This Indenture made the ninth day of June in the year of our Lord one
thousand seven hundred and fifty three Between Edward Brinton of Chester
county in Province of Pennsylvania Esqr and Mary Brinton (widow of Joseph
Brinton late of the same county Esqr) executors of the last will and testament
of the sd Joseph Brinton of the one part and Joseph Muser of Lancaster county
and Province aforesaid yeoman of the other part Whereas Richard Hill Isaac
Norris and James Logan and Thomas Griffiths by virtue of an authority unto
them derived from the Honourable William Penn Esqr. Proprietary of the said
Province and from Joshua Gee of the City of London Silkman Thomas Cad of the
city of Bristol and John Woods of the City of London aforesd Mercht Surviving
Mortgages and trustees of the said Province did by their warrant under their
hands and the lessor seal of the said Province bearing the 27th day of the
first month Anno Domini 1714 Authorize and require the Surveyor General of the
said Province to survey or cause to be surveyed unto Robt Way the quantity of
one hundred acres of land in the said Province in Pursuance of which sd
Warrant there was surveyed and laid out on the 12th day of the third month
Anno Domini 1715 unto the said Robert Way a certain tract or parcel of land on
or near Mill Creek then in the county of Chester (now Lancaster) Beginning at
a white oak being a corner of Elizabeth Whartnabigs land thence north by the
same land three hundred and forty perches to a black oak thence east by vacant
land three hundred and twenty four perches to a post thence south by Edward
Woodwards land three hundred and forty perches to a post thence west by vacant
land three hundred and twenty four perches to the place of beginning
Containing six hundred and fifty acres and the allowance of six acres on each
hundred for roads and highways and Whereas the said Robert Way in his life
time did make his last will and testament in whereof he appointed Philip
Taylor and William Pyle both of Thornbury in the county of Chester aforesd
executors and soon after dyed and Whereas the said Philip Taylor and William
Pyle did in and by a certain deed duly executed under their hands and seals
for the consideration therein mentioned granted and released unto Joseph
Brinton aforesaid in his life time all the said six hundred and fifty acres of
land with the appurtenances and Whereas the consideration money due to the
Proprietaris trustees for the said land being not then paid nor any part
thereof he the said Joseph Brinton did upon the same request that he may be
allowed to pay the same and thereupon to receive a release and confirmation of
the said land to him and his heirs and Whereas the said Richard Hill Isaac
Norris James Logan and Thomas Griffiths the said Commissioners of Property by
their patent of instrument of writing under their hands and the Proprietarys
Great Seal affixed thereto bearing date the third of the tenth month one
thousand seven hundred and twenty eight for the consideration therein
mentioned did grant and confirm unto the said Joseph Brinton all the above
described six hundred and fifty acres of land above described to hold to him
and his heirs and assigns forever as in and by the said recited patent
recorded at Philadela in Patent Book A Vol 6 page 109 the 15th of 11 ber 1729
may more fully appear and Whereas the said Joseph Brinton in his life being so
thereof sized conveyed four hundred acres thereof unto his two sons James and
Moses and afterwards made his last will and testamtnt in writing bearing date
the thirteenth day of the tenth month 1751 amongst other things did devise in
these words Item I order that my executors here after named do sell my land
situate in Lampeter (otherwise Leacock) in Lancaster county containing by
computation two hundred and fifty acres and I do hereby give and grant unto my
said executors and the survivor and the executor or executors of the survivor
of them full and absolute power and authority to convey the same land in fee
simple so such person or persons as shall give the most and best price for the
same and did constitute and appoint the sd Edward Brinton and Mary Brinton
executors to the sd testament as in and by the same duly proved and remaining
upon record in the Registers Generalls office at Chester may more fully
appear. Now this Indenture Witnesseth that the said Edward Brinton and Mary
Brinton for and in consideration of the sum of nine hundred and fifty pounds
of lawfull money of the said Province to them in hand paid by the said Joseph
Musser at or before the ensealing and delivery thereof the receipt whereof
they do hereby acknowledge and thereof do acquit and forever discharge the
said Joseph Musser his heirs and assigns hath granted bargained sold aliened
enfeoffed and confirmed and by these presents doth grant bargain sell alien
enfeoff release and confirm unto the said Joseph Musser his heirs and assigns
All that piece tract of parcel of land being part of the abovesd tract of six
hundred and fifty acres situate in the township of Leacock Beginning at a post
being a corner of land late of James Brinton thence by the same land north one
hundred and nity nine perches to a post thence by Mosses Brintons land east
forty perches to a post south eighteen perches to a post east one hundred and
sixty one perches to a post thence south by Edward Woodwards one hundred and
eighty one perches to a post thence west by vacant land two hundred and one
perches to the place of beginning Containing by by estimation two hundred and
fifty acres by the same more or less as above described, Together with all and
singular the woods meadoes ways waters water courses rights liberties
priviledges hereditaments and appurtenances whatsoever thereunto belonging or
in any wise appeartaining and the reversions and remainders rents issues and
profits thereof and all the estate right title and interest whatsoever of the
said Edward Brinton and Mary Brinton of in or to the sd piece tract and two
hundred and fifty acres of land and premises hereby granted and every part
thereof and true copies of all deeds evidences and writings concerning the
same to be had and and taken at the proper costs and charge of the said Joseph
Musser his heirs and assigns to have and to hold the said two hundred and
fifty acres of land hereditaments and premises hereby granted or mentioned to
be granted with the appurtenances unto the said Joseph Muser his heirs and
assigns forever Under the proportionable part of the quit rent hereafter
becoming due on said land to the Chief Lord or Lord of the fee thereof And
they the said Edward Brinton and Mary Brinton and their heirs the said two
hundred and fifty acres of land hereditaments and premises hereby granted and
released or mentioned so to be and every part thereof with the appurtenances
unto the said Joseph Musser his heirs and assigns against them the said Edward
Brinton and Mary Brinton and their heirs and against all and every other
person and persons whatsoever lawfully claiming or to claim by from or under
them or any or either of them shall and will warrant and forever defend by
these presents and the said Edward Brinton and Mary Brinton for themselves
their heirs executors and administrators doth covenant promise and grant to
and with the said Joseph Musser his heirs and assigns by these presents that
they the said Edward Brinton and Mary Brinton and their heirs and all and
every other person and persons whatsoever any thing having or lawfully
claiming or that shall or may at any time or times hereafter so have or claim
any estate right title or interest of in or to the premises hereby granted or
any part thereof by from or under them or any or either of them shall and will
at any time or times hereafter upon the reasonable request costs and charges
in the law of the said Joseph Musser his heirs or assigns make execute and
acknowledge or cause so to be all and every such further and other reasonable
act and acts deed or conveyances or assurances in the law whatsoever for the
further and better assurance and confirmation of the said two hundred and
fifty acres of land and premises hereby granted or mentioned so to be and
every part thereof with the appurtenances unto the said Joseph Muser his heirs
and assigns as by his or them or by his or their counsel learned in the law
shall be reasonably devised advised or required In witness whereof the said
parties to these presents have interchangeably set their hands and seals

