This Indenture made the Fifth day of the Second month in the year of our Lord one thousand seven hundred and ninety eight Between Abraham Downer of Lampeter Township in Lancaster County State of Pennsylvania Yeoman and Ann his wife, Martin Myer of Manheim Township in the County Aforesaid yeoman and Ann his wife, Christian Myer of Warwick Township in the County Aforesaid yeoman and Elizabeth his wife, Christian Downer of Lampeter Township in the County Aforesaid Yeoman and Ann his wife, Abraham Eby of Lampiter Township in the County Aforesaid Yeoman and Esther his wife, John Downer of Lampiter township in the county aforesaid yeoman, David Downer by his Guardian Abraham Downer of Lampiter Township in the County Aforesaid, yeoman, Daniel Downer by his Guardian Peter Eby of Warwick Township in the County Aforesaid, yeoman, all of the one part and Henry Downer of Lampiter Township in the County Aforesaid yeoman of the other part, Whereas Abraham Downer the Elder by Virtue of Sundry Deeds of Conveyance had and Executed became seised of and in a Certain Tract of Land situate in Lampeter Township aforesaid Containing Two hundred Acres and the usual alllowance of six acres p ct, part of a Tract of five hundred acres granted by William Penn Esquire unto Tobias Collet, Daniel Quaree, Henry Golding and the heirs of Michael Russell by Patent of the 25th of 6 Mo 1713 but as some of the Grantors through whose hands the aforesaid two hundred acres of lands did pass were Aliens and born out of the Allegiance of the King of Great Britain whereby it became necessary for the said Abraham Downer to Apply for and have a Patent of Confirmation which he Obtained under the great seal of the Province of Pennsylvania bearing date the first day of July A.D. 1763 in which the aforesaid Two hundred acres and Allowance of Land with the Appurtenances are Released and Confirmed unto him the said Abraham Downer in Fee as in and by the same Patent Recorded in the Rolls office in and for the City and County of Philadelphia in Patent Book AA Vol 4 pages 395 etc may at large appear, And Whereas Abraham Buckwalter and Mary his wife in and by their Indenture of Bargain and Sale of the 28th of October 1783 did for the Consideration therein mentioned grant Release and confirm unto the said Abraham Downer in fee a certain tract of land by meets and bounds thereof said to contain one hundred and forty acres situate Contiguous to and adjoining the aforesaid Tract of two hundred Acres and Allowances as by the same Indenture now Produced and intended to be Recorded doth appear, And the said Abraham Downer being so seized died leaving to Survive him a widow six sons and three daughters having first made and published his last Will and Testament in writing wherein he Bequeaths his Real and Personal Estate to his Nine Children to wit Abraham, Ann who intermarried with Martin Myer, Elizabeth who intermarried with Christian Myer, Christina, Esther who intermarried Abraham Eby, John, Henry, David, and Daniel, to the four Eldest Sons he devised his lands, And therein Nominates and Appoints his Friends Jacob Landis and Henry Landis whole and sole Executors of his said last will and testament and therein also directs and empowers them to divide his Lands to and between his sons as aforesaid and make deeds to each of them of equal validity as he might or could have done, Notwithstanding the said Executors delayed the Execution of that part of the Will, Probably because the sons were not all arrived to their respective ages before which period they were both Summoned of the Stage of Action whereby the said division and Confirmation by Title Deed Remains yet to be done, which said divisions since their decease has been made by the divisees and the Guardians of minor Children with the Advice and Assistance of their Friends, And it is Considered that Release from the Several Legatees respectively to each other of those that Hold Lands by Virtue of said will from these that receive their Legacies in Cash may be a safe and Legal mode of Procedure to Answer the Spirit and intention of the Testator and Confirm the Titles to the sons to whom the Lands were Literally devised as he Valued each child's Lands at a certain sum per Acre in order to equal his Children as Appears upon face of said Will which has been duly Approved and Remains in the Registers Office in and for the County of Lancaster as of Record, Now this Indenture Witnesseth that they the said Abraham Downer and Ann his wife, Christian Myer and Elizabeth his wife, Martin Myer and Ann his wife, Christian Downer, Abraham Eby and Esther his wife, John Downer, Abraham Downer and Peter Eby for and in Consideration of the sum of one thousand one