Know all men by these Presents that I Daniel Downer have had and received of and from Peter Eby who had been Guardian duly appointed by the Orphan Court at Lancaster over my Estate during my Minority the sum of Four hundred and seventy eight pounds fifteen shilling and four pence in Cash and for the sum of two hundred and sixty five pound three Shilling and seven pence in Bonds to be paid by John and Henry Downer, it being in full for my Share Part of Proportion out of the Real and Personal Estate of my father, Abraham Downer deceased. In Consideration whereof I the said Daniel Downer do by these presents for myself and my Heirs Executors and Administrators and every of them remise release and forever quit claim unto the said Peter Eby his heirs Executors and Administrators and every of them all the said Sum or Sums of money my Share Part and Proportion out of the Real and Personal Estate of my said Father, Abraham Downer deceased whatsoever came into the hand of the said Peter Eby and also all and all manner of Action and Actions Suits Reckonings Accounts and Demands whatsoever I the said Daniel Downer now have or I or my Heirs Executors or Administrators hereafter might have for or against the said Peter Eby or his Heirs Executors or Administrators or any of them for or on account of his Guardianship over my Estate or any matter of Thing in anyway relating to or respecting the same. In Witness whereof I the said Daniel Downer have hereunto set my Hand and Seal the twelfth day of January in the year of our Lord one thousand Eight hundred and three. Daniel Downer.

This Indenture made the twenty fifth day of December in the year of our Lord one thousand eight hundred and four Between Adam Hall of Frankford Township Cumberland County and State of Pennsylvania Yeoman and Eve his Wife of the one part and Daniel Downer of Lampeter Township Lancaster County and State aforesaid Yeoman of the other part, Witnesseth that the said Adam Hall and Eve his wife for and in consideration of the sum of six hundred fifty three pounds five shillings lawful money of the State of Pennsylvania to them in hand well and truly paid by the said Daniel Downer at and before the ensealing and deliver hereof the receipt whereof they do hereby acknowledge and thereof do acquit and forever discharge the said Daniel Downer his heirs executors and administrators by these presents, Have Granted Bargained Sold Aliened Enfeoffed Released and Confirmed and by these presents do grant bargain sell alien enfeoff release and confirm unto the said Daniel Downer and to his heirs and assigns all that certain plantation and tract of land Situate in the aforesaid township of Frankford Cumberland County Beginning at an ash tree on the north side of Conedoquinet Creek at the mouth of a run entering into said Creek thence up said run by land of Jacob Her the several courses thereof one hundred and forty two perches and a quarter to a small white oak, thence by land of William Galbraith South sixty four degrees and a half east one hundred and fifty eight perches and a quarter to a post, thence north two degrees west fifty perches to a post, thence by land of John Richard Woods near the mill dam north thirty one degrees west one hundred and fourteen perches to a post, thence North twenty one degrees west twenty nine perches and a quarter to a post, thence north sixty nine degrees east four perches to a white oak on the bank of the Creek and north thirty two degrees west eleven perches to the place of Beginning, Containing Sixty eight acres and thirty one perches and the usual allowance, it being the same plantation and tract of land which by several good and lawful Conveyances became vested and in lawful possession of the said Adam Hall his heirs and assigns forever as in and by the said Conveyances relation being thereunto had may more fully and at large appear, Together also with all and singular the houses outhouses barns stables gardens orchards meadows fields fences ways woods waters water courses rights privileges hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining, And the Reversions and Remainders rents issues and profits thereof, and all the estate right title Interest use property possession claim and demand whatsoever of them the said Adam Hall and Eve his wife in Law or equity or otherwise howsoever of into our out of the same, To have and to Hold the said Plantation and tract of land containing sixty eight acres and thirty one perches and allowance aforesaid hereditaments and premises hereby granted and released or mentioned or intended so to be with the appurtenances except as hereafter excepted unto the said Daniel Downer and to his heirs and assigns forever, to the only proper use and behoof of him the said Daniel Downer his heirs and assigns, except such reservations as are reserved for the use of the Commonwealth and all the land hereditaments and premises which have been heretofore granted bargained unto Jacob Alter Esquire out of the above described plantation tract of Land, And the said Adam Hall for himself his heirs Executors and Administrators do covenant promise grant and agree to and with the said Daniel Downer his heirs and assigns by these presents that he the said Adam Hall and his heirs the said above described plantation and tract of land (except as above excepted) hereditaments and premises hereby granted and Released or mentioned or intended so to be with the appurtenances unto the said Daniel Downer his heirs and Assigns that them the said Adam Hall and Eve his wife and their heirs and against all and every other person and persons whomsoever lawfully claiming or to claim the same or any part or parcel thereof by from or under him them or any of them shall and will warrant and forever defend by these presents. Domini one thousand seven hundred and ninety one did Grant and Confirm unto James and Robert McFarlane in fee a certain Tract of Land Situate in the aforesaid township of West Pennsboro Containing two hundred and fifty eight acres and a half