This Indenture tripartite made the Eight day of February in the year of our
Lord one Thousand eight Hundred and five, Between Henry Musser of Leacock
Township in the County of Lancaster in the Commonwealth of Pennsylvania yeoman
and Elizabeth his Wife of the one part, Mary Musser the Widow of Henry Musser
Junior late of Earl Township in the said County and Commonwealth deceased
yeoman and Son of the said Henry Musser party hereto, of the second part,
Christian Hess of Salisbury Township in the County and Commonwealth aforesaid
yeoman of the third part, Whereas the Honorable Proprietaries of the late
Province by their Patent dated the fourth day of June in the year of our Lord
One Thousand seven hundred and Thirty five did grant unto Thomas Small a
certain Tract of Land situate on a Branch of the Mill Creek in the said County
of Lancaster containing One hundred and fifty eight acres (more or less) with
the usual allowance, and the said Thomas Small and Wife by Deed dated the
Twelfth day of April in the year One thousand seven hundred and forty eight
and recorded at Lancaster in Book Z Page 436 &c did grant and convey the said
Tract of Land to Peter Sumny, And the said Peter Sumny and Wife by Deed dated
December Twenty sixth One Thousand seven hundred and Forty eight did grant and
convey the said Tract of Land to Peter Baker, which Deed is recorded at
Lancaster in Book BB Page 559 &c, and the said Peter Baker by Deed dated the
Twenty eighth day of October One thousand seven hundred and Sixty five and
Recorded at Lancaster in Book X Page 357 &c did grant and convey the said
Tract of Land to his son Peter Baker, And the said Peter Baker the Son and his
wife by Deed dated the Eighth day of May One Thousand seven hundred and Eighty
four and recorded at Lancaster in Book Z page 201 &c did grant and convey the
said Tract of Land to George Hildebrand, when on the same Day reconveyed Eight
acres part thereof by Deed recorded at Lancaster in Book CC to the said Peter
Baker the Son who by Deed dated March the Twenty fourth One Thousand seven
hundred and Eighty five and recorded at Lancaster in Book DD Page 25 &c
conveyed the said Eight Acres to George Eckert, who by Deed dated the Twenty
fifth day of April in the year of our Lord One Thousand seven hundred and
Eighty eight and recorded at Lancaster in Book GG Page 350 &c reconveyed the
said Eight acres to the said George Hildebrand, By virtue of which Premises
the said George Hildebrand was seized in his Demesne as of Fee of and in the
said Tract of One hundred and fifty eight acres and allowance, as by the said
above recited Patent and Deeds may more fully and at large appear, And by
reason of sundry Judgements had and obtained against the said George
Hildebrand in the Court of Common Pleas in and for the County of Lancaster
Christian Carpenter Junior Esquire High Sheriff of the said County of
Lancaster by Deed Poll under his Hand and Seal dated May the Thirteenth One
Thousand eight hundred for the Consideration therein mentioned did by Virtue
of a certain Writ of Vendioni Exponas therein recited grant and confirm unto
John Musser his Heirs and Assigns, all that the said Tract of one hundred and
fifty eight Acres and allowance and the Appurtenances, To hold the same to the
said John Musser his Heirs and assigns for ever recording to the Act of
General Assembly in such Case made and provided, As by the said recited Deed
Poll duly Acknowledged and entered among the records of the Court of Common
Pleas of the said County and also recorded at Lancaster in Book I vol 3 page
466 &c fully appears, And the said John Musser and his Wife by Deed dated the
Nineteenth day of September in the year One Thousand Eight hundred and
recorded at Lancaster in Book J vol 3 Page 469 &c did grant and convey the
said Tract of Land Containing One hundred and fifty eight acres and allowance
with the appurtenances to the said Henry Musser (Party hereto) in fee, Now
This Indenture witnesseth that the said Henry Musser and Elizabeth his wife as
well in Consideration of the Sum of Eleven hundred and thirty two Pounds
twelve Shillings and five pence lawful Money of Pennsylvania to the said Henry
Musser by his son Henry Musser deceased in his Lifetime well and truly paid,
the Receipt whereof is hereby acknowledged as for and in consideration of love
and affection for his Grand Daughter Elizabeth Musser the daughter of his said
Son Henry Musser by his wife Mary and for her advancement in Life, and in
Consideration of the Covenants and agreements on the part of the said Mary
Musser party hereto, by these presents covenanted to be done and performed
(and to be done and performed) and of the Annuity or Rent Charge herein
reserved to and for the use of Henry Musser (party Hereto) and to his Wife
Elizabeth during their lives and the life of the Survivor of them, and also
for and in Consideration of the Sum of Five Shillings lawful money of
Pennsylvania to him in hand well and truly paid by Christian Hess (Party
hereto) at the ensealing and delivery of these Premises (the Receipt whereof
is hereby acknowledged) and him the said Christian Hess thereof forever
discharged and acquitted, They the said Henry Musser and Elizabeth his Wife
Have and by these presents the said Henry Musser and Elizabeth his Wife Do
grant bargain and sell assign release transfer and set over unto the said
Christian Hess all that the above described Tract of Land containing One
hundred and fifty eight acres with the Appurtenances (be the same more or
less) with the usual allowance and on which the said Henry Musser the Son
lived at the time of his decease, situate lying and being in Earl Township in
the County of Lancaster Joining John Musser, Adam Miller and others, Together
with all and singular the Rights Liberties Privileges and Hereditaments to the
same belonging or in anywise appertaining and all the Estate Right Title
Interest Possession Property Claim and Demand whatsoever at Law or in Equity
of them the said Henry Musser and Elizabeth his Wife of in or to the same or
any Part thereof that is to say for such Estate and Interest of and in the
same as the said Henry Musser was or is entitled to by virtue of the Sheriffs
Deed aforesaid and for no other, and Subject also to the reservations and
Conditions herein after mentioned and contained, To have and to hold the said
described Tract of Land and Premises with all and singular the appurtenances
and Hereditaments to the same belonging to him the said Christian Hess his
Heirs and Assigns for ever To and for the uses Trust and Purposes and subject
to the Conditions Limitations Reservations Restrictions and Covenants herein
contained and set forth and no other, That is to say for the use and in trust
to permit the said Mary Musser to have and enjoy her Dower or Thirds therein
in the same manner as if the said Henry Musser Junr had died Intestate seized
in Fee Simple of and in the said Tract of Land and Premises with like Powers
and Remedies for Partition or appraisement thereof as by Law is provided in
case of Intestate Estates and in Trust to take and receive the Rents Issues
and Profits of the Remainder thereof for the Support Maintenance Education and
Advancement of the said Elizabeth Musser the Grand Daughter during her
Minority and until she shall attain the age of Twenty one years, And as soon
as the said Elizabeth shall attain the age of Twenty one years, then to and
for the use of the said Elizabeth her Heirs and Assigns forever, Subject
nevertheless to the Dower aforesaid, and the annuity or Rent Charge herein
after mentioned and reserved, and also the Trust and for the Uses and Purposes
following, that is to Say, if the said Elizabeth the Grand Daughter should die
under the Age of Twenty one years without leaving lawful Issue at the Time of
her Death, then to and for the use of the said Henry Musser (Party hereto) his
Heirs and Assigns for ever, This Special Trust being Created to prevent any
Incumbrance by the Curtesy Right of any Husband of the said Elizabeth Musser
in Case of her dying under the Age of Twenty one years and not leaving lawful
Issue at the time of her Death, and also upon this further Trust, that if the
said Elizabeth should happen to die under the age of Twenty One years but
leave lawful Issue, then to and for the use of such lawful Issue their Heirs
and Assigns forever, But if no Issue of the said Elizabeth shall be living at
the death of the said Elizabeth, then to and for the use of the said Henry
Musser (Party Hereto) his Heirs and Assigns forever, Reserving nevertheless
out of the said hereby granted Premises and it is hereby expressly covenanted
granted and agreed by and between the Parties to these presents for themselves
their Heirs Executors Administrators and Assigns that the Annual or yearly
Rent charge of Thirty Pounds lawful Money of Pennsylvania shall be and the