hundred and sixty six pounds Eighteen shillings and nine pence in gold and silver coin Current money in said commonwealth to them in hand paid by the said Henry Downer at and before the Sealing and delivery of these presents the receipt and payment whereof are hereby doth acknowledged Have and each of them hath Granted Bargained sold, Aliened Enfeoffed Released Quit Claimed and Confirmed and by these presents Do and each of them Doth grant Bargain sell release Alien Enfeoff Quit Claim and Confirm unto him the said Henry Downer and his heirs All that the following described Tract and Parcel of Land situate in the township of Lampiter and County Aforesaid, Beginning at a post in a line of Abraham Buckwalter's Land and being a corner of John Downers allotment, thence by the same south seventy Two degrees West thirty seven perches to a post, and south nine degrees and a half east thirty two perches and a half to a post and south seventy seven degrees west seventy perches to a post and south ten degrees and three quarters east twenty eight perches and a half to a post and south eighty three degrees west seventeen perches to a post and south eight degrees east seventy seven perches and a half to a stone by mill creek thence by lands of Christian Downer south thirty degrees east seventeen perches to a white oak and north seventy three degrees and a half east fourteen perches to a white oak and south eighty seven degrees and three quarters east one hundred and fifteen perches to a post corner of Abraham Downers land thence by the same north seventy three degrees and a half east fourteen perches and three quarters of a perch to a post in a line of lands of Abraham Buckwalter thence by the same north sixteen degrees and a half west one hundred and forty eight perches to the place of beginning, containing one hundred and nineteen acres and twenty perches of land it being part of the above mentioned larger tract of two hundred acres and allowances together with all and singular the houses, outhouses, edifices and buildings thereon erected and being woods ways waters hedges ditches trees fences gardens orchards meadows easements and appurtenances whatsoever thereto belonging or in anywise appertaining and the reversions remainders rents issues and profits thereof and all the estate right title interest use trust property claim and demand whatsoever of them the said Abraham Downer and Ann his wife Martin Myer and Ann his wife Christian Myer and Elizabeth his wife Christian Downer and Ann his wife Abraham Eby and Esther his wife John Downer Abraham Downer and Peter Eby of in to or out of the same and every part thereof, To have and to hold the above mentioned and described tract of land and premises with the appurtenances unto him the said Henry Downer his heirs and assigns to the only proper use benefit and behoof of him the said Henry Downer his heirs and assigns forever so that they the said Abraham Downer nor Ann his wife Martin Myer nor Ann his wife Christian Myer nor Elizabeth his wife Christian Downer nor Ann his wife Abraham Eby nor Esther his wife John Downer Abraham Downer nor Peter Eby nor their heirs nor any other person or persons for them or any of them or in their names or in the name right or stead of any of them shall or will by any ways or means hereafter claim challenge or demand any estate right title or interest of in or to the said premises or any part or parcel thereof but from all and every action right estate interest or demand of in or to the said premises or any part thereof they and every of them shall be utterly excluded and barred forever by these presents, And that they the said Abraham Downer and Ann his wife Martin Myer and Ann his wife Christian Myer and Elizabeth his wife Christian Downer and Ann his wife Abraham Eby and Esther his wife John Downer Abraham Downer and Peter Eby and their heirs any thing having or claiming in the said premises above mentioned or any part thereof by from or under them or any or either of them shall and will from time to time and at all times hereafter upon the reasonable request and at the proper costs and charges of the said Henry Downer his heirs and assigns make do and execute or cause to be made done and executed all and every such further and other lawful and reasonable act and acts thing and things devices and assurances in the law for the further better and more perfect granting conveying and assuring of the said premises above mentioned with the appurtenances unto the said Henry Downer his heirs and assigns in fee as by the said Henry Downer his heirs and assigns or his or their counsel learned in the law be devised advised or required. In witness whereof the parties have hereto