and allowances as in and by said Patent Enrolled in the Rolls Office for the State of Pennsylvania in patent Book No 18 page 222 reference thereunto being had may more fully appear, And Whereas the said James McFarlane and Elizabeth his wife and the said Robert McFarlane by their joint Indenture bearing date the third day of May in the year of our Lord one thousand seven hundred and ninety six for the consideration therein mentioned did grant and confirm sixty seven acres and one hundred and fifty seven perches part of the aforesaid Tract of two hundred This Indenture made the thirteenth day of April in the year of our Lord one thousand eight hundred and nineteen Between Robert MacFarlane and James Davidson of West Pennsboro Township in Cumberland County and State of Pennsylvania, surviving executors of the last will and Testament of James MacFarlane Esquire late of the aforesaid township of West Pennsboro deceased of the one part and Daniel Downer of the same place yeoman of the other part, Whereas the Commonwealth of Pennsylvania by patent bearing date the Eighteenth day of November in the year of our Lord one thousand seven hundred and eighty five did grant and confirm unto the aforesaid James McFarlane and to his brother Robert McFarlane in fee a certain tract of land called "Troy" situate in West Pennsboro Township Cumberland County aforesaid containing three hundred acres and five eighths of an acre and the usual allowance as in and by the said patent enrolled in the Record Office for the State of Pennsylvania in Patent Book No 4 page 113 reference thereunto being had may more fully and at large appear, And whereas the said Commonwealth by one other patent bearing date the twentieth day of September in the year of our Lord one thousand seven hundred ninety one did grant and Confirm unto the said James and Robert McFarlane in fee one other Tract of Land situate in the aforesaid township called Pleasant Grove containing two hundred and fifty eight acres and a half and the usual allowance as in and by said patent enrolled in the aforesaid Office in patent book No 18 page 228 Reference thereunto being had may more fully and at large appear, And Whereas the said James McFarlane and Robert McFarlane have made division of the above mentioned tract of three hundred acres and five eighths of an acres and allowances as also of some other land that they held Between them in common as appear by a certain Indenture under the hand and Seal of the said Robert McFarlane bearing date the thirty first day of October Anno Domini one thousand eight hundred and three in and by which Indenture the said Robert McFarlane did grant and Confirm unto his brother the said James McFarlane and to his Heirs and assigns forever a certain tract of land containing one hundred and ninety eight acres and a quarter being an equal moiety of the lands and premises held by the said James and Robert McFarlane as Tenants in common, And the said James McFarlane being so thereof seized in his demesne as of fee of and in the said tract of one hundred and ninety eight acres and a quarter, departing this natural life, having first made his last Will and Testament in writing bearing date the fifteenth day of December Anno Domini one thousand eight hundred and seven did therein and thereby amongst other things did will and order in the words following to wit, "I do authorise and empower the Executors of this my Will to sell and Convey the whole of my real estate to the best advantage there came." This Indenture made the day of Anno Domini one thousand eight hundred and twenty two Between David Bear of Westpennsboro Township Cumberland County and State of Pennsylvania and Esther his wife of the one part and Daniel Downer of the same Township County and State aforesaid of the other part, Witnesseth that the said David Bear and Esther his wife for and in consideration of the sum of three thousand six hundred and eighty two dollars and ninety three cents lawful money of the United States to them in hand paid by the said Daniel Donner at or before the ensealing or delivery hereof the receipt whereof is hereby acknowledged have granted bargained sold aliened enfeoffed released and confirmed and by these presents do grant bargain sell alien enfeoff release and confirm unto the said Daniel Downer his heirs and assigns the following described piece or parcel of land situate in the Township County and State aforesaid bounded and described as follows, viz, Beginning at a post thence by land of Paul Pierce now Andrew Pierce south forty five degrees and one half east one hundred and forty nine perches and one fourth to a post, south twenty five degrees east thirty four perches to a post, thence by Henry Warners land south seventy degrees and three fourths East ninety three perches to a post, south seventy three degrees west nineteen perches to a stone, north twenty four degrees and one half west one hundred and fifteen perches and one half to a post, thence by James McFarlane's heir's land north thirty three degrees and one half East sixty six perches to the place of beginning, Containing eighty acres and one hundred and fifty one perches neat measure, It being the same tract of land of which Martin George by sundry good and lawful conveyances or other assurances in the law duly had and executed became in his lifetime lawfully seized in his demesne as of fee, and being so thereof seized died Intestate leaving a widow and issue five children and upon settlement of the Administration account of the personal estate of the said Intestate it was ascertained that there were not sufficient assets in the hands of the Administrators for the payment of the debts and maintenance and education of the minor children of the said Intestate as will appear by having reference to said administration account filed in the Register Office at Carlisle in the said County of Cumberland, And whereupon at an Orphans Court held at Carlisle in and for the Said county the nineteenth day of September A Domini one thousand eight