Virginia, Ohio County SS. We Blair Moran and Absolom Bedjetz, Justices of the peace in the County of Ohio do hereby certify that Nancy Kerr the wife of James kerr parties to a certain deed bearing date 22nd March 1826 and written within personally appeared before us in our County aforesaid and being examined by us privately and apart from her husband and having the deed aforesaid fully explained to her, she the said Nancy acknowledged the same to be her act and deed and declared that she had willingly signed sealed and delivered the same and that she wished not to retract it. Text of will from Ohio Co VA Will Book 4-164, dated 22 Oct 1849, proved Feb 1859:
In the name of God, Amen. I, Thomas Moore, of the County of Ohio and State of Virginia, do make and declare this, my last will and testament, in manner and form following. First, I resign my soul into the hands of Almighty God, hping and believing in a remission of my sins by the merits and mediation of Jesus Christ, and my body I commit to the earth to be buried at the discression of my executers hereinafter named, and my worldly estate I give and bequeath as follows:
First, I give and devise to the Episcopalian Methodist Congregation in West Alexander, Washingtn County, Pennsylvania, the sum of two hundred dollars to be paid into the hands of the presiding Elder of the district, in which said congregation is included. The above named sum, I direct to be paid in yearly instalments of ten dollar each, but in case my Executor hereinafter named should wish to leave this region of the country and reside in some distant part of the Country, then and in that case my said Executor is to have the privilege of paying off said bequeatment at any time.
Second, I give and bequeath to my two sons Elijah and William, and whole estate, real and personal, ater the payment of the bequeathment above named and all my just debts and funeral expenses, my land property lying and being on the waters of Little Wheeling Creek, in the County of Ohio and State of Virginia to give and bequeath to my two sons above named, to hav and to hold to the only proper use and behoof of my said sons Elijah and William, their heirs and assigns forever, to be equally divided betwixt them as near as may be.
Third, I give and bequeath to my two sons above named, all the rest, residue and remainder, of all my estate and effects, real and personal, whatsoever and wheresoever, not herein before otherwise effectually disposed of, after payment of my debts, legacies and funeral expenses and other charges and deductions necessary to be made in the settlement of my estate, all to be divided equally between my two sons aove named.
And finally, I do hereby constitute and appoint my sn Elijah Moore, my soul executor of this my last will and testament. In witness wheref I hae hereinto set my hand and affied my seal this twenty second day of October, in the year one thousand eight hundred and forty nine. /s/ Thos. Moore
