This Indenture made this twenty ninth day of October in the year of our Lord one thousand eight hundred and thirty four by and between Philip Harsh Sr and Christine his wife of the County of Washington in the State of Pennsylvania of the one part and Philip Harsh Jr of the County of Carroll in the State of Ohio of the other part, Witnesseth that the said Philip Harsh Sr and Christiana his wife for and in consideration of the just sum of One thousand dollars to them in hand paid by the said Philip Harsh Jr the receipt of which they do hereby acknowledge have given granted bargained sold released and conveyed and by these presents give grant bargain sell release convey and confirm unto the said Philip Harsh Jr and his heirs and assigns forever all that tract or parcel of land situate and being in the County of Carroll and State of Ohio being the South East quarter of Section six in Township Fifteen of Range Six containing one hundred and fifty five acres and fifty hundredths (be the same more or less) of the lands directed to be sold at Steubenville, To have and to hold the premises aforesaid with all the privileges and appurtenances thereunto belonging or in any way appertaining unto him the said Philip harsh Jr and his heirs and assigns forever, And the said Philip Harsh Jr and Christine his wife for themselves their heirs executors and administrators covenant and promise to and with the said Philip Harsh Jr his heirs and assigns that they the said Philip Harsh Sr and Christiana his wife will well and truly warrant and forever defend the premises herein and hereby granted unto the said Philip Harsh Jr and his heirs and assign against the lawful claims and demands of all and any person whomsoever. To all persons to whom these presents shall come greeting. Know ye, that Jonathan Grable and Katherine his wife of the County of Summit and State of Ohio for the consideration of Twelve hundred Dollars received to their full satisfaction of Phillip Harsh of Carroll County and State of Ohio do give grant bargain sell and confirm unto him the said Phillip Harsh the following described tract or lot of Land situated in the County of Carroll and State aforesaid and being a part of the North West quarter of Section number six in Township Number Fifteen in Range number six and is Bounded as follows, Beginning at a post Standing on the West line of said quarter section eighty three perches South from the North West corner of said quarter section thence East into said quarter section one hundred and nineteen perches and two tenths of a perch to a post thence North thirty perches to a post, thence Eest forty perches to a post on the East line of said quarter section, thence South with such line ninety nine and two tenth perches to a post being the center post of said section thence south to the south line of said section one hundred and fifty nine perches and one tenth perch to a post at the South west corner of said quarter section, and thence North with the west line of said section sixty nine perches and two tenths of a perch to the Beginning, Containing seventy six acres and forty nine and a half perch be the same more or less, To Have and to hold the above granted and bargained premises with the appurtenances thereof unto him the said Philip Harsh his heirs and assigns forever to his and their own purpose use and behoof and also I the said Jonathan Grable do for myself my heirs executors and administrators covenant with the said Philip Harsh his heirs and assigns that at and until the ensealing of these presents I am well seized of the premises as a good indefasible state in fee simple and have good right to bargain and sell the same in manner and form as is above written, and that the same as free of all incumberances whatsoever and furthermore I the said Jonathan Grable do by these presents bind myself and my heirs forever to warrant defend the above bargained and granted premises to him the said Phillip Harsh his heirs and assigns against all claiming and demands whatsoever and I the said Katherine wife of the said Jonathan Grable do hereby in consideration of the money paid to him the said Jonathan remise release and forever quit claim unto the said Phillip Harsh his heirs and assigns all my right and title of dower in and to the above described premises. The Estate of Philip Harsh, Deceased.
Be it remembered that heretofore, to wit at a Court of Common Pleas began and held at the Court House in Carrollton on Monday the twelfth day of June in the Year of our Lord one thousand eight hundred and forty four in and for said County of Carroll and State of Ohio.