hundred and twenty one upon the petition of David Shallaberger and Daniel Downer administrators of all and singular the goods and chattels rights and credits which were of the said Martin George at the time of his death, who died Intestate praying the Court to grant them an order to make sale of the said messuage and tract of land for the payment of the debts and maintenance and education of the minor children of the said Intestate, it was ordered by the said Court that the said Petitioners should appose(?) the premises aforesaid to sale by public vendue or out cry and sell the same for the purposes aforesaid and that they should make a report of their proceedings therein to the next stated orphans Court to be held for said county, And pursuance of which order they the said David Shellaberger and Daniel Downer (after due public and timely notice by them given of the time and place of Sale) did on the seventeenth day of December AD 1821 Expose the premises aforesaid to sale by public venue or out cry and sold the same to the said David Bear for the sum of three thousand six hundred and eighty two dollars and ninety three cents he being the highest bidder and that the highest and best price bidden for the same which sale or report thereof made to the Justices of the said Court the nineteenth day of December AD 1821 and confirmed by the said Court and it was considered and adjudged by the said Court that the same should be and remain firm and stable forever as by the Records and proceedings of the said Court relation being thereunto had more fully appear, And whereas the said David Shellaberger and Daniel Donner administrators of all and singular the goods and chattels rights and credits which were of the said Martin George at the time of his death who died Intestate as aforesaid by virtue and in pursuance of the said order of Court for the sale of the Real Estate of the said Intestate, by Indenture under their hands and seals bearing date the first day of April A Domino one thousand eight hundred and twenty two for the consideration therein mentioned did grant and confirm unto the said David Bear and to his heirs and assigns all that the said above mentioned and described tract of land with the This Indenture made the fifth day of April Anno Domini one thousand eight hundred and thirty three Between Andrew Pierce of West Pennsborough township Cumberland County and State of Pennsylvania Yeoman and Rebecah his wife of the one part and Daniel Downer of the same place of the other part, Witnesseth that the said Andrew Peirce and Rebecah his wife for and in consideration of the sum of five thousand four hundred dollars lawful money of the United States to them in hand paid by the said Daniel Downer at or before the ensealing or delivery hereof the receipt whereof is hereby acknowledged, have granted bargained sold aliened enfeoffed released and confirmed and by these presents do grant bargain sell alien enfeoff release and confirm unto the said Daniel Downer and to his Heirs and assigns all that certain tract of land situate in the aforesaid township West pennsborough Cumberland County beginning at a hickory on the bank of Connodogwannet Creek thence by the heirs of Joseph Pierce deceased south forty eight degrees and three quarters east forty two perches and a half to a white oak, thence South twenty six degrees and a half east eighty four perches and a half to a post, thence South thirteen degrees and a quarter east seventy eight perches and a half to a black oak, thence south eleven degrees and three quarters east Seventy six perches and a half to a stone, thence South seven degrees east sixty two perches and a half to a post, thence south sixty eight degrees west fifteen perches and six tenths to a thence south twenty four degrees and three quarters west six perches to a heap of stones, thence by land of north forty five degrees and a half west one hundred and forty eight perches to a post, thence by land of James McFarland North thirty one degrees and three quarters west sixty eight perches and a half to a post at the aforesaid creek, thence down the said creek the several courses thereof one hundred and nine perches and a quarter to the place of beginning, Containing one hundred twenty four acres and one hundred fifty eight perches and allowances, it being part of the real estate of Joseph Pierce father of the said Andrew Pierce who died intestate seized in his demesne as of fee of and in the above described tract of land, together with other lands which said above described tract of land (together with other land) containing one hundred and twenty four acres and one hundred and fifty eight perches and allowance aforesaid marked in the diagram No B which was confirmed to said Andrew Peirce by his guardian Archibald McAllister, To have and to hold to said Andrew Peirce his heirs and assigns forever agreeably to the confirmation and proceedings of the Orphans court of Cumberland county entered on the Orphans Docket No 5 page 268 reference thereunto being had may more fully and at large appear, It being hetsby(?) a Patent from the late proprietaries, Together with all and singular the buildings improvements woods ways water courses rights liberties privileges advantages hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining the reversions and remainders rents issues and profits thereof and also all the estate right title interest use trust possession property claim and demand whatsoever of the said Andrew Peirce and Rebecah his wife in law equity or otherwise howsoever of in to or out of the same and every part and parcel thereof, To have and to hold the said described tract of land containing one hundred fifty four acres 158 perches and allowances hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said Daniel Downer his heirs and assigns, to and for the only proper use benefit and behoof of him the said Daniel Downer his heirs and assigns forever, And the said Andrew Peirce for himself and for his heirs executors and administrators