1733-39: Thomas Sever of Roxbury, MA, and Elizabeth his wife, with Thomas
Webster of Kingston, NH, and Mary his wife, the only daughters and
heirs-at-law of Benjamin Greely, late of Haverhill, deceased, petition for an
accounting of the estate of their grandfather, Andrew Greely, late of
Salisbury, deceased, who dying intestate, left behind him three sons and one
daughter and the applicants, Elizabeth and Mary, the only children of one
other son, the said Benjamin Greely, who died in his said father's lifetime.
He left behind property, his eldest son Philip Greely, since deceased, was
appointed administrator, "that ye sd Intestate in his lifetime fully advanced
by way of settlement in Executing Deeds of Gift to Joseph Greely, Andrew
Greely & ye sd Philip and as to what Estate ye Intestate died Seized &
possessed of there was no Settlemt thereof made in ye Lifetime of ye sd Admr
nor Since his Death wherefore ye sd appt" petitioned for a division. They
state also in a postscript to the petition that "The Agreemt p'tendind to have
ye Sacttion of ye Judge of Probate" was not legal as Elizabeth and Mary were
infants and not represented. The paper was filed in Court 9 Aug 1734.
Haverhill Septr 12 1733: Joseph Greeley aged Eaighty years Testifieth and
Saith That about fourty years Agoe I the deponent with my father Andrew
Greeley was Bound to Somond Wainwright of Havirill for a Certain Sum of Money
which my Brother Benjamin Greele owed him ye sd Wainwright which after my
Brothers Decease the sd Wainwright came upon my father and myselfe for the
payment of the aforsd debt and my father could not pay the debt but was forced
to sell his house which was a doble house and corn mill and about four acres
of land in haverill to the said wainwright for to discharge my Brothers debts.

Ephraim Roberdes of Haverhill being in his seventy fourth year of his age
Deposeth that aboute forty years ago Benjamin Greeley of Haverhill was sued by
Capt Simon Wainwright for a Certain Depts which he owed ye said Wainwright: &
which I the Deponent understood his father Andrew Greeley With his Brother
Joseph became Siretys for: and sometime after the Death of the said Benjamin
Greeley: the sd Capt Wainwright Sued the Said Andrew Greeley and Joseph
Greeley for the Said Debt: and the Said Andrew Greeley was forced to Sell his
Dwelling House and land and Corn mill in haverhill to Capt Wainwright to
Discharge the said Debt, Dated Haverhill Sep 18 1733.
Another deposition to the same effect by William White shows that the sale
took place in 1690-91, while Joseph Peasley of Haverhill, aged eighty-seven
years, deposed to the above facts.
On 23 Jul 1733 the Court cited Andrew Greeley and Joseph Greeley to appear
in Court to answer to the complaint of the children of their brother Benjamin.
"Capt Henry True aged 86 testifyeth and Saith yt Andrew Grele after he came
down from haverhill lived some considerable time at his Son Andrew Greles in
Salisbery and then dyed between 30 and 40 years agoe. Robert Smith of full
age testifyeth to al above" 17 Sep 1733
"The Deposition of Lt Jeremiah Allin aged 75 years and Elizabeth moodey aged
66 - Who testify & say yt about ye year 1692 Andrew Grele and his Wife Came
down from haverhill to their Son philip Greles in Salisbury and lived with him
Some Considerable time all wch time they were unable to do anything and were
very troublesom and chargeable to their son and yt his Wife dyed there," Sworn
17 Sep 1733.
Andrew Greele filed a statement of the support of his mother and father
amounting to 29 pounds 5 shillings, stating that this "maintenance in their
old age was adjusted among ye brethren."
Thomas Webster filed a bond in Court to cover the cost of division, and
losing the case in the lower court appealed it. The decree of the Judge of
Probate was repealed in so far as to allow a division. The case had dragged
for five years and evidently Thomas Sever was afraid that he would not receive
all that he should for he wrote the Judge the following letter:
"Roxbury Sept the 13 1738
To the honnerabell John Appeltom Esqr and Judg of probate may it pleas your
onner I have bin informed that a Considerabell part of my Grandfathers Land
that was given away by deed of gift has not as yet bin meshered and I think
that will not anser the Order which the Governer and Counsell gave out and I
think it would be very propper that those Jentellmen who are the pryzers
should see it done before there be any Settellment made. Nothing more. From
your obedient frend, Thomas Sever."
In the appraisement it was found that there was real estate not given away
by Andrew Greeley amounting to 487 pounds 16s 8d, while the value of the
property given by the deeds of gift was, to Philip 436 pounds 10 s; to Andrew
410 pounds 13s 4d, while Joseph received the Haverhill land valued at 378
pounds.
The division finally made, 6 Feb 1739-40, gave to Philip Greeley's heirs 25
pounds 11s 8d, in real estate so they should have their father's proper double
share, then a portion to the children of Benjamin Greele dec'd and to the
children of Mary, a daughter of Andrew Greely, deceased, etc. [Ref: Holman

Apr 21 1741: sold to son Joseph, for fifty pounds, four acres of upland

Nov 13 1742: with wife Martha, sold Thomas Cottle land in Haverhill, still