On motion of John Pearce Sayn the last will and testament of Philip Harsh deceased was brought into Court, the two subscribing witnesses to said Will to wit Isaac Atkinson Sr and Daniel McCook who being duly sworn did depose and say that the said Deceased did sign and subscribe said will at the end thereof in the presence of the Witnesses and that the said Witnesses attested and Subscribed said Will in the presence and at the request of the Deceased that the Testator at the time of execution said Will was of sound mind and memory of full age and not under any restraint and at appearing to the Court that the said Will is duly attested executed attested and process as aforesaid the same is admitted to probate, and the and figures as follows, to wit,
In the name of God Amen. I Philip Harsh of the County of Carroll and State of Ohio being advanced in Year and sensible of the uncertainty of life do make and publish this my last Will and Testament. First It is my Will that after my death my body decently interred, and that my just debts and funeral expenses be fully paid. Second, of my Estate remaining at my decease I devise and bequeath to my daughter and her Husband, George Sommers one equal eleventh part deducting therefrom however the sum of sixty dollars whichthey the said George and Barbara have already received. Third I give and bequeath to my daughter Katherine and her husband Matthew Tressel a like equal eleventh part of my Estate so remaining as aforesaid, deducting thereform fifty eight dollars which they have heretofore received. Fourth to my Son William Harsh I give and bequeath a like equal eleventh part of my said Estate, so remaining at my death as aforesaid, deducting from such Eleventh part the sum of eighty dollars and fifty cents which I have already advanced to the said William. Fifth I give and bequeath to my Son Louiss Harsh the West half of the South west quarter of section twenty three of Township Sixteen in Range six the said land being charged nevertheless with certain sums of money particularly described and specified in a certain article of agreement existing between me and the said Lewis in relation to the said premises and hereby authorized empower and require my Executors herein after named to make and execute to the said Lewis and his heirs a deed in fee for said land whenever after my decease the said Lewis Harsh or his heirs Shall fully pay to them the said Executors the several sums of money due upon said Article of agreement. Sixth I devise and bequeath to my son Leonard Harsh one equal eleventh part of my Estate remaining at my decease deducting however from such eleventh part the sum of sixty five Dollars and fifty cents heretofore received by him. Seventh to my son John Harsh I give and bequeath a like equal eleventh part of my Estate, so remaining at my decease as aforesaid, deducting form such eleventh part the sum of one Hundred and fifty dollars and sixty two cents which has already been received by the said John. Eighth to my son Philip Harsh I give and bequeath one equal eleventh part of any Estate aforesaid deducting from such eleventh part one hundred dollars and fifty cents, which he has already received. Ninth, I give and bequeath to my daughter Susanne and her husband Tobias Kentnen a like equal eleventh part of my said Estate so remaining as aforesaid deducting from such eleventh part of my said Estate so remaining as aforesaid deducting from such eleventh part the sum of fifty five dollars which they have already received. Tenth TO my daughter Christina and her husband Michael Hildabrand I give and bequeath a like equal eleventh part deducting from such part seventy four dollars which they have heretofore received. Eleventh I give and bequeath to my son Levi Harsh a like equal part of my Estate (to wit one eleventh thereof) deducting therefrom the sum of Eighty dollars and fifty cents which has already been received by the said Levi. Twelfth To my sons Leonard and Philip aforesaid in trust for my daughter Mary Potorf, I give and bequeath one equal eleventh part of said Estate after deducting from such eleventh part fifty eight dollars already received by said Mary. And I hereby require and direct the said Leonard and Philip so soon after my decease as the said Eleventh part of Estate so bequeathed to the said Mary, or any part thereof, shall come into their hands, they shall load the same at common Interest securing the payment thereof by bond and pay such interest annually to the said Mary and to no other person during her life and after her death the principal sum so loaned as aforesaid shall be paid to the children of said Mary by her first husband, to wit, John Christina, and Jacob Harsh, after the said children shall become of lawful age, or of either of them should die before their mother then such principal sum should be paid to such of such Children or either of them as shall survive their mother the said Mary Pattorf. Thirteenth I give and bequeath to the children of my Son Daniel Harsh of Clinton County Ohio deceased two certain promissory notes, one drawn for the sum of two hundred dollars payable by the said Daniel Harsh deceased, to me Philip Harsh after my decease, with interest payable annually from the date thereof and dated December 13th A.D. 1837, the other note drawn for fifty five Dollars and payable to Leonard Harsh and by said Leonard aforesaid to me, which said Note is dated the 11th of December AD 1837 and executed by the said Daniel Harsh deceased with said notes so given and bequeathed to the children of my said son Daniel deceased shall be taken and considered one equal eleventh part of my said Estate. Fourteenth The several sums herein mentioned and directed to be deducted from the several Eleventh parts as aforesaid shall not be so considered to preclude my claim or claims which I now hold against any of said Begets or devises. Fifteenth It is my Will that the said several sums herein before devised, to be deducted from the said Eleven parts of my Estate shall constitute a common fund, which I devise in ten equal shares as follows, to wit, one tenth part to William Harsh, a like part to Leonard Harsh, a like part to Philip Harsh, a like part to Levi Harsh, a like part to Susanna Knestnick, a like part to Catharine Hildebraid, a like part to Barbara Sammurs, a like part to Catharine Trefiel, and a like part to Mary Pottorff my children as aforesaid or to their heirs the said Tenth part to Mary Pottorf to be held in trust by my said Leonard and Philip for the use of said Mary and her said children as aforesaid [sic, only nine listed here]. And lastly I hereby constitute and appoint my sons Leonard and Philip Harsh Executors of this my last Will and Testament hereby revoking and annulling all former Wills by me made In Testimony whereof I have hereunto set my hand and seal this seventeenth day of January A.D. one thousand eight hundred and thirty nine.