Peace for the county of Lancaster Mosses Brinton and Doras Buckwalter who on
their solemn Affirmation do say that they saw Edward Brinton and Mary Brinton
sign seal and as their act and deed did acknowledge the within writing to be
their deed for the uses therein mentioned and that they set their hands as
evidence thereunto Witness my hand and seal the sixteenth day of June Anno

The Last Will and Testament of Jost Mosser Deceased being wrote in the
German Language could not be recorded but thereon is Endorsed as flows, Viz,
Lancaster County SS. Apepard before ye subscriber Bane Landis; hans
Whittmer, and Christian Stauffer the Witnesses to ye within Will who did
solemnly Affirm they were present and saw and heard ye Testa within named Sign
Seal and declare ye within writing as his Last Will and Testament and at ye
doing thereof he was of sound disposing mind Memory and Understanding, to the

and Y-2 -- when these books were photocopied the covers were put on the wrong
books, so indexes based on the original filings are wrong when compared to the
County Courthouse):
The 21st day of March in the Year 1760 I Jost Musser in Lampeter Township
and in the County of Lancaster being of good memory and understanding thanks
be given to Almighty God for the same and knowing that it is appointed for all
men to die I make and ordain herewith my Last Will and Testament in form
following viz First I recommend my Soul unto the Hands of the Lord and my Body
to be buried in a Christian like manner and as concerning my temporal Estate
wherewith it has pleased God to bless me in this world I order and bequeath
the same in manner following. Imprimis it is my will that after my decease in
the first all my debts should be paid off. Item it is my will that after my
decease my loving wife Veronica with the children shall continue to keep house
as long as it pleaseth her, but if one of my sons should marry he shall go to
live on my first(?) Plantation which shall be adjudged and valued unto him by
four impartial men of which my guardians shall choose two and he who gets the
place shall choose the other two and when my other son marrieth then shall the
Plantation where I live on in like manner be valued unto him of Four impartial
men of which also my Guardians shall choose two and he who gets the place two
and these four men shall set then their yearly payments or terms which each of
them shall pay yearly as they shall judge at proper and reasonable, and
because the two places are not yet paid by the Land Lord therefore if it
should happen that they must be paid during the time my will continues the
housekeeping they shall be paid out of my estate and after one of my sons have
entered the Place where I live or to possess it they shall divide all my goods
and personal estate in manner following. In the first I bequeath unto my
loving wife Veronica the sum of Eighty Pounds in cash and a mare of Ten pounds
worth and a cow which she will have and a chest which she will have and she
shall have ability(?) to take as much Kitchen furniture and linens cloth as
she has need of. And to her dower and further maintenance shall be of my sons
who possess the Place where I lived on yearly give unto her as follows. At
first he shall build her a little house to live in and firwell(?) for her
yearly at first dry and cut firewood 40 pounds fat beef and 100 pounds dry
port 12 bushels of wheat 3 bushels of corn 2 bushels of barley and two cows of
Apple ties which she will have in the length or Breadth and peaches and
cherries as much as she needs and 25 pounds of bestwelled(?) Hemp together
with the two thereof and to sow her a quarter of Flax into good tilled ground
and 6 pounds good wool and the fourth part of the Kitchen and cabbage garden
well changed and 10 pounds of Sunires(?) and to keep her Cow and Mare always
in the Pasture and to feed them in the winter with his own. And concerning the
land where my son Henry lives on I order and give unto my herein appointed
Guardians a right to give him a deed out of mine and he shall have it for 525
Pounds and he shall give Bonds for it last every year 30 Pounds as many as it
will make out. And concerning the residue of my estate it is my will and I
order herewith that my children shall divide it all in equal portions. And as
John Wanner and Anne Wanner are my step children they shall nevertheless be my
right heirs and stand with my children in equal shares but said John Wanner
shall count his patrimony it being 23 Pounds to it. And it is my will that my
eldest son according to law shall inherit two portions but they shall all
inherit equal my step children as my own and the youngest as the eldest. And
I order and appoint herewith Abraham Wittmer Jacob Hartman and my son Henry as
Executors and Guardians of my wife and children and of all my estate and of my
last Will and Testament. And I revoke herewith all former wills testaments
and legacies and acknowledge this to be my last will and testament and no
other. In witness whereof I have hereunto set my hand and seal on the day and
