlement known now by the name of Bufaloe Township (but formerly by the name of Thamoke) bounded or adjoining by Mahinay Creek and the lands of George Gabriel and Abraham Herr Containing about two hundred acres be the same more or less being that same tract of land which by virtue of a Proprietary Warrant bearing date the 4th day of June Anno Domini 1763 was surveyed unto Henry Christ who by his Deed bearing date the nineteenth day of July Anno Domini 1766 did grant and convey the same unto a certain Casper Snevely and he the said Casper Snevely and Sabrina his wife has conveyed to the said David Herbster by a deed bearing date the fifth day of January Anno Domini 1768 in fee as by the said deeds referenced to the same being had may more at large appear, Together also with all and singular the ways waters, water courses, rights, liberties, privileges, hereditamentsand appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversions and remainders thereto together with a receipt for the sum of 231 pounds paid in part of the purchase money as all the estate, right, title, interest, property possession claim and demand whatsoever of them the said David Herbster and Barbary his wife both at law and Equity or otherwise howsoever of in and to the above described tract of piece of land and premises, To Have and to hold the above mentioned Beeded(?) and Bounded tract of two hundred acres of land be the same more or less hereditaments and premises hereby granted and released or mentioned so to be with the appurtenances unto the said George Heine his heirs and assigns to the only proper use benefit and behoof of him the said George Heine his heirs and assigns forever and subject to the remainder of the purchase money Interest and Quit rents now due and hereafter becoming due for the hereby granted premises to the Chief Lord or Lords of the fee thereof, and the said David Herbster for himself his heirs executors and administrators and for the said Barbary his wife Doth covenant promise grant and agree to and with the said George Heine his heirs and assigns by these presents that the said David Herbster and his heirs the said tract or parcel of two hundred acres of Land be the same more or less hereditaments and premises hereby granted and released with the appurtenances untothe said George Heine his heirs and assigns forever against him the said David Herbster and the said Barbary his wife and their heirs and against all and every other person and persons whomsoever lawfully claiming the same or any part thereof shall and will warrant and forever defend by these presents. This Indenture made thi twelfth day of June in the Year of our Lord 1772 Between Reuben Haines of the City of Philadelphia in the Province of Pennsylvania Breans(?) and Margaret his wife of the one part and David Harbster of Northumberland County in the said province Yeoman of the other part, Witnesseth that the said Reuben Haines and Margaret his wife in Consideration of the sum of two hundred pounds lawful Money of Pennsylvania to them in hand paid by the said David Harbster at or before the Sealing and delivery hereof, the receipt of which they do hereby Acknowledge and thereof and of every part thereof do forever discharge the said David Harbster his Heirs Executors and Administrators by these presents, have granted Bargained sold aliened Enfeoffed Released and confirmed and by these presents do Grant Bargain sell Alien Enfeoff Release and Confirm unto the said David Harbster and to his heirs and Assigns A Certain Tract of Land situate on the Mouth of Lick Run or Swift Run on Penns Creek in the County of Northumberland in the said province, Beginning at a Spanish Oak on the North side of said Penns Creek thence North forty two perches to a White Oak thence North East Twenty perches to a black oak, thence North West fifty nine perches to a post late a corner of Jacob Tucker's Land now of Overmier, thence North sixty five degrees East three hundred ninety eight perches and a half to a post another corner of said Overmier's Land thence South East one hundred and thirteen perches to a Black Oak in the North side of said Pens Creek thence up the said Creek the several courses thereof four hundred and sixty seven perches to the place of beginning, Containing two hundred and ten acres and nine perches of land and allowance of six percent for roads, be the same more or less, as in and by a certain Tetrein(?) of Survey remaining in the Secretarys Office at Philadelphia reference being hereunto had more fully and at large appear, Together with all and Singular the Buildings Improvements Woods Waters Water Courses Right Liberties Privileges Hereditaments and appurtenances whatsoever hereunto belonging or in any wise appertaining and the reversions and remainders Rents Issues and Profits thereof, Also all the Estate Rights Title Interest Use Possession Claim and Demand, whatsoever of them or Either of them the said Reuben Haines and Margaret his wife in law Equity or otherwise howsoever of in to or out of all and Singular the Premises and every part thereof, TO have and to hold the aforesaid Described Tract of Land Hereditaments and premises hereby granted or mentioned to be granted with the appurtenances unto the said David Harbster his heirs and assigns to the only proper use benefit and behoof of the said David Harbster his Heirs and Assigns forever, Under and Subject to the yearly Quit Rent hereafter, to grow due for the hereby granted premises unto the Chief Lord or Lors of the fee thereof, And the said Reuben Haines and his heirs the aforesaid described tract of Land Hereditaments and premises hereby granted unto the said David harbster his heirs and assigns with the appurtenances against him the said Reuben Haines and his heirs and against all other person or persons whatsoever lawfully claiming or to claim by from or under him them or any of them shall and will Warrant and forever defend by these presents. On the day of came the within named Reuben Haines and Margaret his Wife and acknowledged the within Indenture to be their act and deed and desired the same to be recorded as such, the said Margaret voluntarily thereunto consenting, she be of full age, privately and apart examined the contents first made known unto her. Second District of Pennsylvania SS. Be it remembered that on the fourth day of September in the year of our Lord 1810 before me the subscriber president of the Court of Common Pleas in and for the district aforesaid, personally came Timothy Mallack late of the city of Philadelphia but now of the Borough of Lancaster esquire who being duly saith that he well knew the within named Reuben Haines and Margaret his wife and is well acquainted with their handwriting respectively he being his half brother and she his wife, Richard Lanuaze one of the subscribing witnesses he hath and is told to have died some time ago with William Glaze the other subscribing witness he was not acquainted, that he doth well believe that the said Reuben Haines and Margaret Haines respectively is of their own handwriting. To all People to whom these presents Shall come, David Herbster of Beaver Township in the County of Northumberland and Commonwealth of Pennsylvanai sends Greeting. Know ye athat the said David Herbster, for and in Consideration of the sum of eighty pounds to him in hand paid by Jacob Herbster of Beaver Township in the County aforesaid at and before the ensealing and deliver hereof the receipt whereof he doth hereby acknowledge and thereof acquit and forever discharge the said Jacob Herbster his heirs and Executors and administrators by these presents, hath granted bargained sold released and confirmed and by these presents doth grant, bargain, sell, release and confirm unto the said Jacob Herbster and to his heirs and assigns, all that certain improvement and tract of land lying and being in Beaver Township aforesaid adjoining lands of Michael Miller Joseph Symon and to David Herbster's land, and on other land containing one hundred thirty eight acres, be the same more or less, Together with all and Singular the Buildings, improvements, ways, woods, waters, water courses, rights, liberties, hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversions remainders rents issues and profits thereof, To hae and to hold the said described tract of land containing one hundred and thirty eight acres be the same more or less hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said Jacob Herbster his heirs and assigns, To the only proper use and behoof of the said Jacob Herbster his heirs and assigns forever, Subject to the payment of the Arrears of Purchase money interest and quit rents due and to become due for the same and the said David Herbster for himself his heirs executors and administrators doth covenant promise and grant bargain and sold that tract of land and every part and parcel thereof against him and his heirs and against all and every other person and his heirs and against all and every other person and persons whomsoever lawfully claiming or to claim the said tract of land containing one hundred and thirty eight acres, be the same more or less, to the said Jacob Herbster his heirs and assigns shall and will warrant and forever defend by these presents.