grant covenant promise and agree to and with the said Daniel Downer and his heirs administrators and assigns by these presents that he the said Andrew Peirce and his heirs executors and administrators the said described tract of land hereby granted with the appurtenances unto the said Daniel Downer his heirs and assigns against them the said Andrew Peirce and his heirs and against all and every other person or persons whomsoever lawfully claiming or to claim any right title or interest in and to the same or any part thereof, shall and will warrant and forever defend by these presents. Therefore we command you that taking with you twelve good and lawful men of your Bailwic by whom the truth of the matter may be better known in your proper persons you go to the premises aforesaid with the appurtenances and then and there by their oaths and affirmations in the presence of the parties aforesaid by you to be warned (if upon being warned they will be present) the premises aforesaid with the appurtenances you cause to be parted and divided and one eighth part whereof (the whole into eight equal parts to be divided) with the appurtenances to the said John Doner and to his heirs and assigns one eighth part thereof (the whole into eight parts to be divided) with the appurtenances to the said Henry Doner and to his heirs and assigns, one other eighth part thereof (the whole into eight parts to be divided) with the appurtenances to the said Daniel Doner and to his heirs and assigns, one other eighth part thereof (the whole into eight parts to be divided) with the appurtenances to the said Abraham Downer John Doner David Downer Rudolph Shank and Susanna his wife David Long and Ann his wife Martha Bowman to each of them the one Seventh of the one eighth part thereof and to their heirs and assigns, And the other one Seventh part of the said one eighth part thereof unto Christopher Downer John Downer and David Downer and to their heirs and assigns one other eighth part thereof (the whole into eight parts to be divided) with the appurtenances to the said Mary Downer Eliza Downer Christopher Downer David Downer William Salmon and Martha his wife Daniel Downer Henry Downer John Downer Abraham Downer and Joseph Downer that is to say, to each of them one tenth of the one eighth part thereof and to their heirs and assigns respectively, one other eighth part thereof (the whole into eight parts to be divided) with the appurtenances to the said Christian Meyer and Elizabeth his wife and to their heirs and assigns, one other eighth part thereof (the whole into eight parts to be divided) with the appurtenances to the said Leah Neff Lydia Eby Ann Eby and Susanna Eby that is to say to each of them one fourth part of the one eighth part thereof and to their heirs and assigns respectively, and one other eighth part thereof (the whole into eight parts to be divided) with the appurtenances to the said Abraham Meyer John Meyer John Forry and Ann his wife and Jacob Miller and Elizabeth his wife that is to say to each of them one fourth part of the one eighth part thereof and to their heirs and assigns respectively to be held by the said parties respectively in severally you cause to be assigned and delivered so that neither the said Demandants and the said Defendants respectively nor their heirs shall have more in the respective parts of the premises aforesaid with the appurtenances then they might and to them apportioneth to have so that the said Demandants and the said Defendants respectively their parts of the premises aforesaid with the appurtenances to them respectively happening severally may appropriate themselves, But if the said Inquest by you to be Summoned as aforesaid to make the said partition shall be of opinion that the premises aforesaid with the appurtenances cannot be so parted and divided without prejudice to or spoiling of the whole, then we command you that you cause the said Inquest to equalize such partition or purparts (if equal partition in value cannot be made of any share or purport) by valuing the purparts respectively and to award that any one or more of the shares or purparts shall be subject to the payment of such sum of money as shall be equal to the difference in value of any other share or shares purpart or purparts and return the same with their Inquest otherwise to make a just valuation and appraisement of the premises aforesaid with the appurtenances on their oaths or affirmations due notice having been first given to the several persons or parties interested in the same premises to appear if they think fit at the time and place of holding such Inquisition and that partition or valuation which you shall so make you distinctly and openly have under your hand and seal and under the hands and Seals of those by whom the same shall be made before our Judge at Lancaster at our District Court for the City and County of Lancaster there to be held on the first Monday in September next that such further proceedings may be had as to law and Justice shall appertain, And have you then there this writ. Inquisition taken at the dwelling house Daniel Boch in Lampeter Township Lancaster (being part of the premises in the annexed writ ascribed on Thursday the 29th day of August Anno Domini Eighteen hundred and thirty three by virtue of a writ de partitione Facienda directed to the Sheriff of Lancaster County and annexed to this Inquisition upon the oaths of Timothy Rogers, John George Cooper, John M Duchman, John Leonard, Adam Metzger, Jacob Rathfor, and the solemn affirmations of Benjamin Landis, David Buchwalter, Jacob Landis, Abraham Landis, Jacob Demuth and Jacob Bushony, twelve free honest and lawful men of the baliwic of the same Sheriff who upon their oaths and affirmations aforesaid respectively do say that they went into and upon the Real Estate of Abraham Downer late of the Borough of Manetta deceased and in said writ described viz Number one consisting of a certain plantation and Tract of land situate in the Township of Lampeter in the County of