---------- Mercer Co PA Deeds 1M-467, dated 17 Jan 1834:
This Indenture made the seventeenth day of January in the year of our Lord one Thousand eight hundred and thirty four Between Thomas Astley of the City of Philadelphia and Sarah H Astley his wife by their attorney Enoch Marvin duly constituted by power of Attorney dated the twelfth day of June A.D. 1815 of the first part, and John M Orr of the County of Mercer in the State of Pennsylvania of the second part, Witnesseth that the said parties of the first part for and in consideration of the sum of one hundred and twenty five dollars lawful money of the United State to them in hand paid by the said John M Orr at or before the ensealing or delivery hereof, the receipt whereof is hereby acknowledged, have granted bargained sold release and confirm unto the said parties of the second part their heirs and assigns all that certain tract or parcel of land situate in Springfield Township in the County of Mercer aforesaid and bounded as follows, Beginning at the South East corner at a Black Oak, thence by lands of twenty four perches to a post, thence north two degrees west one hundred and seventy two perches to a post, thence by land of George Durrister north eighty eight degrees east seventy four perches to a post, thence by the eastern boundary of the larger tract of which this is a part South two degrees East one hundred and seventy two perches to the beginning, Containing seventy five acres and allowances of six percent, being part of a larger tract of four hundred acres surveyed in pursuance of a warrant in the name of William Rediger and dated the 14th April 17892 which said tract was confirmed by the Commonwealth of Pennsylvania to John Field, William Cruinder and James Gibson in trust for the Pennsylvania Population Company by patent dated the sixth day of December 1799 enrolled in Book No 41 page 227 and all the right title and interest of said company hath by sundry conveyances and assurances became fully vested in the said parties of the first part in fee, all which conveyances and assurances are recorded in the said County of Mercer reference thereto being had fully appears, Together with all and singular the buildings improvements woods ways water courses rights liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining, and the reversions and remainders rents issues and profits thereof and also all the estate right title interest property claim and demand whatsoever of them the said parties of the first part in law or equity or otherwise howsoever of in and to the same, To have and to hold the said described tract or parcel of land hereditaments and premises hereby granted or mentioned or intended to so be with the appurtenances unto the said James M Orr his heirs and assigns to and for the only proper use benefit and behoof of him the said James M Orr his heirs and assigns forever, And the said parties of the first part do hereby covenant promise and agree to and with the said John M Orr his heirs and assigns by these presents that they the said parties of the first part and their heirs the said described tract or parcel of land hereby granted with the appurtenances unto the said John M Orr his heirs and assigns against themselves the parties of the first part and their heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same by under or through them or any of them and against all other claims shall and will warrant and forever defend by these presents. In Witness whereof the said parties of the first part by their said Attorney have hereunto set their hands and seals the day and year first above written. Received the day of the date of the above Indenture of and from the above named John M Orr the sum of two hundred and twenty five dollars lawful money of the United States being the consideration money above mentioned in full. Enoch Marvin, Attorney.
Mercer County, SS. Before me the subscriber a Justice of the peace in and for said County personally came the above named Enoch Marvin attorney in fact for the above named Thomas Astley and Sarah his wife, and acknowledged the above indenture to be their act and deed and desired that the same might be recorded as such. Will of John M. Orr (Will Book 9, p. 217) Mercer Co. PA.
Know all men by these presents that I john M. Orr of Mercer County, State of Pennsylvania, being in ill health and of sound mind and memory do make and publish this my last will and testament hereby revoking all former wills by me at any time heretofore made.
1st. My will is that all my just debts and funeral expenses shall be by my Executor hereinafter mentioned be paid out of my personal property , the said personal property to be appraised and sold at public sale by me Executors.
2nd. I will and bequeath to my four daughter, Mary J. Black, Isabella Jordan, Elizabeth Jordan and Margaret Drake the balance of my personal property to be equally divided.
3rd. I will and bequeath to my three sons, William Orr, Hiram Orr and David P. Orr, the sum of one dollar each to be paid one years after my decease.
4th. I will and bequeath, devise and convey to my two sons, James Orr and Joseph S. Orr all my real or landed estate to be equally in value divided between them by my executors.
5th I also will that my son James Orr shall have the use of one half of the homestead barn until he can properly provide for himself elsewhere, also half of the apples in the old orchard until his own where he now lives supply his family use. John M. Orr
Lastly I do nominate and appoint my son William Orr to be the executor of this my last will and testament whereof I the said John M. Orr have to this my last will and testament subscribed my name and affixed my seal, this 10th day of May, one thousand, eight hundred and eighty.
Signed, sealed, published and declared by the said John M. Orr, in the presence ofus who at his request and in his presence and in the presence of each other have subscribed our names as witnesses thereof. Mary Jane Drake and James S. Palmer.
