one thousand Seven Hundred and Sixty One Between Jacob Miller of the County of
Lancaster in the Province of Pennsylvania Yeoman of the one part and Abraham
Toner and Christian Miller of the County and Province aforesaid Yeoman of the
other part, Whereas the said Jacob Miller in and by a certain Bond or Writing
Obligatory under his Hand and Seal bearing equal Date herewith stands held and
firmly bound unto the said Jacob [sic] Toner and Christian Miller in the Sum
of Six hundred and Sixty pounds lawful Money of Pennsylvania conditioned for
the payment of Three Hundred and Thirty pounds like Money on the Twenty third
day of this Instant September together with lawful interest for the same as in
and by the said in part recited Bond or Writing Obligatory and the condition
thereof (relation thereunto being had) more at large appears, Now This
Indenture witnesseth that the said Jacob Miller as well for and in
Consideration of the aforesaid Debt or Sum of Three hundred and Thirty Pounds
and for the better securing the payment thereof with its Interest unto the
said Abraham Toner and Christian Miller their Executors Administrators and
Assigns in Discharge of the said recited Obligation as of the further Sum of
Five Shillings to him in hand paid by the said Abraham Toner and Christian
Miller at and before the Ensealing and Delivery hereof the Receipt whereof is
hereby acknowledged hath granted bargained sold released and Confirmed and by

hundred and sixty six acres of Land Hereditaments and all and singular the
premises hereby granted and released or mentioned or intended so to be with
the Appurtenances unto the said Abraham Toner and Christian Miller their
heirs and assigns to the only proper use benefit and behoof of the said
Abraham Toner and Christian Miller their heirs and Assigns forever, Provided
always that if the said Jacob Miller his heirs Executors Administrators shall
and do well and truly pay or cause to be paid unto the said Abraham Toner and
Christian Miller their Executors Administrators or Assigns the aforesaid Debt
of Sum of Three hundred and Thirty Pounds with lawful Interest for the same on
the Day and Time mentioned for payment thereof according to the Condition of
the above in part recited Bond or Writing Obligatory without Fraud or further
Delay then and from thenceforth as well this Present Indenture and the state
hereby granted shall become void any thing hereinbefore contained to the

Six percent for roads etc And the said Jacob Kendig being right fully sized of
and the Said four hundred acres of land with the Appurtenances died Intestate
and without Issue and after the Decease of the Said Jacob Kendig the above
mentioned four Hundred acres of Land Descended to and vested in George Kendig
the Brother and Heir at Law of the Said Jacob Kendrick Deceased, Who by his
Certain Indenture together Barbara his wife Duly Executed the twentyeth day of
December Anno Dom 1731 Did Grant and Confirm unto Michael Downer aforesaid and
to his Heirs and Assigns a certain piece or Parcel of the above recited four
hundred Acres of Land Bounded and Described as Beginning at a post in the
Corner of Jacob Downers Land and from thence Extending by Joseph Buchwalter
North by West Two hundred and twenty six perches and a half to a post, thence
West by South one hundred and fifty perches to a post, thence by land Late of
Felix Landes South by East Two hundred and twenty five perches and half to a
post, thence by Jacob Kendigs Land East by North one hundred and fifty perches
to the place of Beginning, Containing Two hundred Acres and the Usual
Allowance of Six Acres PC for Roads etc to be held on of him the Said Michael
Downer his Heirs or Assigns forever Reference to the Said Several Indentures

that the said Michael Downer and Magdalena his wife as well for the Love and

being and all other the Buildings Improvements Orchards Gardens Meadows fields
Woods Waters Ways Rents Issues Profits Privileges Advantages Hereditaments and
Appurtenances And all and Singular the Estate or Estates Right Title and
Interest Liberty Property Heritage Claim or Demand whatsoever of them the Said
Michael Downer and Magdalena his wife their heirs Assigns or either of them of
in or to the Same Belonging or in any wise appertaining and all the Reversion
and Reversions, Remainder and Remainders thereof, To Have and To Hold unto him
the said Abraham Downer and to his Heirs and Assigns to the only proper use
Benefit and Behoof of him the said Abraham Downer and to his Heirs and Assigns
forever Subject and under the Proportional Part of the Yearly Quit Rent and
all other the Reservations from hence forth to become due to the Honorable the
Proprietaries and Successors in name and Form as in the Original Grant
mentioned and Specified, And without any other Covenant Cause or Condition
??> Change or Incumberance Whatsoever Except what appears in these Presents,
And the Said Michael Downer for himself and for Magdalena his wife their Heirs
Executors Assigns and Every of them Respectively Doth further Grant Covenant
Promise and Agree to and with the Said Abraham Downer and his Heirs and
Assigns the Said given and granted Lands and Premises unto him the said
Abraham Downer and his Heirs and Assigns Against All Manner of Persons to
Warrant and forever defend by these Presents, And Shall at any time or times