interchangeably set their hands and seals and dated the day and year first above written. Personally came before me the subscriber one of the justices of the peace in and for said County Abraham Downer and Ann his wife Martin Myer and Ann his wife Christian Myer and Elizabeth his wife Christian Downer and Ann his wife Abraham Eby and Esther his wife John Downer Christian Downer and Ann his wife Abraham Downer and Peter Eby and severally acknowledged the within indenture of release to be their act and deed to the intent the same may be admitted upon record as such, their several wives having severally arrived to their respective age and the contents made known to them voluntarily thereto did consent in testimony whereof I have hereunto set my hand and seal the twenty eight day of March 1798. Washington County October 8th 1798 came Christian Myer and Elizabeth Myer before us two of the justices of the peace for said County and acknowledged the within instrument of writing to be their acts and deed and the within mentioned land and premises to be the rite and estate of the within mentioned Henry Downer his heirs and assigns forever. State of Maryland, Washing County SS. I do hereby certify that Alexr Clagett and Cephas Beall Esquires before whom the acknowledgement to the within deed appears to have been made and whose names are thereto subscribed was at the time of doing the same and still are two of the justices of the peace in and for the county aforesaid duly commissioned and sworn. Be it Remembered that heretofore, to wit on the Second day of July in the year of our Lord one thousand eight hundred and thirty three a writ of the Commonwealth of Pennsylvania commonly called a writ de partitione Facienda(?) issued out of the District Court for the City and County of Lancaster in the words following, to wit, Lancaster County SS, The Commonwealth of Pennsylvania to the Sheriff of Lancaster County, Greetings, Whereas at the suit of John Doner, Henry Doner and Daniel Doner Demandants and Abraham Doner, John Doner, David Doner, Rudolph Shank and Susanna his wife late Susanna Doner, David Long and Ann his wife late Ann Doner, Martha Bowman widow late Martha Doner, the children of Christian Doner deceased and Christopher Doner John Doner and David Doner, three minor children of Christian Doner Junior deceased and Grandchildren of the above named Christian Doner deceased who was one of the brothers of the plaintiffs with notice to their uncle and Guardian Abraham Doner and Mary Doner, Eliza Doner, Christopher Doner, David Doner, William Salmon and Martha his wife late Martha Doner, and Daniel Doner, Henry Doner John Doner Abraham Doner and Joseph Doner five minor children of David Doner deceased who was one of the brothers of the plaintiffs with notice to their brother and Guardian of said five minors, Christopher Doner and Christian Mayer and Elizabeth his wife late Elizabeth Doner one of the sisters of the Plaintiffs, Leah Neff widow late Leah Eby, Lydia Eby, Anne Eby and Susanna Eby being the four children of Esther Eby deceased who was one of the sisters of the Plaintiffs, and Abraham Myers John Myer John Forry and Ann his wife late Ann Myer, and Jacob Miller and Elizabeth his wife late Elizabeth Myer being the four children of Ann Myer deceased also one of the Sisters of the Plaintiffs, Defendants, they the said Defendants were summoned to be and appear before our Judges at Lancaster at our District Court for the City and County of Lancaster there to be held on the second Monday in June in the year of our Lord one thousand eight hundred and thirty three to answer the said Demandants of a plea for that whereas the said Demandants and the said Defendants together and undivided as tenants in common do hold in fee Simple a certain plantation and Tract of Land Situate in the Township of Lampeter in the county of Lancaster Containing one hundred and Sixteen acres more or less, whereon is erected three dwelling houses a Swisher Dam, three Stables and other improvements adjoining to land of Henry Downer James Porter Daniel Sefever Christian Diffenbaugh and others, and also a Certain Lot of ground Situate on Front Street in the Borough of Marietta in said County whereon is erected two two-story frame dwelling houses and Store and other improvements adjoining to lot of David Casset on the East and lot of Mrs Mary Doner on the west with the appurtenances whereof the said Defendants partition between them to be made according to the laws and customs of this Commonwealth in such case made and provided do gainsay and the same to be done do not permit very unjustly and against the same laws and customs, And it was in such manner proceeded in our said Court