This Indenture made the twenty sixth day of December in the year of our Lord one thousand seven hundred and ninety nine, between Robert Sturgeon of Union Township, Fayette County and Commonwealth of Pennsylvania, and Jenny his wife, of the one part and Arthur Henry of Dunbar Township and County and Commonwealth aforesaid of the other part, Witnesseth that the said Robert Sturgeon and Jenny his wife, for and in Consideration of the sum of three hundred pounds Pennsylvania currency, to them in hand paid, the Receipt whereof they do hereby acknowledge to have been paid by the said Arthur Henry before the sealing and delivery of these presents, have granted bargained sold Released Enfeoffed assigned and Confirmed and by these presents do grant, Bargain Sell, Release, Enfeoff, assign and confirm unto the said Arthur Henry all the Estate Right Title Interest property claim and demand whatsoever of them the said Robert Sturgeon and Jenny his wife, of in to and out of the following described Lot or piece of Ground, being in the Town of East Liberty and Township of Dunbar and County and Commonwealth aforesaid, there lying on the North side of Market Street and Cornering on Market and Water Streets, beginning at a post on the corner aforesaid and Running North twenty degrees East ten perches to a post thence North seventy degrees West four perches to a post thence by another lot of said Sturgeons South twenty degrees West ten perches to a post, thence by Water Street South Seventy degrees East four perches to the place of Beginning, Containing in all one fourth part of an Acre, and being No 8 on the plot of the aforesaid Town and being a part of that tract of land for which a patent of deed of Confirmation was granted to Joshua Dickerson on the sixteenth day of April in the year of our Lord one thousand seven hundred and eighty seven, by the Commonwealth aforesaid, and being that lot or piece of ground which said Dickerson afterwards conveyed to said Sturgeon by a Deed of Conveyance dated the eleventh day of March in the year of our Lord one thousand seven hundred and ninety seven, Together with all and singular the Rights members and appurtenances to the aforesaid Belonging or of Right in anywise appertaining, Reserving always Nevertheless therefrom the sum of one half dollar annually to be paid by the said Arthur Henry or his heirs or assigns unto the said Joshua Dickerson his heirs or assigns as a quit or ground Rent, To have and to Hold the aforesaid lot or piece of Ground thus Conveyed, with the Appurtenances to the aforesaid Arthur Henry to his heirs To the proper use and Behoof of him the said Arthur Henry and his heirs and assigns forever free and clear of all restrictions, Excepting only as is before Reserved, and that the said Robert Sturgeon and Jenny his wife and their heirs and assigns shall unto the said Arthur Henry and his heirs and assigns forever warrant and defend against any and all persons Claiming or to claim the same. Witnesseth that the said Robert Sturgeon and Jenny his wife for and in Consideration of the sum of Eight hundred Dollars lawful money of the State of Pennsylvania, to them in hand paid, the Receipt whereof they do hereby acknowledge to have been paid by the said Arthur Henry, before the sealing and delivery of these presents, have granted, Bargained, sold, Released, enfeoffed assigned and Confirmed, and by these presents do grant, Bargain, sell, Release enfeof, assign and Confirm unto the said Arthur Henry all the Estate Right title Interest property Claim and demand whatsoever of them the said Robert Sturgeon and Jenny his wife of in to and out of the following described piece or parcel of ground, being in the Town of East Liberty and Township County and Commonwealth aforesaid, lying on the north West side of Union Street, Beginning at a post at the South West end of said street, thence along said street North twenty degrees East nine perches to a post, thence by land of David Howard North Seventy degrees west twenty perches to a post, thence by Market Street South twenty degrees west seven perches to a post, thence by land of Joshua Dickerson a straight line twenty perches to the place of Beginning, Containing it being a part of that tract of Land for which a patent or Confirmation was granted to Joshua Dickerson on the sixteenth day of April in the year of our Lord one thousand seven Hundred and eighty seven by the Commonwealth of Pennsylvania and being that piece of ground which said Dickerson Conveyed to Robert Sturgeon by deed of Conveyance Bearing date the Eleventh day of in the year of our Lord one thousand seven hundred and ninety seven, Together with all and singular the Rights members and Appurtenances to the aforesaid piece of Ground belonging or of right in any wise appertaining, To have and to hold the aforesaid piece or parcel of Ground thus Conveyed with the Appurtenances to the said Arthur Henry and to his heirs to the proper use and behoof of him the said Arthur Henry and his heirs and assigns forever, and that the said Robert Sturgeon and Jenny his wife and their heirs shall unto the said Arthur Henry and to heirs and assigns forever warrant and defend against any and all persons claiming or to claim the same, In Witness whereof we have thereunto set our hands and seals the day and year first above written. Whereas the Commonwealth of Pennsylvania by Pattent or Confirmation dated the 23rd day of September 1785 did grand unto Henry Hast a certain tract of land called Hasts Bog(?) and whereas the said Henry Hast and Elizabeth his wife by Indenture dated the 10th day of March 1787 conveyed part of said tract unto Margaret Sturgeon now Deceased, Now know ye that as the <4-5 words illegible> Margaret Sturgeon Deceased, that is Robert Sturgeon William Sturgeon, William Moss and wife Nancy, Michael Davis and wife Mary, for and in consideration of the sum of five hundred twenty Dollars to them in hand paid by Elias Jefferies of Fayette County and Commonwealth of Pennsylvania Receipt is hereby acknowledged have granted bargained sold and by these presents do grant bargain sell convey and confirm unto the said Elias Jeffers his Heirs and Assigns the following piece or parcel of land which was left to us by our Mother Margaret Sturgeon Deceased as aforesaid which land surveyed some time last summer the boundary lines of said tract of land are as follows beginning at a post N 32 E 20.7 to a post from thence N 67 7.5 E 10.2 to a post from thence S 17 7 1/2 W 3.2 to a post from thence N 42 35 W 300 poles to the place of beginning Containing thirty five Acres and twenty two perches and Allowances such land situate lying and being on the Waters of Dunlap's Creek in Monallen Township in the County of Fayette adjoins lands of Said Elias Jeffers and Benjamin Beel and also Daniel Johnston and this which land are Robert Sturgeon, William Sturgeon, William Moss and wife Nancy, Jonathan West and wife Jane, Michael Davis and wife Mary shall warrant and forever Defend against all persons claiming or to claim by through or under them and their Heirs and against all and every other person or persons Claiming any Right Title or Interest to the same. Freely and Clearly Acquitted and discharged from the affect of any Judgements or Mortgages or any other encumbrance prior to the date hereof and we further do Covenant with said Elias Jefferis that if this Instrument of writing should prove Insufficient as to a Compete title in fee simple to said E Jefferies that we shall make or cause to be made unto said E Jefferies any other title of said Land what may be considered in fee simple and for the true performance of all the Covenants and Agreements above mentioned we bind ourselves our Heirs Executors Administrators unto said Elias Jeffereies to his Heirs Executors Administrators. In Witness whereof the granting parties aforesaid have hereunto set their hands and seals the twentieth day of February one thousand eight hundred and Twelve (1812).