Delivered all such further and other Reasonable Lets Deeds Devices and
Assurances either in Law or Equity howsoever as by the said Abraham Downer his

February A.D. 1767 duly executed and acknowledged win the Court of Common
Pleas at Lancaster for the County of Lancaster the first Tuesday in said Month
and year, and the lesser part being on the South West corner of that certain
tract on Mill Creek which Joseph Buckwalter and Barbara his wife did grant and
confirm unto their Son the said Abraham Buckwalter his Heirs and Assigns
forever by their certain Indenture dated the 23rd day of February A.D. 1767
etc, Relation being had of the before recited Indentures respectively will
more fully and at large manifest and made appear, Together with all and
singular the Houses Out houses edifices and buildings thereon erected and

Landis Executors in the same will named, they having first been duly qualified
well and truly to administer the Estate of the said deceased and especially to
Exhibit a true and perfect Inventory thereof into the Registers Office at
Lancaster within one Month from this date and to render as Just and true
account of the Administration on said Estate within one year or when thereto

yeoman and Elizabeth his [wife], Abraham Eby of Lampeter Township in the
County aforesaid yeoman and Esther his wife, John Downer of Lampeter Township
in the County Aforesaid Yeoman, David Downer by his Guardian Jacob Hartman of
Lampeter Township in the County aforesaid, Daniel Downer by his Guardian Peter
Eby of Warwick Township of the County Aforesaid, all of the one part, and
Christian Downer of Lampeter Township in the County aforesaid Yeoman of the
other part, Whereas Abraham Downer the Elder by Virtue of Sundry Deeds of
Conveyance duly had and Executed became Seized of a Certain Tract of Land
Situate in Lampeter in Lancaster County Containing Two hundred acres and
allowances part of a Parcel of 5500 granted by William Penn unto Tobias
Collett, Daniel Quare, Henry Goldney and the Heirs of Michael Russell by
Patent of the 25th of 6th Month 1718 but as some of the Grantors through whose
hand the aforesaid 200 acres of Land did pass were Aliens and born out of the
Allegiance of the King of Great Britain whereby it became Necessary for the
said Abraham Downer to Apply for and have a Patent of Confirmation which
Obtained under the great seal of the Province of Pennsylvania bearing date the
first day of July 1763 in which the aforesaid 200 acres and Allowance of Land
Hereditaments and Appurtenances are released and confirmed to him the said
Abraham Downer in Fee as in and by the same patent, Recorded in the City of
Philadelphia in patent Book AA Vol 4 page 395 etc may appear, And Whereas
Abraham Buckwalter and Mary his wife in and by their Indenture of Conveyance
of the 28th of October 1783 did for the Consideration therein mentioned Grant
release and Confirm unto the said Abraham Downer in Fee one hundred and forty
Acres of Land by Certain Meets and Bound therein mentioned situate Contiguous
to and Adjoining the Aforesaid Tract of Two hundred Acres and Allowances as by
the same Indenture now produced and intended to be Recorded Doth Appear, And
the said Abraham Downer being so seized died leaving to survive him a Widow
six sons and three daughters having first made and published his last Will and
Testament in writing wherein he Bequeathed his Real and Personal Estate to and
Between his wife and nine children viz Abraham, Ann who intermarried with
Martin Myers, Elizabeth who intermarried with Christian Myer, Christian,
Esther who intermarried with Abraham Eby, John, Henry, David, and Daniel, to
the four Eldest Sons he devised his Lands aforesaid and thereon nominats and
Appoints his Friends Jacob Landas and Henry Landas whole and Sole Executors of
his said Last Will and thereon also directs and empowers them to divide his
Lands between his sons Aforesaid and make deeds to them of equal Validity as
he might or could have done, Notwithstanding the said Executors delayed the
Execution of that part of the Will Probably on account the Children were not
all arrived to the Respective Ages before which period they were Summoned of
the stage of Action whereby the said division and Confirmation by Title Deed
means yet to be done which division since their decease has been made by the
Legatees themselves, the Guardians of Minor Children, with the advice and
Consent of their Friends, And is Considered that Releases from the several
Legatees respectively to each other of those that hold Land by Virtue of said
Will from those that receive Legacies in Cash may be save and Legal Mode of
Procedure to answer the spirit and intention of the Testator and Confirm the
Title Deeds to the Sons to whom the Lands were Literally Devised as he Valued
Each Child's Land at a certain sum per Acre in Order to equal his Children as