that partition thereof between the said Demandants and the said Defendants should be done. Therefore we command you that taking with you twelve good and lawful men of your Bailwic by whom the truth of the matter may be better known in your proper persons you go to the premises aforesaid with the appurtenances and then and there by their oaths and affirmations in the presence of the parties aforesaid by you to be warned (if upon being warned they will be present) the premises aforesaid with the appurtenances you cause to be parted and divided and one eighth part whereof (the whole into eight equal parts to be divided) with the appurtenances to the said John Doner and to his heirs and assigns one eighth part thereof (the whole into eight parts to be divided) with the appurtenances to the said Henry Doner and to his heirs and assigns, one other eighth part thereof (the whole into eight parts to be divided) with the appurtenances to the said Daniel Doner and to his heirs and assigns, one other eighth part thereof (the whole into eight parts to be divided) with the appurtenances to the said Abraham Downer John Doner David Downer Rudolph Shank and Susanna his wife David Long and Ann his wife Martha Bowman to each of them the one Seventh of the one eighth part thereof and to their heirs and assigns, And the other one Seventh part of the said one eighth part thereof unto Christopher Downer John Downer and David Downer and to their heirs and assigns one other eighth part thereof (the whole into eight parts to be divided) with the appurtenances to the said Mary Downer Eliza Downer Christopher Downer David Downer William Salmon and Martha his wife Daniel Downer Henry Downer John Downer Abraham Downer and Joseph Downer that is to say, to each of them one tenth of the one eighth part thereof and to their heirs and assigns respectively, one other eighth part thereof (the whole into eight parts to be divided) with the appurtenances to the said Christian Meyer and Elizabeth his wife and to their heirs and assigns, one other eighth part thereof (the whole into eight parts to be divided) with the appurtenances to the said Leah Neff Lydia Eby Ann Eby and Susanna Eby that is to say to each of them one fourth part of the one eighth part thereof and to their heirs and assigns respectively, and one other eighth part thereof (the whole into eight parts to be divided) with the appurtenances to the said Abraham Meyer John Meyer John Forry and Ann his wife and Jacob Miller and Elizabeth his wife that is to say to each of them one fourth part of the one eighth part thereof and to their heirs and assigns respectively to be held by the said parties respectively in severally you cause to be assigned and delivered so that neither the said Demandants and the said Defendants respectively nor their heirs shall have more in the respective parts of the premises aforesaid with the appurtenances then they might and to them apportioneth to have so that the said Demandants and the said Defendants respectively their parts of the premises aforesaid with the appurtenances to them respectively happening severally may appropriate themselves, But if the said Inquest by you to be Summoned as aforesaid to make the said partition shall be of opinion that the premises aforesaid with the appurtenances cannot be so parted and divided without prejudice to or spoiling of the whole, then we command you that you cause the said Inquest to equalize such partition or purparts (if equal partition in value cannot be made of any share or purport) by valuing the purparts respectively and to award that any one or more of the shares or purparts shall be subject to the payment of such sum of money as shall be equal to the difference in value of any other share or shares purpart or purparts and return the same with their Inquest otherwise to make a just valuation and appraisement of the premises aforesaid with the appurtenances on their oaths or affirmations due notice having been first given to the several persons or parties interested in the same premises to appear if they think fit at the time and place of holding such Inquisition and that partition or valuation which you shall so make you distinctly and openly have under your hand and seal and under the hands and Seals of those by whom the same shall be made before our Judge at Lancaster at our District Court for the City and County of Lancaster there to be held on the first Monday in September next that such further proceedings may be had as to law and Justice shall appertain, And have you then there this writ. Inquisition taken at the dwelling house Daniel Boch in Lampeter Township Lancaster (being part of the premises in the annexed writ ascribed on