In the name of God, Amen. I James Simmons of the State of Pennsylvania
County of Mercer and Township of Delaware being sick and weak in body but of
sound mind memory and understanding (Praised be God for it) and considering
the certainty of death, and the uncertainty of the time thereof, and to the
end I may be the better prepared to leave this world. Whenever it shall
please God to call me hence, do therefor make and declare this my last will
and testament in manner following, that is to say,
I give and bequeath unto my son James and my daughter Letty and Lucinda Mary
and Eliza one dollar each, to be paid out of my estrate in twelve years from
the date underneath, but my other children being under age, named as follows
Larnia, David, Jeremiah, and Hannah Mahala, for the purpose of keeping these
last four children together and that they may be provided with a home until
they are all of age, if they should live so long. For this purpose I will and
bequeath (after all my lawful debts are paid) unto my beloved wife Hannah
Simmons all my real and personal estate, goods and chattels, for the
maintenance of herself and the children that is under age until they come to
lawful age. But if my wife should marry my real estate shall fall to my sons
David and Jeremiah but if my wife should remain a widow in that case she can
remain on the land until the day of her death at which time it falls to the
last boys mentioned to be divided share and share alike.
In witness whereof I have hereunto set my hand and seal the eighth day of
January 1834. James Simmons.
Signed sealed published and declared by the above James Simmons to be his
last will and testament in the presence of us who at his request and in his
presence have subscribed our names as witnesses thereto. Amos Ball. Alex
Mitchell. Pearson Arnold.
Mercer County SS. This 24th day of March 1834 personally appeared before
me Samuel Holstein Register for the Probate of wills etc for said county Amos
Ball and Pearson Arnold subscribing witnesses to the written instrument of
writing who after being duly sworn according to law did depose and say that
they were present and saw James Simmons sign the within instrument of writing
and heard him acknowledge the same to be his last will and testament and that
at the time of his so doing the said James Simmons was of sound and disposing
mind memory and understanding to the best of their knowledge and belief.