same is hereby reserved and charged in and upon the hereby granted Premises of
one hundred and fifty eight Acres and the Appurtenances payable and to be paid
yearly and every year on the first day of April in each and every year to the
said Henry Musser and Elizabeth his Wife and their assigns or to the Survivor
of them for and during the Term of the Natural lives of the said Henry Musser
and Elizabeth his Wife and the life of the Survivor of them, And if it shall
happen that the said Annuity or yearly Rent charge of Thirty Pounds or any
part thereof shall be behind and unpaid in part in the whole by the Space of
Thirty Days next after either of the Days of Payment whereon the same should
or of right ought to be paid as aforesaid, Then and so often and at all Times
thereafter it shall and may be lawful to and for the said Henry Musser and
Elizabeth his Wife or the Survivor of them or their Executors Administrators
Assigns into the above Premises or any Part thereof to Enter and Distrain for
the said Annuity or Rent Charge and the Distress and Distresses then and there
found and taken to take lead drive carry Away and impound and the same
impounded to detain and keep at the proper risk and charge of the said
Christian Hess his Heirs and Assigns for the Space of five Days; and if within
the same Space of five Days Payment and Satisfaction of the said Annuity or
yearly Rent Charge be not made, then at any Time thereafter the same Distress
and Distresses to Expose and sell by Public Auction or Vendue for the best
price that may be gotten, And after the said Annuity or yearly Rent charge and
the Arrearages thereof be fully paid and Satisfied together with the Costs and
Charges thereabout the overplus, if any, to return to the said Christian Hess
his Executors Administrators or Assigns, And the said Christian Hess for
himself his Heirs Executors and Administrators doth Covenant Promise grant and
agree to and with the said Henry Musser his Heirs Executors Administrators and
Assigns by these presents that the said Christian Hess his heirs and Assigns
shall and will well and truly Pay or cause to be paid unto the said Henry
Musser and Elizabeth his Wife and the Survivor of them or Assigns the said
Annuity or yearly Rent Charge of Forty Pounds above mentioned in and upon the
Days and Times above mentioned in manner and form above expressed according to
the true Intent and Meaning of these Presents, and the said Mary Musser (Party
hereto) for herself her Heirs Executors Administrators and assigns doth hereby
covenant Grant and agree to and with the said Henry Musser (Party hereto) his
Heirs and assigns that if the said Elizabeth Musser the Grand Daughter shall
happen to die under the age of Twenty one years and leave no Issue living at
her Death during the lifetime of the said Mary Musser whereby the Remainder in
fee Simple hereby limited to the said Henry Musser his Heirs and Assigns shall
take Effect in Possession indefeasibly, that then she the said Mary Musser
shall and will upon request or Demand of the said Henry Musser his Heirs or
Assigns upon Payment or Tender by him or them to the said Mary of the sum of
six hundred Pounds lawful Money of Pennsylvania yield give up release
relinquish and set over to the said Henry Musser his Heirs or Assigns all the
Dower or Thirds and right and Possession of her the said Mary and all her
Claim or Demands either at Law or in equity of in and to the said Premises or
any Part thereof, So that the Henry Musser his Heirs and Assigns shall and may
have hold possess occupy and enjoy the whole of the said Premises without any
Molestation or Hindrance from or by the said Mary or any other Person claiming
by from or under her or by any of her Means; and also that the said Mary shall
not commit any Waste in the Premises and that she shall not and will not nor
shall any Person for her or on her Behalf use any Process at Law or other
Means whatsoever to obtain Partition or Sever her Interest in the Premises
until her Daughter Elizabeth shall attain the age of Twenty one years. In
testimony whereof the said Parties to these Presents have hereunto
interchangeably set their Hands and Seals the Day and year first above

Received on the day of the date of the above written Indenture the sum of
five shillings lawful Money of Pennsylvania in full from the above named
Christian Hess of the money consideration mentioned in the said Indenture.

desired that the same might be recorded as such according to law, She the said
Elizabeth being of full age and by me examined as the law directs, She
voluntarily consented thereto. In testimony whereof I have hereunto set my

This Indenture made the eight day of February in the year of our Lord one
thousand eight hundred and five, Between Henry Musser of Leacock Township
Lancaster County and State of Pennsylvania yeoman and Elizabeth his wife of
the one part and their son Jacob Musser of the said Township of Leacock in the
county and state aforesaid yeoman of the other part, Whereas in and by a
certain deed or instrument of writing bearing date the ninth day of June in
the year of our Lord one thousand seven hundred and fifty three between Edward
Brinton and Mary Brinton of the one part and Joseph Musser of the other part,
after reciting as therein is recited, the said Edward Brinton and Mary Brinton
did for the consideration therein mentioned grant and confirm unto the said
Joseph Musser his heirs and assigns forever a certain tract or parcel of land
situate in Leacock Township aforesaid, Beginning at a post being a corner of
land late of James Brinton thence by the same land north one hundred and
ninety nine perches to a post thence by now or late Moses Brintons land east
forty perches to a post, south eighteen perches to a post, east one hundred
and sixty one perches to a post, thence south one hundred and eighty one
perches to a post, thence west by Vacant land two hundred and one perches to
the place of beginning, Containing by estimation two hundred and fifty acres
(be the same more or less) above described, the same being entered in the
Office for Recording of Deeds for the County of Lancaster in Book D Page 548
&c the fifteenth day of March one thousand seven hundred and sixty relation
thereunto being had may more fully and at large appears, And Whereas the said
Joseph Musser and Feronica his wife by their certain indenture bearing date
the tenth day of March in the year of our Lord one thousand seven hundred and
sixty for the consideration therein mentioned did grant release and confirm
unto the said Henry Musser (first party to these presents) his heirs and
assigns a part of the said above described tract such part containing one
hundred and twenty five acres (be the same more or less) with the
appurtenances, To hold the same unto him the said Henry Musser his heirs and
assigns forever, in fee, as in and by the said recited indenture recorded in
the office for Recording of Deeds in and for the County of Lancaster in Record
Book FF Page 513 &c relation being thereunto had may more fully appear, Now
this Indenture Witnesseth that the said Henry Musser and Elizabeth his wife
for and in consideration of the natural love and affection which they have and
bear unto their son the said Jacob Musser and for the furtherance of him the
said Jacob Musser in life, and also for and in consideration of the sum of
nine hundred and fifty pounds two shillings lawful money of Pennsylvania to
the said Henry Musser well and truly in hand paid by the said Jacob Musser at
and before the ensealing and delivery of these presents (the receipt and
payment whereof is hereby acknowledged) have and each of them hath granted
bargained sold aliened enfeoffed released and confirmed and by these presents
do and each of them doth grant bargain sell alien release enfeoff and confirm
unto the said Jacob Musser his heirs and assigns, all that certain tract of
piece of land situate in Leacock Township aforesaid bounded and described by
the lines as follows, viz, Beginning at a post thence west one hundred and two
perches to a post a corner of land late of Henry Resh thence by the same north
one hundred and eighty one perches to a post in now or late Moses Brintons
line thence by said line east one hundred and two perches to a post thence
south one hundred and eighty one perches to the place of beginning, Containing
by estimation one hundred and twenty five acres (be the same more or less) (It
being the same tract of land and premises which Joseph Musser and Fernonica
his wife granted and conveyed unto the said Henry Musser (first party hereto)
his heirs and assigns forever as above is recited) Together with all and
singular the houses outhouses edifices and building thereon erected and built,
and all ways woods underwoods waters watercourses meadows orchards gardens
profits commodities advantages emoluments hereditaments and appurtenances
whatsoever to the same belonging or in any wise appertaining and the
reversions and remainders rents issues and profits thereof, And also all the
estate right title interest use trust property possession claim and demand
whatsoever of him the said Henry Musser and Elizabeth his wife of in and to
