This Indenture made the tenth day of May in the year of our Lord one
thousand seven hundred forty three, Between John Brubocher Jun of Township of
Lancaster and Province of Pennsyvania yeoman (son of Hans Brubocher deceased)
Daniel Eshleman and Elizabeth his wife, she being a daughter of the said Hans
Brubocher) of the one part, and Jacob Brubocher Junr of the Township and
County afsd Yeomen (son of the said Hans Brubacker) of the other part, Whereas
the late William Penn Esqr Proprietor and Governour in Chief of the said
Province by patent under the Great Seal and the hands of his Commisioners of
Property bearing date the 28th day of November Ano Dom 1717 for the
consideration therein mentioned did grant release and confirm unto the afsd
Hans Brubocher (by the name of Hans Pupather) a certain tract of land on
Little Conestogoe Creek in that part of the County of Chester, which since the
division of the said county is called the County of Lancaster containing seven
hundred acres of land and the usual allowance for Roads &c, To Hold to him his
heirs and assigns forever under the quit rent of one English silver shilling
or the value thereof in coin currant to be paid for every hundred acres
thereof on the first day of March yearly forever as by the said patent

the 7th day of January Ano Dom 1717 &c may more fully appear, And the said
Hans Brubocher being so possessed of the premises as affsd soon after dyed
intestate whereby the said land descended to his heirs viz the aforesaid John
Elizabeth and Jacob parties to these presents, And Whereas Jacob Brubacher the
Elder brother of the aforsd Hans Brubocker and Peter Shware of the County
aforesaid, having part of the original purchase money for the said tract of
land and were intended and understood to have been part owners in the sd land
with the said Hans Brubacher and accordingly settled and dwelt on the same
although the patent was solely in the name of the said Hans Brubocher and
agreeable thereto thereto [sic] the said parties of these presents after the
death of their said Father released to the said Jacob Brubachor the Elder and
Peter Shware Junr their several shares and parts thereof according to the
Purchase money each of them had advanced and paid to hold to them their heirs
and assigns forever, And the said Daniel Ashleman and Elizabeth his wife
having also received the value of their part of share of the said land out of
the personal estate of her said father the remainder of the said tract my
Mutual consent and agreement was divided between the said John Brubachor Junr
and Jacob Brobocher Junr parties thereto according to the value thereof and
thereby the southernmost side of the said tract on the east side of the said
Creek was surveyed for and agreed to be the part and share of the said Jacob
Brubacker Junr by the courses and distances following vizt, Beginning at a
post by the west side of the said creek being a corner of the said Jacob
Brubocher Senr land thence by the lands of John Dehuff and Benjamin hersha
east south east two hundred fifty six perches to a marked white oak thence
north north east one hundred twenty five perches to a post thence by the land
of the said Peter Shware north seventy three degrees and a quarter west two
hundred ninty six perches to a post by the west side of the said Creek then
down by the west side of the said Creek on the several courses thereof one
hundred and six perches to the place of beginning, Containing one hundred
eighty three acres of land and the usual allowance of six pct for roads and
highways, Now this indenture witnesseth that the said John Brubocher Junr
Daniel Ashleman and Elizabeth his wife to the Intent the said partition may be
fully confirmed and the said Jacob Brubaker have a free and clear title to his
part or share of the said land and premises, and for and in consideration of
the sum of five shillings lawfull money to them in hand paid by the said Jacob
Brubocker Junr the receipt whereof is hereby acknowledged they the said John
Brubocker Junr Daniel Ashleman and Elizabeth his wife have remised released
and forever quit claimed and by these presents do for them and each and every
of them and their and each and every of their heirs remise release quit claim
and confirm unto the said Jacob Brubocher Junr his heirs and assigns forever
(in his full and peaccable possession now being) all the estate right title
interest claim and demand whatsoever of them the said John Brubacker Junr
Daniel Ashleman and Elizabeth his wife and each and every of them of in and to
the before described tract of one hundred eighty three acres of land bounded
as aforesaid, Together with all and singular the houses buildings fields,
meadows, woods ways waters water-courses, rights, members improvements
hereditaments and appurtenances to the same belonging or in anywise
appertaining and the reversions and remainders rents issues and profits
thereof, To have and to hold the said tract of one hundred and eight three
acres of land bounded and limited as aforesd and being part and parcel of the
first mentioned tract of seven hundred acres unto the said Jacob Brubocher
Junr his heirs and assigns and to his and their proper use and behoof forever
to be holden of the Chief Lords of the Fee thereof under the yearly Quitrent
henceforth to become due and payable for the same so as neither the said John
Brubocher Junr Daniel Ashleman and Elizabeth his wife nor their nor any of
their heirs, shall not nor may at any time hereafter ask claim challenge or
demand any estate right title or interest whatsoever of in or to the before
described and released tract of land and premises or of in or to any part or
parcel hereof but thereof and therefrom shall be utterly debarred and forever
secluded by these presents, And the said John Brubocher Junr Daniel Ashleman
and Elizabeth his wife for themselves their heirs executors and administrators
do covenant grant and agree to and with the said Jacob Brubocher Junr his
heirs and assigns that he the said Jacob Brubocher Junr paying the yearly quit
rent aforesaid shall and may from thenceforth and forever hereafter peaceably
and quietly have hold occupy and enjoy the before described tract of one
hundred and eighty three acres of land and hereditaments with the
appurtenances and take and receive the rents issues and profits thereof
without any lawful lett suit trouble or disturbance of them the said John
Brubacker Junr Daniel Ashleman and Elizabeth his wife or any of them or their
heirs or assigns. In Witness whereof the said parties to these presents
interchangeably their hands and seals have hereunto set dated the day and year

