I do ordain or determine the following disposition of my worldly substance. My wife & family may choose two cows out of the flock for their benefit and keep four hogs which will be necessary for their use also ten sheep of the [their?] choice and my wife shall also keep all the household furniture. She shall also keep all the wheat, meat, & flour which I now have for the sumers [summer's?] provision of the family. The watch which is now in Johns possession John shall keep until William is twenty one years of age and then John shall give the watch to William. I also allow the field of grain which is up north of the house to be reserved for the use of the family. I also ordain that the balance of the cattle, sheep and hogs, the farming utensils, geers [gears?] and all the horses except Susans are all to be sold and all the debts paid out of the proceeds of the sale. All the grain which is in the ground is also to be sold except the field above the house. If any more money is left of the proceeds of the sale than will pay the [missing word?] it shall be equally divided among the children. I also wish John to give William a finished literary education at his own expense and as a compensation to John for Williams education I allow him an equal dividend of all the real estate. The farm shall not be sold until William is twenty one years of age, after which if necessary or thought by the family to be advantageous it may be sold.
I also appoint my wife and son John Executors of the Estate. Any book accounts and outstanding debts are to be collected by John and his mother for aiding to pay the debts. The amount of money thirty one dollars which Richard Davis owes me after his account is taken out shall also be put into the hands of John and his mother for their aid in paying the debts. This Deed made this nineteenth day of April in the year of our Lord one thousand eight hundred and fifty four between John A Smith and Mary Smith his wife, John Hosic and Dorcas M Hosic his wife, Thomas Todd and Susan Todd his wife, Elizabeth A Smith and William T Smith, which said John A Smith, Dorcas M Hosic, Susan Todd, Elizabeth A Smith and William T Smith are children heirs at law and devisees of William C Smith, late of Ohio County, Virginia, deceased and as said John A Smith as Executor of the last will and testament of the said William C Smith deceased of the first part, and James Todd of the second part, Witnesseth that in consideration of the sum of two thousand three hundred Dollars the receipt of which is hereby acknowledged the said parties of the first part do grant unto the said party of the second part all the following described plot or parcel of land situated on the waters of Middle Wheeling Creek in said County of Ohio and bounded as follows, viz, Beginning at a White Oak corner to Silas McDonald South 65 W 7 poles to a Stake, thence S 5 E 10 P to a W.O. thence S 81 1/4 W 27 4/10 poles to a sugar, thence S 13 1/2 E 25 poles to a white oak, thence S 27 W 5 3/10 poles to a stake, thence S 75 1/2 W 38 3/10 poles to a stake, thence N 44 W 10 4/10 poles to a stake, thence S 68 W 9 8/10 poles to a stone thence N 43 3/4 W 106 poles and 16 links to a white oak and ash, thence N 1 E 22 poles to a dogwood, thence N 19 1/2 E 50 6/10 poles to a white oak, thence N 81 1/4 E 40 poles to a stake, thence S 55 1/2 E 83 1/2 poles to a stake, thence S 86 1/2 E 29 poles to a stake, thence N 2 3/4 E 56 8/10 poles to a rock, thence N 85 1/4 E 29 poles thence S 1 E 108 1/2 poles to the Beginning, