Know all men by these presents that Caleb Phipps of the county of Mercer and Mary his wife for and in consideration of sixty five dollars to them in hand paid by James Orr of said County have granted and sold and by these presents do grant bargain and sell unto the said James Orr all their right interest and claim to eighty acres of land part of lot no 837 in the 4 dist donation land in Mercer County which they have by virtue of a treasurers deed from Aaron Hackney dated 25th of November 1820 and by virtue of a treasurers deed from Jonathan Smith to William Stevenson dated June 1830 transferred on the back to F Junkin dated December the 10th 1830 by said Stevenson Beginning at a post the on the west corner of land sold to John Wilkinson by said Junkins thence with by said land 4 degrees west 170 perches to a post thence S 87 deg west 80 perches to a post thence South 4 deg W 170 perches to a post thence N 87 east to the place of beginning, Containing 80 acres strict measure and the said described eighty acres of land the said Caleb Phipps and Mary his wife have hereby quit claim and do hereby transfer all the interest they have unto the said James Orr his heirs and assigns forever. This Indenture made the eleventh day of December in the year of our Lord one thousand eight hundred and thirty four Between James Orr or the County of Mercer and Commonwealth of Pennsylvania of the one part and Matthew Boomer of the same County and State of the other part, Witnesseth, that the said James Orr for and in consideration of the sum of eighty five dollars lawful money of the United States to him in hand paid by the said Matthew Boomer at or before the ensealing or delivery hereof the receipt whereof is hereby acknowledged have granted bargained sold aliened enfeoffed released and confirmed, and by these presents do grant bargain sell alien enfeoff release and confirm unto the said Matthew Boomer his heirs and assigns the following piece or parcel of land to wit, part of a tract of land in the 4th district of donation land and numbered in the general draft of said district "837" Beginning at a post the southwest corner of a part of the same tract which was sold to John Wilkinson by William F Junkin, thence North four degrees west by said land one hundred and seventy perches to a post, thence South eighty seven degrees West eighty perches to a post, thence South four degrees west one hundred and twenty perches to a post and thence North eighty seven degrees east Eighty perches to the place of beginning, Containing eighty acres more or less, It is the same tract of land which was sold by Jonathan Smith Treasurer of Mercer County to William Stevenson by deed dated June 1830 and transferred by said Stevenson to Wm F Junkin dated Dec 10th 1830, and the land herein mentioned was transferred by Wiliam F Junkin to Caleb Phipps and by the said Caleb Phipps and Mary his wife by deed dated the 11th day of February 1835 [sic] to James Orr party hereto, Together with all and singular the buildings improvements woods ways waters water courses rights liberties privileges hereditaments and appurtenances whatsoever thereto belonging or in any wise appertaining, and the reversions and remainders rents issues and profits thereof and also all the estate right the interest property claim and demand whatsoever of him the said James Orr in law or equity or otherwise howsoever or in and to the same, To have and to hold the said described piece or parcel of land as above described hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said Matthew Boomer his heirs and assigns, to and for the only proper use benefit and behoof of him the said Matthew Boomer his heirs and assigns forever, And the said James Orr doth covenant promise and agree to and with the said Matthew Boomer his heirs and assigns by these presents that he the said James Orr and his heirs the said described piece or parcel of land hereby granted with the appurtenances unto the said Matthew Boomer his heirs and assigns against him the said James Orr and his heirs and against all and every other person or persons howsoever lawfully claiming or to claim the same by from or under him or them and no further Shall and will warrant and forever defend by these presents. The Commonwealth of Pennsylvania. To All to whom these presents shall come, greeting. Know ye that in consideration of the sum of one hundred and twenty seven dollars and thirty eight cents in full now paid by James Orr a certain tract of land being lot 515 in the 3rd Donation District Situate in Springfield Township Mercer County Beginning at a post thence by Lot No 514 South three degrees east two sixteen and two tenth perches to a post, thence by land of Denniston's heirs South eighty eight degrees west twop hundred and nine tenths perches to a post, thence by Lot no 531 North one and a half degrees west two hundred twenty perches to a chestnut, thence by lot no 516 North eighty nine degrees east one hundred ninety five and three tenth perches to the Beginning, Containing two hundred fifty four acres one hundred twenty two perches and Allowances etc, Which said Tract was surveyed by virtue and in pursuance of the act of the 26th day of March 1813 on the actual settlement and Improvement of William Orr and whereas the right of the said William Orr in and to said Tract by Virtue of sundry conveyances and other assurances in Law became vested in the said James Orr, To whom a of acceptance issued the 12th day of February 1842 with the appurtenances To Have and to hold the said tract of parcel of land with the appurtenances unto the said James Orr and his heirs to the use of him the said James Orr his heirs and assigns forever, Free and clear of all restrictions and as to Mines Royalties Quit-Rents or otherwise excepting and reserving only one eighth part of all gold and silver ore for the use of the Commonwealth to be delivered at the pit mouth clear of all charges. In witness whereof I J Klingmy Smith Secretary of the Land office of the said Commonwealth hath hereto set his hand and the seal of the land office of Pennsylvania hath been hereunto affixed, the fourteenth day of February in the year of our Lord one thousand eight hundred and forty two and of the Commonwealth the sixty sixth. This Indenture Made and concluded by Deed Between James Orr and Elizabeth his wife of the State of Ohio of the first part and William Orr of the second part Ralph Hunter of the third part and Ishmail Grives of the fourth part all of Mercer County Pennsylvania Witnesseth whereas the Commonwealth of Pennsylvania by Patent bearing date February 14th 1842 granted and conveyed to said James Orr a certain tract of undrawn donation land situate in Mercer County Pennsylvania, being Lot number five hundref and fifteen (515) in the 3 District Containing two hundred fifty four acres one hundred and twenty five perches and allowances as by said Patent more fully appears, and said James Orr drew and held said patent in trust for the said second third and fourth parties hereto although said trust was not stated in said patent. Now in consideration of the presents and for the further consideration of one dollar to the said first party in hand paid by the said second third and fourth parties the receipt of which is hereby acknowledged the said first party has granted bargained sold aliened enfeoffed released and confirmed to said second party all the following described piece or parcel of land being part of the tract aforesaid Beginning at a post and Black oak thence South 3 degrees East 58 5/10 perches to a post thence west 94 perches to a post thence south 1 1/2 degrees east 45 perches to a post thence west 164 5/10 perches to a post thence north 1 1/2 degrees west 100 perches to a chestnut thence North 89 degrees East 195 3/10 perches to the place of beginning Containing ninety nine acres twenty six perches strict measure more or less To have and to Hold the same to him the said William Orr his heirs and assigns forever. And have also in like manner granted bargained sold to the third party the two following described piece or parcels of land being part of the larger tract of land joint aforesaid, that is to say beginning at a post the original corner of the Tract running thence North 1 1/2 west 120 perches to a post thence East 104 3/10 perches to a post thence South 1 degree East 47 perches to a post thence South 62 degrees West 15 5/10 perches to a M O thence South 19 degrees East 88 5/10 perches to a post thence South 1 degree East 25 8/10 perches to a post and thence South 88 degrees West 100 8/10 perches to the place of Beginning Containing seventy six acres seventy five perches strict measure be the same more or less. Also that other piece of land part of the larger tract aforesaid Beginning at a post the corner of the tract hereby granted to William Orr running thence West 94 perches to a post thence South 1 1/2 degree East 45 perches to a post thence East 94 5/10 perches to a post and thence North 3 degrees East 40 perches to the place of Beginning Containing twenty six acres eighty six perches Strict Measure be the same more or less. To have and to Hold to him the said Ralph Hiouten the two last pieces aforesaid his heirs and assigns forever. And the said first part in like manner have granted bargained and sold to said fourth party the following described piece of parcel of land part of the larger tract of land first before described that is to say Beginning at a post one of the original corners of the tract running thence South 38 degrees west by land of Dennis Selias 96 4/10 perches to a post thence north 1 degree west 23 9/10 perches to a post thence North 19 degrees west 28 5/10 perches to a M O thence North 62 degrees East 15 7/10 perches to a post thence North 1 degree east 47 perches to a post and thence East 94 5/10 perches to a post and thence North 3 degrees east 112 4/10 perches to the place of beginning Containing sixty eight acres four perches strict measure be the same more or less to have and to hold to him the said Ishmael Grieves his heirs and assigns forever. Together with all and singular the buildings improvements woods way waters and water courses with the reversions remainders rents issues and profits of each of said respective described pieces or parcels of land To have and to Hold the first described piece containing ninety nine acres to him the said William Orr his heirs and assigns forever, and also the two next described pieces containing respectively seventy six acres and twenty six acres to him the said Ralph Hunter his heirs and assigns forever, and also the fourth described piece containing sixty six acres to him the said Ishmail Gieves his heirs and assigns forever as fully and for said estate as was and is vested in the said James Orr by virtue of the Patent aforesaid but without recourse to the said first party.
