----- Will of Mary Musser, widow, dated 6 Mar 1846, pro 27 Aug 1846:
In the name of God Amen. I Mary Musser widow of East Lampeter township Lancaster County and State of Pennsylvania being weak in body but of sound mind memory and understanding and considering the uncertainty of this transitory life do make and publish this my last will and Testament in manner and form following, First it is my Will and I do hereby order and direct that all my just debt and funeral expenses shall be paid and satisfied by my executor hereinafter named out of my estate as soon as conveniently can be done after my decease. Item I give and bequeath unto my grandson Jacob Hoffhin an illegitimate son of my daughter Nancy five hundred dollars. Item I give and bequeath unto my grand daughter Fanny Musser a daughter and only child of my deceased son Peter Musser Ten dollars. And the residue and remainder of all my estate including the advancements which I have heretofore or shall hereafter in my lifetime make to my Children hereinafter named, or any of them, I give and bequeath the one seventh part thereof to John Musselman of Adams County Pennsylvania in Trust to and for the only proper use purpose and intent that he the said John Musselman shall invest the same in such good and reasonable security as he may be able to obtain and the interest annually accruing therefrom the said Trustee shall appropriate to the maintenance and support of my son Christian Musser and his family during the lifetime of my said son Christian Musser and if he the said Trustee should think it necessary for the support of my said son Christian and family, he the said Trustee may from time to time pay to and for the said Christian and his family as much of the said account as he the said Trustee may think proper so to do. And if he the said Trustee should die before my said son Christian then and in such case it is my Will that the Orphans Court of the County wherein he my said son Christian shall reside shall if the said Court see fit and proper, appoint a trustee instead of the said John Musselman which new trustee shall have like power as the said John Musselman has to all interests and purposes and at the death of my said son Christian any estate or property of the said bequest in the hands or care of his Trustee shall go the heirs at law of my son Christian. Item the other six sevenths of the said residue of all my estate I give and bequeath unto my daughter Magdalene the wife of John Hershey, my daughter Franny the wife of Benjamin Hershey, my daughter Mary the wife of John Martin, my daughter Nancy the wife of Jacob Cready, my son Henry Musser, and my daughter Elizabeth Musser, and their heirs, share and share alike. Item if my illegitimate grandson the said Jacob Heffhin should die before he arrives at the age of twenty one years, then and in such case I give and bequeath the bequest herebefore given to him or as much thereof as may be in the hands or case of his guardian to the said Trustee of my son Christian in Trust as aforesaid, my said daughter Magdalena, Franny, Mary, Nancy, and Elizabeth, and my son Henry in equal shares or share and share alike to them and their heirs. Item I appoint my son Henry Musser to be the guardian of my said grandson, the said Jacob Heffhin, during his minority. And lastly, I nominate constitute and appoint my said son Henry Musser to be Executor of this my last Will and Testament hereby revoking all former wills legacies and bequests heretofore by me made and declare now this and no other to be my last Will and Testament. In witness thereof I the said Mary Musser have hereunto set my hand and seal the sixth day of March, Anno Domini one thousand eight hundred and forty six (1846). Mary (X) Musser.
Signed, sealed, pronounced and declared by the testator to be her last will and Testament in the presence of us, who in her presence and at her request and in the presence of each other have thereunto subscribed our names as witnesses, and further she the said Testator declaring to us that she cannot write her name and therefore made her mark for her hand and seal, the words "have" "musser" and "son" were interlined before signing and sealing of this will with the knowledge of the testator. On the twenty seventh day of August Anno Domini 1846 Before me the Subscriber personally appeared John Frey and D Groff Jr the subscribing witnesses to the preceding Will and on their solemn affirmations said that they were present and saw and heard Mary Musser the testator therein named sign, seal, publish, pronounce, and declare the same to be her last will and testament and at the doing thereof she was of sound and well disposing mind memory and understanding to the best of their knowledge observation and belief. August 27th 1846, Letters Testamentary granted to Henry Musser, the Executor, he being duly affirmed well and truly to administer the goods and chattels rights and credits of the said Testator according to Law, and also that he will diligently and faithfully regard and well and truly comply with the provisions of the Law relating to Collateral Inheritances.