their names or in the name right or Stead of any of them shall or will by any

Premises or any part thereof they and every of them shall be utterly excluded

the proper costs and Charges in the Law of the said Christian Downer his heirs

etc may appear, And Whereas Abraham Buckwalter and Mary his wife in and by
their Indenture of Conveyance of the 28th of October 1783 did for the
Consideration therein mentioned grant Release and confirm unto the said
Abraham Downer in to one hundred and forty acres of Land situate Contiguous to
and adjoining the aforesaid Tract of two hundred Acres and Allowances as in
and by the same Deed now Produced and intended to be Recorded doth appear, And
the said Abraham Downer being so seized died leaving two Survive him a widow
six sons and three daughters having first made and published his last Will and
Testament in writing wherein he Bequeaths his Real and Personal Estate to and
between his widow and Nine Children viz Abraham, Ann who intermarried with
Martin Myer, Elizabeth who intermarried with Christian Myer, Christina, Esther
who intermarried Abraham Eby, John, Henry, David, and Daniel, to the four
Eldest Sons he devised his lands, And therein Nominates and Appoints his
Friends Jacob Landis and Henry Landis Executors of his said last will and
therein also directs and empowers them his Executors to divide his Lands
between his sons Aforesaid and make deeds to each of them of equal validity as
himself might or could have done, Notwithstanding the said Executors delayed
the Execution of that part of the Will, Probably because the sons were not all
arrived to their respective ages (before which period they were both Summoned
of the Stage of Action) whereby the said division and Confirmation by Title
Deed Remains yet to be done, which divisions since their decease has been made
by the Parties themselves and the Guardians of minor Children with the Advice
and Assistance of their Friends, And it is Considered that Release from the
Several Legatees respectively to each other of those that Hold Lands by Virtue
of said will from these that receive their Legacies in Cash may be a safe and
Legal mode of Procedure to Answer the Spirit and intention of the Testator and

Land of Jacob Waver South thirty one degrees and three quarters East Eighteen
perches and eight tenths of a perch to a post and south seventy nine degrees
East eight perches and two tenths of a perch and south forty degrees and a
half East twenty one perches to a post, and North seventy four degrees and one
quarter East fifty three perches and one quarter to a Stone, and South Seventy

thereof they and every of them shall be utterly excluded and barred forever by
these presents, And that they the said Martin Myer and Ann his wife, Christian

Be it Remembered that at and before the Execution of the within Release the
following Paragraph as a Codicil to the within mentioned Last Will and
Testament is Observed, viz, "I order and it is my will that my son Christian
Downer shall have power and privilege to take the water out of Abraham's Water
Course on both sides of the meadow, but nevertheless that they shall have it
in Rotation one like the other" which Privilege is hereby Reserved and not
released nor intended to be released, to the said Abraham Downer but to be and
sincere to the use of the said Christian Downer his heirs and Assigns
Agreeable to the will of the Testator, And that the foregoing was Acknowledged
by all the parties to the within mentioned Release as a reserve to which they
were Content and desired the same may be Admitted upon record as such. In

degrees east seventy seven perches and a half to a stone by mill creek thence
by lands of Christian Downer south thirty degrees east seventeen perches to a
white oak and north seventy three degrees and a half east fourteen perches to
a white oak and south eighty seven degrees and three quarters east one hundred
and fifteen perches to a post corner of Abraham Downers land thence by the
same north seventy three degrees and a half east fourteen perches and three
quarters of a perch to a post in a line of lands of Abraham Buckwalter thence
by the same north sixteen degrees and a half west one hundred and forty eight
perches to the place of beginning, containing one hundred and nineteen acres
and twenty perches of land it being part of the above mentioned larger tract
of two hundred acres and allowances together with all and singular the houses,
outhouses, edifices and buildings thereon erected and being woods ways waters

all and every action right estate interest or demand of in or to the said
premises or any part thereof they and every of them shall be utterly excluded
and barred forever by these presents, And that they the said Abraham Downer
and Ann his wife Martin Myer and Ann his wife Christian Myer and Elizabeth his
wife Christian Downer and Ann his wife Abraham Eby and Esther his wife John
Downer Abraham Downer and Peter Eby and their heirs any thing having or
claiming in the said premises above mentioned or any part thereof by from or
under them or any or either of them shall and will from time to time and at
all times hereafter upon the reasonable request and at the proper costs and
charges of the said Henry Downer his heirs and assigns make do and execute or
cause to be made done and executed all and every such further and other lawful
and reasonable act and acts thing and things devices and assurances in the law
for the further better and more perfect granting conveying and assuring of the
said premises above mentioned with the appurtenances unto the said Henry
Downer his heirs and assigns in fee as by the said Henry Downer his heirs and
assigns or his or their counsel learned in the law be devised advised or

justices of the peace in and for said County Abraham Downer and Ann his wife
Martin Myer and Ann his wife Christian Myer and Elizabeth his wife Christian
Downer and Ann his wife Abraham Eby and Esther his wife John Downer Christian
Downer and Ann his wife Abraham Downer and Peter Eby and severally
acknowledged the within indenture of release to be their act and deed to the
intent the same may be admitted upon record as such, their several wives
having severally arrived to their respective age and the contents made known
to them voluntarily thereto did consent in testimony whereof I have hereunto

the within instrument of writing to be their acts and deed and the within
mentioned land and premises to be the rite and estate of the within mentioned

Clagett and Cephas Beall Esquires before whom the acknowledgement to the
within deed appears to have been made and whose names are thereto subscribed