the same or every or any part thereof, and also all other true copies of deeds
evidences and writings touching or concerning the same or any part thereof and
now in the custody and possession of him the said Henry Musser or which he can
or may come by without suit at law or equity, To have and to hold the said
tract or piece of land above described containing one hundred and twenty five
acres (be the same more or less) hereditaments and premises hereby granted
with the appurtenances unto the said Jacob Musser his heirs and assigns To the
only proper use benefit and behoof of the said Jacob Musser his heirs and
assigns for ever, Under and subject to a certain bond of performance bearing
date even with these presents wherein the said Jacob Musser his heirs
executors administrators or assigns are bound to yield perform furnish and
provide unto the said Henry Musser and Elizabeth his wife certain Articles
privileges and allowances in said bond mentioned for and towards their support
in life yearly and every year during the natural lives of the said Henry
Musser and Elizabeth his wife or the longest liver of them as by said Bond may
appear, And the said Henry Musser and Elizabeth his wife their heirs executors
and administrators do covenant promise and grant to and with the said Jacob
Musser his heirs and assigns that he the said Henry Musser his heirs and all
and every other person and persons his or their heirs any thing having or
claiming in the said premises above granted or meant mentioned or intended so
to be or any part thereof by from or under him them or any or either of them
shall and will from time to time and at all times hereafter upon the
reasonable request and at the proper costs and charges of him the said Jacob
Musser his heirs and assigns make do and execute or cause and procure to be
made done and executed all and every such further and other lawful and
reasonable act and acts thing and things conveyances and assurances in the law
whatsoever for the further better more sure and perfect granting conveying and
assuring of all and singular the said premises with the appurtenances unto the
said Jacob Musser his heirs and assigns for ever (except as before subjected
and reserved) as by the said Jacob Musser his heirs and assigns his or their
Counsel learned in the law shall be reasonably advised devised or required,
And the said Henry Musser and Elizabeth his wife their heirs the said tract or
piece of land above described Containing one hundred and twenty five acres (be
the same more or less) and premises (except as before subjected and reserved)
unto the said Jacob Musser his heirs and assigns against him the said Henry
Musser and Elizabeth his wife and their heirs and against all and every other
person or persons whatsoever lawfully claiming said premises or any part
thereof by from or under him her them or any or either of them shall and will

In the Name of God Amen. I Henry Musser of Leacock township Lancaster county
and state of Pennsylvania yeoman being old and weak in body but of sound mind
memory and understand blessed be god for the same do make and Publish this my
last will and Testament in manner and form Following to wit, principally and
first of all I recommend my Immortal soul into the hands of God who gave it
and my body To the earth to be buried in a decent and Christian like manner at
the discretion of my executors herein after named and as to such worldly
Estate where with it hath pleased God TO bless me with in this life I give and
dispose of the same in manner and form following, to wit. Item it is my will
and I do order and direct that all my just Debts and funeral charges Shall be
paid by my Executors out of my estate as soon as conveniently can be done
after my decease. Item whereas I have Advanced my son John Musser and my son
Jacob Musser each With a Plantation or tract of land by deeds duly executed
bearing Date the 8th of February one thousand eight hundred and Five Subject
to Certain bonds of performance of the same Date with the said deeds wherein
they my said two sons are severally bound to deliver unto me and my wife
Elizabeth during our Natural lives or the Longest liver of us yearly and every
year with Certain sums of money and articles of Maintenance in the said Bonds
mentioned and set forth as by said bonds may Appear and also I have advanced
my deceased son Henrys child and widow with a certain Plantation or tract of
land whereon my said deceased son Henry lived by deed in Trust bearing date
the said 8th day of February instant part Subject to eh payment of the Sum of
thirty pounds lawful Money of Pennsylvania unto me and my Wife Elizabeth
yearly and every Year during our Natural or the longest lives of us and also
further on Conditions and with this Special Proviso and Reserve that if my