Lancaster Containing one hundred and sixteen acres more or less adjoining to land of Henry Downer, James Porter, Daniel Lefever, Christian Diffenbach, and others which has lately been surveyed by Israel Carpenter and divided into two purparts as follows, to wit, Purpart A Consisting of one hundred and ten acres and four perches of land including the mansion house, barn and other improvements according to the Draught hereto annexed, Purpart B Consisting of Twelve acres and thirty six perches of land whereon is erected a house Stable and other improvements according to the Draught hereto annexed, Purpart C Consisting of a certain Lot of Ground situate in Front Street in the Borough of Manetta in said County whereon is erected two two story frame dwelling houses and Store and other improvements adjoining to lot of David Cassel and lot of Mrs Mary Downer and the Inquest aforesaid upon their oaths and affirmations aforesaid respectively do Say and find that the premises aforesaid with the appurtenances cannot be divided to and among the parties in the said writ named by assigning and delivering to each one equal part in value of the said premises without prejudice to and spoiling of the whole, And they do further say and find that the said premises with the appurtenances cannot be divided to and among all the parties in the said writ named by and delivering to each a Share or purpart of the same premises of an equal value and by equalizing such parts by valuing the same respectively and awarding that the same purparts or shares should be subject to the payment of such sum or sums of money as would give to the other parties in the said writ named respectively a share of equal value to their interest respectively in said premises without prejudice to and spoiling of the whole. And I do therefore the said Inquest have valued and appraised the said Purport A consisting of one hundred and ten acres and four perches of land at and for the sum of Eighty two dollars per acres amounting to the sum of Nine thousand and twenty two dollars and fifty cents, And Purpart B consisting of twelve acres and thirty six perches of Land at and for the sum of ninety five dollars per acre amounting to the sum of one thousand one hundred and sixty one Dollars and thirty seven cents, And Purpart C consisting of a Lot of Ground on Front street in the Borough of Manetta in said County whereon is erected two two story frame dwelling houses Store and other improvements adjoining to Lots of David Casset and Mary Downer and for the sum of thirteen hundred dollars. Same day John Downer the eldest brother of Abraham Downer deceased appearing in Court agrees to accept purpart A in the said Inquisition mentioned containing 110 acres and four perches valued at $9022.50 whereupon the Court adjudged it to him on his paying or securing to be paid to the other parties in the said writ named their proportions of the appraised value according to their respective rights.

This Indenture made the twenty eighth day of March Anno Domini one thousand eight hundred and thirty seven, Between Michael Miller of Frankford Township Cumberland County and State of Pennsylvania and Susannah his wife of the one part and Daniel Doner of West Pennsboro Township County and State aforesaid, yeoman, of the other part, Witnesseth, that the said Michael Miller and Susanna his wife for and in consideration of the sum of two hundred and seventy five dollars lawful money of the United States to them in hand paid by the said Daniel Doner at and before the ensealing and delivery hereof the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, enfeoffed, released and confirmed and by these presents do grant, bargain, sell, alien, enfeoff, release, and confirm unto the said Daniel Doner and to his heirs and assigns a certain tract or lot of land situate in the Township of Frankford aforesaid Bounded and described as follows, to wit, Beginning at a post on line of Alexander Kerr's land and near to the Conodogunet Creek thence by land of said Kerr North sixty four degrees west twenty two perches to a post thence by other lands purchased by said Doner North thirty five east thirty two perches to a post on line of William Atlers land, thence by the same south two degrees east thirty six perches to the place of Beginning, Containing two acres and fifty four perches neat measure it being part of a larger tract of land which was part of the real estate of William Drawbach late of Frankford Township upon which estate a writ of partition and valuation issued of the Orphans of Cumberland County to the sheriff of said County tested at Carlisle the 10th day of September A.D. 1818, and returnable at the next Stated orphans Court and being returned accordingly by the said Sheriff with an inquisition thereunto annexed loyally taken whereupon Jacob Alten Esquire guardian of George Drawbach one of the minor children of the said William Drawbach decd prayed the Court to award to him for the use of his said ward that part marked No 1 in said inquisition, Whereupon the Court (on certain conditions) awarded the same to the said Jacob Alter Esquire, guardian for the use of his said ward as in and by the records of the said Court remaining in the office of the said Court at Carlisle, reference being thereunto had may more fully and at large appear, and the said two acres and fifty four perches of land which George Drawbach and Barbara his wife by their Indenture dated the twenty first of June one thousand eight hundred and thirty four, for the consideration therein mentioned did grant and confirm unto the aforesaid Michael Miller as in and by said Indenture reference being thereunto bad will more fully and at large appear, Together with all and singular the buildings, improvements, woods, ways, waters, water courses, rights, liberties, privileges, and hereditaments and premises appurtenances whatsoever thereunto belonging or in any wise appertaining, the reversions and remainders, rents, issues, and profits thereof, and all the estate