The 24th day of May 1762. Before me the subscriber one of his Majestys
Justices of the Peace for Lancaster County psonally came John Brubocher the
only surviving grantor to the above indenture and acknowledged the same to be
his act and deed and desired the same might be recorded accordingly. And at
the same time on his solemn affirmation did declare that he saw Daniel
Eshleman and Elizabeth his wife (Co Grantors with him this affirmant and since
deceased) sign, seal execute and as their act and deed deliver the same and
that another John Brubaker and James Fox in each their respective handwriting
subscribed their names as Witnesses to the same. In testimony whereof I have

Lancaster County Court House in Book Y-2 p27 (note confusion regarding X-2 and
Y-2 -- when these books were photocopied the covers were put on the wrong
books, so indexes based on the original filings are wrong when compared to the
County Courthouse):
In the Name of God Amen. This first day of December in the year of our Lord
one thousand seven hundred and seventy three I Jacob Brubaker of Manheim
Township in the County of Lancaster being weak of Body but of sound Mind
Memory and Understanding do hereby make my last Will and Testament in the
Manner following, viz, First I recommend my Soul into the Hands of God who
gave it and my Body to the buried in the Earth as my Friends shall or may
direct and concerning my Worldly Estate herewith it hath pleased God to bless
me with in my Life Time I do hereby order and direct how to do and dispose of
the same. Item I do order that all my just debts and Funeral Charges shall be
paid and satisfied by the Executors of this my Last Will and Testament herein
after named. Item I will and order that my Executors shall give or pay to the
Poor belonging to the Society or Communion of the Mennonite the sum of twenty
Pounds Pennsylvania money. Item I bequeath and order that my beloved wife Ann
Brubaker shall foremost take back again every thing she has brought to me both
in money and affects. Item I order and will that my said beloved wife Ann
shall have her Apparage(?) or Dower in my Stone Dwelling house and the same in
which heretofore a school has been kept as also a garden and stable. Item I
order and bequeath unto my said the best Cow in ye stable and that she shall
have the use and benefit of one acre of meadow ground such as she may choose
during her lifetime but as long as she shall remain my widow. Item I give and
bequeath unto my said wife further the sum of Sixty Pounds Pennsylvania
currency to be her own property while said sum of money I do bequeath her
instead of her Right of Dower or Lands of my Real Estate and of the Benefit
thereof arising as that she is not to claim or receive any more. Item I order
and bequeath further unto my said wife that she is to receive yearly (but as
long as she shall remain a widow) of the Possessors of my Plantation fifteen
bushels of wheat ten bushels of Rye three gallons of good Rum and free fire
wood while said last Article she is to get but upon her own charges and such
part of my land where it may be at least detrimental to the Place. Further a
quarter of an acre to be sowed with Flax a half hundred weight of Hemp to be
delivered to her from the Breach Fifty lb weight of Beef to be delivered into
her said House yearly and her said Cow to have the Pasture in the same good
manner as the Tenants Cattle. Further is she to have for her own use two Rows
of Apple trees in the young orchard such as she may chose together also with
the ground wherein they stand as also one half acre of land for planting and
raising of Potatoes yearly as long as she shall remain a widow as aforesaid.
Item It is further my will and I do hereby ordain that all my Children shall
be heirs to my Estate both of Real and Personal in an equal manner and that
neither of them shall have any advantage before any of the rest and my eldest
son shall inherit no more as the youngest but that they shall be equal. Item I
give and bequeath unto my step-daughter Anna Brubaker the sum of forty five
pounds in money as and for whatever may derive to her by her said mother. Item
I will and order that my Plantation together with all the land thereto
belonging and also all my moveable effects shall be sold by my hereinafter
named Executors of this my Last Will and Testament all which is to be done in
about six months next after my decease by way of Public Vendue and it is to be
sold for the best Price that can be got for the same, And I do hereby
authorize and impower my herein after named Executors of this my last Will and
Testament with all such full Power strength and authority as may be required
for the disposing and selling off my said Estate (both Real and Personal) and
that they after shale thereof shall sign and deliver or execute all such Deed
or Deeds of Conveyance thereof as the Laws of this Country shall or may
require And that all such Deed or Deeds so by them executed as aforesaid shall
be as good Firm sure and valid in the Law as I myself might or could have done
if I myself had executed the same as my own Act and Deed. And in Case any of
my Executors should in that Interim happen to die then the survivor of them
shall have the same Power concerning the selling my Estate as aforesaid, And I
command my said Executors to use this endeavor for the welfare of my younger
children and see that they may be educated in piety and virtue. Item I will
ordain make constitute and appoint my loving friends Peter Brubaker Henry
Musser Jacob Mayer and John Wanner to be the Executors of this my last Will
and Testament and also appoint the same my said Friends to be Guardian over
the Persons and Estate of two of my minor Children viz Abraham Brubacker and
Jacob Brubaker (the rest being of age). The foregoing is and shall be my Last
Will and Testament and I do hereby annul and revoke all other former will or
wills by me made heretofore but this only one which I do hereby ratify and
confirm to be my last Will and Testament and no other. In Witness whereof I
have hereunto put my hand and seal the day and year first and before written.

