Will dated 17 Jun 1830, pro 22 Jun 1831, recorded in Fairfield County Will Book 2, page 305, Case #760.
In the name of God, Amen. I, Christian Doner, of the County of Fairfield and State of Ohio, being weak in body, but of sound mind, memory, judgement, and understanding, considering the certainty of death, and the uncertainty of the time thereof, do make and publish this my Last Will and Testament, in manner and form following, that is to say,
First and principally, I commit my soul into the hands of Almighty God, and my Body to the earth, to be decently buried at the discretion of my Executor hereinafter named, and after my debts and funeral charges are paid, I devise and bequeath as follows,
Whereas I and my beloved wife Nancy are now old and inform, and not capable to take care of, and support, ourselves, and our means thereto being limited, it is my wish and desire that my son David shall support and maintain us so long as we shall live in this works, with meat, drink, clothing and lodging sufficient and suitable for our advanced state of life. Therefore,
I give and bequeath unto my said son David all of my personal property that I now possess and the increase thereof.
I further give and devise unto my aforesaid son David, all my real estate, consisting of a tract of land in Clearcreek Township, in the County of Fairfield and State of Ohio, and is known by being a part of the West half of Section 4(?) one T 12 and T 20 containing forty four acres more or less, it being the place whereon I now live, to him the said David and his heirs and assigns in fee simple.
The above devise and bequest is not to include any property money or other affects that I may hereafter inherit by devise and bequest or otherwise.
It is further my will and desire that if my said son David shall neglect or refuse to furnish my said wife Nancy, after my death, with all necessary meat, drink, clothing, lodging, and houseroom, or shall in or any wise abuse, molest, or ill treat her, or suffer the same to be done, then, and in that case my said wife Nancy shall have and make use of so much of my personal property as she may chose during her natural lifetime, and shall more over have the privilege of renting my farm, whereon I now life, and enjoy the rent thereof.
And whereas my worldly possessions are limited and not more than sufficient to support me and my wife Nancy, it is therefore my will and desire that my sons Abraham and John and the heirs of my deceased son Christion and my Daughters Susanna wife of Rudolph Schenk, Anna wife of David Long, and Magdalena shall not have any part of my personal or real estate, that is now in my possession, or the increase thereof more than they have already received.
And lastly I do thereby constitute and appoint my youngest son David Doner Executor of this my last will and Testament, revoking and annulling all former wills by me heretofore made, ratifying and confirming this, and none other, to be my last will and testament.
In witness whereof, I, the said Christian Doner, have thereunto set my hand and seal this 17th day of June one thousand eight hundred and thirty. Christian Doner.
Signed, sealed, published, and declared by Christian Doner the above named testator, as and for his last will and testament, in the presence of us, who at his request, and in his presence, have subscribed our names as witnesses thereto. Samuel Leathor. Abel Morgan, William Isigh.
The State of Ohio, Fairfield County SS. At a court of common please holden at Lancaster in and for said County on the 22nd day of June 1831 the last will and testament is produced in court and Michael Righ and Saml Leather the subscribing witnesses thereto being first duly sworn saith that they saw the decedant sign and heard him acknowledge the said will to be his last will and Testament, that he was at the time of sound mind and memory to the best of their opinion (at the by sickness) that they signed their names as witnesses thereto in the presence of the testator, on which it is ordered to be recorded the executor therein named having been duly qualified as such. Signed Hugh Bayles, Clerk. [Ref: FairfieldCoOH Will 2-305]