rights, title, trust, possession, property claim and demand whatsoever, of the said Michael Miler and Susannah his wife of law or equity or otherwise howsoever of in to or out of the same, and every part and parcel thereof, To Have and to hold the said described tract or piece of two acres and fifty four perches of land neat measure hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said Daniel Doner his heirs and assigns to such proper use and behoof of them the said Daniel Doner his heirs and assigns forever, And the said Michael Miller for his heirs, executors, and administrators, doth covenant, promise, and agree to and with the said Daniel Doner his heirs executors administrators and assigns by these presents that he the said Michael Miller and his heirs executors and administrators the said described tract of two acres and fifty four perches of land hereby granted with the appurtenances unto the said Daniel Doner his heirs and assigns against him the said Michael Miller and his heirs and against all and every other person or persons whomsoever lawfully claiming or to claim any right title or interest in and to the same or any part thereof shall and will warrant and forever defend by these presents. This Indenture made the thirtieth day of March in the year of our Lord one thousand eight hundred and thirty seven, Between George Drawbach of Frankford Township Cumberland County and State of Pennsylvania and Barbara his wife of the one part and Daniel Doner of West Pennsboro Township County and State aforesaid of the other part, Whereas by force and virtue of a deed of conveyance duly executed by the aforesaid Daniel Doner and Elizabeth his wife bearing date the day of A.D. one thousand eight hundred and ten, William Drawbach became in his lifetime lawfully seized in his demesne as of fee of and in two tracts or parcels of land in said Deed particularly described and being so thereof seized died intestate whereupon a writ of Partition and valuation issued to the Sheriff of Cumberland County tested at Carlisle the 10th day of September A.D. 1818, returnable to the next stated Orphans Court for the valuation of the real estate of the said William Drawbach late of Frankford Township deceased and being returned accordingly by the said Sheriff with an inquisition thereunto annexed lawfully taken by the said Sheriff Dated the 10th day of October A.D. 1818 in which inquisition said real estate was divided into two parts, to wit, No 1 containing thirty acres and ninety two perches appraised at twenty three dollars and thirty three cents per acre with the usual allowances No 2 containing thirty nine acres and ninety nine perches neat measure and John Drawback eldest son of said intestate came into Court and prayed the Court to award that part of real estate in said inquest marked No 2 to him whereupon the Court awarded the same to the said John Drawbach under the conditions in the said award mentioned, and Jacob Alter Esquire guardian for George Drawbach one of the children of said William Drawbach also prayed the Court to confirm that part of the said estate marked in the inquisition as No 1 to him for his said ward George Drawbach whereupon the Court awarded the same to the said Jacob Alten Esquire for the said George Drawbach upon the conditions in the said award mentioned as in and by the proceedings of the said court remaining in the office of the Clerk of the Orphans Court at Carlisle reference thereto had will more fully and at large appear, and whereas John Drawbach and Leah his wife by their Indenture bearing date the second day of December A.D. 1825 on the conditions therein mentioned did grant that part which was awarded to him the said John Drawbach marked No 2 as above unto Jacob Alten Esq guardian for William Drawbach for the use etc and the same William Drawbach and Susan his wife by their Indenture dated the second day of August A.D. 1832 for the consideration therein mentioned did grant and convey the same legally descended and who by their Indenture dated the 2nd day of April A.D. 1828 for the consideration therein mentioned did grant and convey part thereof to John Drawbach containing 54 acres 106 perches and the said John Drawbach and Leah his wife by their Indenture dated the 23rd day of May A.D. 1834 with other property and for the consideration therein mentioned did grant and confirm Sagan North seventy five and a half degrees west thirty perches to a post, and north thirty five degrees East twenty perches to the place of beginning, Containing seventy six acres and fifty eight perches strict measure, It being composed of parts of three different tracts of land, one thereof called the "Martin George place" being a tract of land containing eighty acres and fifty one perches of which Martin George Esquire died seized and which was after his decease sold by his executors to David Bear, and by the said David Bear by Deed bearing date the 1st day of April AD 1822 sold and conveyed to the said Daniel Doner as by the said Deed Recorded in Book GG vol 1 page 55 more fully appears, one other of said tracts was sold and conveyed to said Daniel Doner by Andrew Pierce and wife by Deed bearing date the 5th day of April AD 1833 Containing one hundred and twenty four acres and one hundred and fifty eight perches as by the same appears, Recorded in Book OO vol 1 page 368, and the remaining tract (of which a small part only is included in the land now conveyed) was sold and conveyed to the said Daniel Doner by Robert Laird Administrator with the will annexed of James McFarlane Esquire deceased by Deed bearing date the 1st day of January AD one thousand eight hundred and forty, as by the same appears in Recorded in the Office for Recording of Deeds in Cumberland County in Book SS vol 1 page 278, Together with all and singular the improvements ways waters water courses rights liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversions and remainders rents issue and profits thereof, and all the estate right title interest property claim and demand