Contents and that nothing therein is contained but what is inserted and
written with my free consent is ratified with my signing of my name hereunto

Lancaster County SS. On the fifteenth day of January Anno Domini 1774 before
me the Subscriber personally appeared Eberhart Michael one of the subscribing
Witnesses to the within will and on his Corporal(?) Oath did depose and say
that he was present and saw and heard Jacob Brubaker the Testator within named
sign seal publish pronounce and declare the within named Will as and for his
Last Will and Testament and that at the signing thereof he was of sound and
well disposing mind memory and understanding to the best of his knowledge

Lancaster County SS. On the fifteenth day of January Anno Domini 1774 Before
me the subscriber personally appeared Benj Hershey one of the subscribing
Witnesses to the within Will and on his solemn affirmation did depose and say
that he was present and saw and heard Jacob Brubaker the Testator within named
sign seal Publish Pronounce and declare the within named will as and for his
Last Will and Testament and that at the signing thereof he was of sound and
well disposing mind memory and understanding to the best of their knowledge

Be it Remembered that on the fifteenth day of January Anno Domini 1774 the
last will and Testament of Jacob Brubaker late of Manheim Township in the
County of Lancaster yeoman deceased was proved in due form of Law and Letters
Testamentary were granted to Peter Brubaker Henry Musser and Jacob Meyer and
John Wanner the Executors therein named they being first duly qualified will
and truly to administer of the Testator and to exhibit a true and perfect
Inventory into the Registers Office at Lancaster on or before the fifteenth
day of February to render a true and just account of their administration of
the said Estate when thereto lawfully required. Given under the seal of the

intermarried with two of the daughters of Jacob Brubacher late of Manheim
Township deceased, It is ordered that a Citation do issue to Peter Brubaker,
Jacob Myer, Henry Musser, and John Wanner executors of the last Will and
Testament of the said Jacob Brubaker deceased to appear at the General Orphans
Court to be held at Lancaster on the first Tuesday in December next then and
there to settle and pass their administration Account on the Estate of the
