In the name of God Amen. I Martin Musser of the township of Lampiter in the
county of Lancaster and State of Pennsylvania, yeoman, being of sound and
disposing mind memory and understanding do make and declare this my last will
and testament in manner following, to wit, I Recommend my soul to God and my
body to the earth to be decently interred as my executors shall direct, in
humble hope of a glorious resurrection and an happy admission into the regions
of immortal bliss and glory, in and through the merits of my mediator and
redeemer Jesus Christ. And as to such worldly estate wheretowith God hath
blessed me, I do give devise and dispose of the same in manner following, to
wit, Imprimis It is my will and I do order and direct that my just debts and
funeral expenses be paid and satisfied as soon as conveniently may be done
after my decease. Item I do give and bequeath unto my beloved wife Mary the
sum of three hundred pounds, in specie, of gold or silver coin, to be paid her
out of my personal estate in one month after my decease and also one horse or
mare, and one milk cow, allowing her the choice among those which I shall die
possessed of. And I do further give and bequeath unto my said wife Mary all my
household stuff and kitchen furniture. And it is my will and I do hereby order
and direct that my said wife Mary shall and may have the use of and liberty
and privilege to live and reside in possess and enjoy this my dwelling house,
wherein we now reside, with the kitchen and cellar belonging to and under the
same dwelling house (which shall be kept up under good and sufficient roof by
the possessor or the plantation whereon I now reside) together with the use
and benefit of the one fourth part of the garden near the said dwelling house,
for an during the term of her natural life. And further It is my will and I do
hereby order and direct that my son in law John Landis who was the husband of
my daughter Elizabeth deceased do and shall find and provide for my said wife
Mary and deliver to her yearly and every year during the term of her natural
life twelve bushels of good clean wheat, five bushels of good clean rye, ten
bushels of good clean Indian corn, eighty pounds of good beef, one good fat
hog, weighing no less than one hundred and fifty pounds, one half bushel of
fine salt, one bushel of coarse salt, ten gallons of good rye whiskey, two
barrels of good cider, and as many apples and as much fruit (if the orchard
and trees on this my plantation product any) as she may want for her own use,
twenty pounds of good heckled hemp, and fifteen pounds of good heckled flax,
with the tow thereof, six pounds of good clean wool, and as many fowls and
eggs as she may want for her own use. And likewise that the said John Landis
shall find, provide and deliver to my said wife at her door good and
sufficient firewood, ready cut and fit for her use during the term aforesaid,
and shall also during the said term keep in good and sufficient fodder hay
pasture and stable one horse or mare and one cow for the benefit of my said
wife, and shall likewise from time to time when and as often as occasion shall
require during the term aforesaid take or carry the grain for my said wife to
such of the neighboring mills as she shall direct to be ground or made into
meal, and bring the meal and offal home to her again without delay. Which said
legacies bequests allowances and privileges to my said wife are and are hereby
declared to be and shall be deemed and taken for and in lieu and in full
satisfaction of and for her dower or thirds at common law, and all claims and
demands whatsoever of in to and out of my estate. Item I do give devise and
bequeath unto my said son in law John Landis and to his heirs and assigns all
this my plantation and tract of land whereon I now reside, situate and being
in the township of Lampiter in the County of Lancaster aforesaid, adjoining
Conestogoe creek and bounded by the several lands of Andrew Groff, Christian
Hartman and my brother Peter Musser, containing one hundred and forty acres,
be the same more or less, Together with the buildings improvements and
appurtenances thereon and thereunto belonging or appertaining, To hold to him
the said John Landis, his heirs and assigns, under and subject to the
privileges and liberties herein before given to my said wife Mary, and to the
provision of the sundry necessaries for my said wife, during the term of her
natural life, to be found provided and delivered by him or them to her in
quantity and quality as herein before mentioned and directed. And I do value
and charge the same premises to the said John Landis at and for the sum of two
thousand and one hundred pounds in specie of gold or silver coin. And as the
said John Landis hath heretofore paid unto me the sum of three hundred and
fifty pounds on account and in part of the said valuation or sum of two
thousand one hundred pounds (the receipt and payment of which said sum of
three hundred and fifty pounds I do hereby acknowledge) I do therefore direct
and appoint the residue or remainder of the said valuation money to wit, the
sum one thousand seven hundred and fifty pounds in specie of gold or silver
coin to be paid by the said John Landis his heirs executors administrators or
assigns by installments in yearly payments of one hundred pounds each, yearly
and every year hereafter until the same be fully paid and discharged. Item As
to all the rest residue and remainder of my estate real and personal not
herein before particularly given or bequeathed (including the said sum of one
thousand and seven hundred and fifty pounds residue of the valuation of my
plantation and tract of land herein before given and devised unto the said
John Landis or so much or such part of the said sum of one thousand seven
hundred and fifty pounds as shall be or remain behind and unpaid to me in my
lifetime and at the time of my decease) I do give devise and bequeath the same
unto my three daughters, to wit, Mary the wife of Joseph Buckwalter, Esther
the wife of Joseph Yordy, and Barbara Musser, share and share alike, that is
to say, one equal third part thereof I do give devise and bequeath unto my
said daughter Mary, her heirs executors administrators and assigns forever,
One other equal third part thereof I do give devise and bequeath unto my said
daughter Esther, her heirs executors administrators and assigns forever, and
the other equal third part thereof I do give devise and bequeath unto my said
daughter Barbara, her heirs executors administrators and assigns forever.
Respect being had to the sums and articles which my said daughters or some of
them have severally had and received from me in my lifetime and to the charges
which I have entered or made against them respectively for the same. And
lastly I do hereby nominate constitute and appoint my son in law Joseph
Buchwalter and my trusty friend Henry Buchwalter, both of the said township of
Lampiter, and the survivor of them executors and executor of this my last will
and testament. Herby revoking all former and other will or wills testament or
testaments by me made and declaring this and none other to be and contain my
last will and testament. In witness whereof I have hereunto set my hand and
seal the eighth day of September in the year of our Lord one thousand eight

his presence and at his request have subscribed our names as witnesses

Lancaster County SS. On the fifth day of December anno domini 1807 Before me
the Subscribe personally appeared John Messencope, William Bausman and Philip
Gloninger, the three subscribing witnesses to the within will, the said John
Messencope upon his corporal oath and the said William Bausman and Philip
Gloninger upon their solemn affirmations according to law did depose declare
and say that they were present and saw and heard Martin Musser the testator
therein named sign seal publish pronounce and declare the within instrument in
writing as and for his last will and testament and that at the doing thereof
he was of sound and well disposing mind, memory and understanding to the best

Be it Remembered that on the fifth day of December anno domini 1807 The last
will and testament of Martin Musser, late of Lampiter township in the County
of Lancaster deceased was proved in due form of law, and letters testamentary
thereon were granted to Joseph Buchwalter one of the executors therein named
(Henry Buchwalter, the other executor therein also named being dead), he
having first been duly qualified well and truly to administer the estate of
the said deceased especially to exhibit a true and perfect inventory thereof
into the Registers Office at Lancaster within one month from this date, and to
render a true and just account of his executorship on said estate in one year
or when thereto lawfully required. Given under the Seal of said Office, G