Thursday the 29th day of August Anno Domini Eighteen hundred and thirty three by virtue of a writ de partitione Facienda directed to the Sheriff of Lancaster County and annexed to this Inquisition upon the oaths of Timothy Rogers, John George Cooper, John M Duchman, John Leonard, Adam Metzger, Jacob Rathfor, and the solemn affirmations of Benjamin Landis, David Buchwalter, Jacob Landis, Abraham Landis, Jacob Demuth and Jacob Bushony, twelve free honest and lawful men of the baliwic of the same Sheriff who upon their oaths and affirmations aforesaid respectively do say that they went into and upon the Real Estate of Abraham Downer late of the Borough of Manetta deceased and in said writ described viz Number one consisting of a certain plantation and Tract of land situate in the Township of Lampeter in the County of Lancaster Containing one hundred and sixteen acres more or less adjoining to land of Henry Downer, James Porter, Daniel Lefever, Christian Diffenbach, and others which has lately been surveyed by Israel Carpenter and divided into two purparts as follows, to wit, Purpart A Consisting of one hundred and ten acres and four perches of land including the mansion house, barn and other improvements according to the Draught hereto annexed, Purpart B Consisting of Twelve acres and thirty six perches of land whereon is erected a house Stable and other improvements according to the Draught hereto annexed, Purpart C Consisting of a certain Lot of Ground situate in Front Street in the Borough of Manetta in said County whereon is erected two two story frame dwelling houses and Store and other improvements adjoining to lot of David Cassel and lot of Mrs Mary Downer and the Inquest aforesaid upon their oaths and affirmations aforesaid respectively do Say and find that the premises aforesaid with the appurtenances cannot be divided to and among the parties in the said writ named by assigning and delivering to each one equal part in value of the said premises without prejudice to and spoiling of the whole, And they do further say and find that the said premises with the appurtenances cannot be divided to and among all the parties in the said writ named by and delivering to each a Share or purpart of the same premises of an equal value and by equalizing such parts by valuing the same respectively and awarding that the same purparts or shares should be subject to the payment of such sum or sums of money as would give to the other parties in the said writ named respectively a share of equal value to their interest respectively in said premises without prejudice to and spoiling of the whole. And I do therefore the said Inquest have valued and appraised the said Purport A consisting of one hundred and ten acres and four perches of land at and for the sum of Eighty two dollars per acres amounting to the sum of Nine thousand and twenty two dollars and fifty cents, And Purpart B consisting of twelve acres and thirty six perches of Land at and for the sum of ninety five dollars per acre amounting to the sum of one thousand one hundred and sixty one Dollars and thirty seven cents, And Purpart C consisting of a Lot of Ground on Front street in the Borough of Manetta in said County whereon is erected two two story frame dwelling houses Store and other improvements adjoining to Lots of David Casset and Mary Downer and for the sum of thirteen hundred dollars. In Testimony whereof as well the said Sheriff as the Inquest aforesaid have hereunto set their hands and Seals the 29th day of August Anno Domini 1833. September 3rd 1833. Inquisition read and confirmed Judgement that the Inquisition and valuation remain firm and stable forever. Same day John Downer the eldest brother of Abraham Downer deceased appearing in Court agrees to accept purpart A in the said Inquisition mentioned containing 110 acres and four perches valued at $9022.50 whereupon the Court adjudged it to him on his paying or securing to be paid to the other parties in the said writ named their proportions of the appraised value according to their respective rights.

Same day Henry Downer second Brother of Abraham Downer deceased appearing in Court agrees to accept Purpart B in the said Inquisition mentioned Containing twelve acres and thirty six perches of land valued at $1161.37 whereupon the court adjudge it to him on his paying or securing to be paid to the other parties in the said writ named their proportions of the appraised value according to their respective rights.