whatsoever of them the said Daniel Doner and Elizabeth his wife in law equity or otherwise howsoever at in and to the same and every part thereof, To have and to hold the said messuage and tract or parcel of land with the hereditaments and premises hereby granted or mentioned and intended so to be with the appurtenances as above described unto the said Abraham Doner his heirs and assigns to and for the only proper use and behoof of the said Abraham Doner his heirs and assigns forever, And the said Daniel Doner for himself his heirs executors and administrators doth by these presents covenant grant and agree to and with the said Abraham Doner his heirs and assigns that he the said Daniel Doner and his heirs all and singular the hereditaments and premises herein above described and granted or mentioned and intended so to be with the appurtenances unto the said Abraham Doner his heirs and assigns against him the said Daniel Doner and his heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof either in Law or equity shall and will by these presents Warrant and forever defend. Cumberland County SS. On the thirtieth day of March Anno Domini 1844 before me a Justice of the Peace in and for the said County personally appeared the above named Daniel Doner and Elizabeth his wife and in due form of law acknowledged the above Indenture to be their acts and deeds and desired the same might be recorded as such and the said Elizabeth being of full age and separate and apart from her said husband by me thereon privately examined and the full contents of the Deed being by me first made known unto her, did thereupon declare and say that she did voluntarily and of her own free will and accord sign seal and as her act and deed deliver the above written Indenture Deed or conveyance without any coercion or compulsion of her said husband. Cumberland Co PA Wills M-241, dated 1 Dec 1846, proved 10 Mar 1853:
In the Name of God Amen. I Daniel Doner of West Pennsborough Township Cumberland County make publish and declare the following as and for my last Will and Testament. I give and bequeath to my beloved wife Elizabeth if she should survive me out of my personal property such articles as she may need for housekeeping to be used by her as se may think proper to the value of fifty dollars at the appraised prices of the same. I also give and devise to her the use and occupation of the house built last summer or the Mansion farm with the appurtenances, except that the wash house belonging to the same shall be used and occupied in common with my son and family, to have and to hold the same during her natural life or widowhood. I also give and bequeath to my said wife during her natural life or widowhood the interest on the sum of two thousand dollars, viz, one hundred and twenty dollars to be paid her every six months after my decease to wit, in installments of sixty dollars each by my son Henry out of my Mansion farm which is hereby charged with the said payments during her natural life or so long as she remains my widow, but if she shall marry again, then the said annually as well as the use and occupation of the house above mentioned shall ceased and be terminated and she shall be entitled to receive from executors out of my estate in lieu thereof the sum of one hundred dollars in addition to what interest may be due to her or may have been paid to her at the time the said event shall take place, which shall be in full of all her claims against my estate. To my sons Abraham, John, and Jacob I have already made advancements to the amount of two thousand dollars each out of the price of the farms I have heretofore sold and conveyed to them, and have charged them with the same in my family book in common with the charges made in the said book against my other children as advancements, the said entries up to the 15th of April 1844 being copied in the said book in the handwriting of John Harper Esquire at my request and the subsequent entries and any that may be hereafter made, are thereby recognized by me and declared to be correct, and which are to be considered as so much money bequeath to each and every of my children as therein named and set forth. To my son Henry I give and devise my mansion farm agreeably to the lines herebefore established by a survey in 1844 made by John Harper Esq and be the adjoining tracts of my sons Abraham and Jacob Containing one hundred and forty one acres more or less to be held by him his heirs and assigns forever, subject to the estate of my said wife in the house etc as above set forth and also subject to the payment of the said sum of one hundred and twenty dollars in semiannual payments as herebefore stated. And further the said tract so devised being now valued by me at the sum of Eight thousand dollars, two thousand dollars of said valuation is bequeathed to him. The further sum of two thousand is to remain in this house as a fund for the payment of the above mentioned annuity to my said wife. The said two thousand dollars to be paid by my son Henry to my executor hereinafter named after her decease in three annual payment without interest, and the remaining four thousand dollars as to be paid in like manner by him to my said Executors in annual payments after my decease of three hundred dollars each, the odd sum to be added to the last payment all without interest and the said sum of two thousand dollars and of four thousand dollars are hereby charged upon the said Tract of land. To my son David I give and devise my Creek or Piece farm adjoining the Canadaquinet Creek, Alex Hogan, Abraham Doner, and Robert McKecham containing 146a 45p strict measure agreeably to the lines established by a survey made by John Harper Esquire and the deed to my son Abraham, to be held by him his heirs and assigns forever, Subject however to the payment hereinafter mentioned, viz, the said Tract being valued by me at the sum of four thousand five hundred dollars, two thousand dollars thereof to be an advancement to him and the remaining twenty five