said deceased son Henrys only child or daughter Elizabeth Should happen to
died under age and Without lawful Issue then and in that case the fee simple
Estate of and in the said plantation and premises should revert and fall back
to me and my heirs and assigns for ever with this further proviso that I or my
heirs or assigns should and must in that case pay unto the widow of my said
deceased son Henry the sum of six hundred pounds lawful money of Pennsylvania
in and by the said deed in Trust duly Executed and acknowledged and Recorded
in the office for Recording of deeds at Lancaster for the County of Lancaster
may appear. Item I do give and Bequeath unto my Beloved wife Elizabeth all and
Singular the Rights privileges allowances Sum and sums of money due to be
given paid and allowed unto her out of The Real Estate herein before mentioned
by virtue of several bonds of Performance and by Virtue of the deed in Trust
herein before particularly mentioned and Recited according to the true intent
and meaning of the said several bonds and Deed in trust may appear and Further
I do hereby give and bequeath unto my said beloved wife Elizabeth During the
term of her Natural life all the Residue and Remainder of my moveable Estate
after my Just debts and Funeral Charges are first Paid thereout with privilege
to use and Dispose of the same as her necessary wants or occations shall
Require in order to make her comfortable and happy in Life and After the
decease of my said beloved wife Elizabeth I order and Direct that the Residue
and Remainder of my moveable Estate Which my said wife shall leave behind her
at her decease I order The same then to be Equally divided to and between my
two sons John and Jacob Musser their heirs and assigns for ever Share and
share alike to whom I do hereby give and bequeath the same. Item if my grand
Daughter Elizabeth Musser only child of my deceased son Henry Musser should
die under age and without lawful Issue then and in that case I give and Devise
the Real Estate which I and my wife Elizabeth by deed in trust of the 8th of
February instant past did grant and Convey unto Christian Hess in trust and
for the use of my said deceased son henrys child and Widow as by said deed
before Recited may appear, unto my two sons John and Jacob Musser their heirs
and assigns TO hold the same Real Estate in case Aforesaid unto my said Two
Sons John and Jacob Musser their heirs and assigns Forever as tenants in
command and not as Joint Tenants Subject To the Payment of the sum of six
hundred pounds lawful money of Pennsylvania unto my deceased son Henrys widow
Mary Musser, As per special covenant in the deed in Trust aforesaid. Item The
Reason why I exclude by deceased son Henrys child from any Further inheritance
in this my last Will and Testament is because I have advanced her Sufficiently
with Real Estate in lieu of her Father my said Son Henry Musser deceased
Shareing in my Estate as by the Deed in Trust herein before Recited may Appear
Therefore I exclude her from any further Claim or Interest of into and out of
my Estate bequeathed in this my last Will and Testament. And Lastly I nominate
Constitute and appoint my two sons John and Jacob Musser to be the executors
of this my last will and Testament hereby revoking all other Wills legacies
and bequests by me heretofore made and declaring this and no other to be my
last will and Testament In whereof I have hereunto set my hand and seal this
twentieth day of February Anno Domini one thousand eight hundred and Five.

Lancaster County SS. On the 23 day of December Anno Domini 1805 before me
the subscriber personally appeared Christian Rush and Christian Carpenter the
two subscribing witnesses to the annexed will who upon their solemn
Affirmations according to Law did declare and Say that they were Present and
saw and heard Henry Musser the testator therein named Sign Seal publish
pronounce and declare the annexed Instrument in writing as and for his last
will and Testament and that at the time of doing thereof he was of sound and
well disposing mind memory and understanding according to the best of their
knowledge observation and belief.
Be it Remembered that on the 23rd day of December Anno Domini 1805 the Last
will and Testament of Henry Musser late of Leacock Township In the County of
Lancaster yeoman Deceased was proved in due form of Law and Letters
Testamentary thereon were granted to John Musser and Jacob Musser the
Executors therein named they having first been Duly affirmed well and truly to
administer the Estate of the Said Deceased especially to Exhibit a true and
perfect Inventory thereof into the Registers Office at Lancaster within one
month and to render a just and true account of their Executorships on said
Estate in one year From this date or when thereto legally required Given under