Whereas Abraham Downer lately died without issue having first made his last will and testament wherein and whereby he did among other things devise certain real estate to his brothers and sisters or their representatives, And Whereas by virtue of a certain writ commonly called a writ de partitione Facienda issued out of the District Court for the City and County of Lancaster on the 2nd day of July Anno Domini 1833 the said real estate was duly valued and appraised according to law, and purpart A of said Real Estate Consisting of one hundred and ten acres and four perches of land Situate in Lampeter Township in the County of Lancaster was valued and appraised at and for the sum of Nine thousand and twenty two dollars and fifty cents and purport B of said Real estate consisting of Twelve acres and thirty six perches situate in said Township was valued and appraised at and for the sum of one thousand one hundred and sixty one dollars and thirty seven cents, And purpart C of said real estate Consisting of a Lot of ground on Front Street in the Borough of Manetta in said County whereon is erected two two story frame dwelling houses store and other improvements, And Whereas at a District Court held at Lancaster for the City and County of Lancaster on the 3rd day of September Anno Domini 1833 John Downer one of the brothers of said Abraham Downer deceased accepted purpart A at the valuation so as aforesaid made, Consisting of one hundred and ten acres and four perches of land situate in Lampeter Township aforesaid, and at the same time Henry Downer another of the brothers of the said Abraham Downer deceased accepted purport B at the valuation so a aforesaid made, Consisting of twelve acres and thirty six perches of land as in and by the said records orders and proceedings reference thereto being had will more fully and at large appear, And Whereas purpart C of said real estate being that part thereof which is situate in the Borough of Manetta Consisting of a Lot of ground on Front Street whereon certain improvements are erected was not accepted at the valuation by either of the parties interested in said proceedings in partition and was by order of the District Court aforesaid exposed to public sale by the Sheriff of Lancaster County who sold the same to John Casset of said Borough nearly all of the moneys arising from said sale having been paid to Daniel Grosh Executor of the last will and Testament of said Abraham Downer deceased for the purposes of paying legacies bequeathed by said will, And Whereas the said John Downer did by Indenture grant bargain and sell the aforesaid one hundred and ten acres and four perches of land to John Rohrer of Manheim Township Lancaster County and to his heirs and assigns forever, so that the whole of the real estate which passed under said writ to the Brothers and Sisters of said Abraham Downer deceased is now vested as follows, in said Henry Downer Twelve acres and thirty six perches, in said John Rohrer one hundred and ten acres and four perches, in said John Cassel the lot of ground on Front Street in the Borough of Manetta and to their respective heirs and assigns forever. Now know ye that the several and respective parties being all the heirs and legal representatives of said Abraham Downer deceased before mentioned have on the day of the date hereof had and received of and from said Henry Downer John Rohrer and out of the balance of the proceeds of the money paid by John Cassel amounting after deducting all costs charges and expenses and certain inheritance tax to the Sum of Nine thousand eight hundred and seventy Dollars and one cent Lawful money of the United States their full equal distribution Shares of and in said sum they the before mentioned said parties in said writ of partition do hereby release quit claim exonerate and forever discharge the said John Rohrer his heirs and assigns holding the said one hundred and ten acres and four perches of Land and every part thereof, and do also release quit claim exonerate and forever discharge the said Henry Downer his heirs and assigns holding the said Twelve acres and thirty six perches of land and every part thereof, and do also release quit claim exonerate and forever discharge the said John Cassel his heirs and assigns holding the said Lot of ground and every part thereof and of and from all and every claim and demand whatsoever by reason of the premises so that the said John Rohere Henry Downer and John Cassel and their respective heirs and assigns shall and may from time to time and at all items hereafter forever quietly and peaceably have hold occupy possess and enjoy the aforesaid mentioned Real estate and every part and parcel thereof free and clear and freely and clearly acquitted exonerated and discharged of and from all and every claim and demand whatsoever which we or either of us now have or can or may hereafter have by reason of any matter or thing whatsoever.