hundred dollars to be paid by him to my executor hereinafter named in payment of two hundred fifty dollars per annum after my decease without interest. And as to all the rest and residue of my estate I give and dispose of the same in the following manner, viz, all my personal property (except what is kept by my widow) is to be disposed of by my executor and converted into money which together with the bonds due me by my sons John Abraham and Jacob and the moneys to be paid to my Executor by my sons Henry and David out of their lands as aforesaid, and the sum due on the death of the widow or marriage and any other estate are to form one general fund out of which after payment of my debts funeral expenses etc I give and bequeath as follows, To my son Daniel I have advanced to the amount of two thousand dollars which is to be in part of his portion of my estate out of the said general fund. I give and bequeath to my daughter Elizabeth intermarried with John Hale the sum of two thousand dollars. To my daughter Nancy intermarried with Samuel Wegner the sum of two thousand dollars. To my daughter Fanny intermarried with Henry Line two thousand dollars, and to my daughter Maria two thousand dollars, and it is my will and I direct that in making the said payments to my said daughters of their said legacies each one is to be charged by my Executors with the sum with which they shall stand charged respectively in my family book before mentioned as advancements. The said advancements to form a part of the said general funds. And the residue of said funds in any I give and bequeath to all my Children and their heirs, or if they have no children living at the time of their death in such case to the survivors to be divided equally among all my said Children. It is further my will that all the legacies and bequests by me made to my said children are to be considered in full of all sums they or any of them may have rendered me by Cabow(?) after they may have arrived at the age of twenty one years, and if any such claim shall be set up and persisted in, the one so doing shall thereby forfeit all shares in my estate. Lastly I hereby nominate and appoint my sons John and David to be the Executors of this my last Will and Testament, hereby revoking all former wills heretofore made and declaring this and no other to be my last Will and Testament. To the Register of the County of Allegheny in the City of Pittsburgh, State of Pennsylvania, I, A. C. Sponster Register of the County of Cumberland in the State of Pennsylvania send Greetings. Whereas the last Will and Testament of Daniel Doner late of West Pennsborough Township County and State aforesaid did and has been produced and offered before me for probate having the names of John P. Myers and John Reed thereto attached as subscribing witnesses which said will is hereto enclosed and it is suggested to me that John P. Myers one of the subscribing witnesses to the aforesaid will resides in your city, These are therefore to authorize you the said Register of the County aforesaid to procure the said John P Myers to come before you and after he shall have been duly sworn or affirmed as the law directs to answer the interrogatories annexed to this commission respecting the execution of the said Will herewith enclosed as aforesaid. Myers subscribed to that will now exhibited to you in your proper hand writing? 2. Did you subscribe the will as a witness at the request of the Testator and in his presence? 3. Did the Hon John Reed subscribe the will as a witness at the same time? 4. Was the testator Daniel Donar at the time of sound and disposing mind, memory, and understanding to the best of your knowledge judgement and belief? Attest. Spinster Esquire Register for the Probate of Wills granting letters of Administration etc in and for the County of Cumberland in the Commonwealth of Pennsylvania, bearing date the 28th day of February A.D. 1853, Before me A. Richardson the Commissioner named in said Commission at the Registers Office at Pittsburgh, in and for the County of Allegheny on the 3rd day of March A.D. 1853 personally appeared Dr. J. P. Myers the person named as a witness in the above commission and as subscribing witness to the instrument hereto annexed purporting to be the last Will and Testament of Daniel Doner deceased he being duly sworn according to law, depose and say as follows: In the first Interrogatory, deponent says that he is a subscribing witness to the will of Daniel Doner late of West Pennsborough Township Cumberland County Pennsylvania and that the name J. P. Myers is in his own proper hand writing, To the second interrogatory deponent says, that he subscribed the said will at the request or the Testator, and in his presence, To the Third Interrogatory, deponent says that the Hon John Reed did subscribe as a witness to the said Will at the same time to the best of his recollection and belief, To the fourth Interrogatory deponent says that at the time the Testator Daniel Doner was of sound and disposing mind memory and understanding to the best of his knowledge, judgement, and belief. Cumberland County SS. This 10th day of March A.D. 1853 Before me A. C. Sponster Register for the Probate of Wills and granting Letters of Administration in and for said County personally came Hon Fred Watts who being duly sworn according to Law says that he is well acquainted with the handwriting of the Hon John Reed, one of the subscribing witnesses to the within and foregoing instrument of writing purporting to be the Last Will and Testament of Daniel Doner late of West Pennsborough Township deceased and that the name John Reed as therein written is in the proper handwriting of the said deceased witness to the best of his observation knowledge and belief. Be it remembered that on the 10th day of March A.D. 1853 the Last Will and Testament of Daniel Doner late of West Pennsborough township deceased was legally proved and Letters Testamentary issued thereon to John Doner and David Doner the Executors therein named.
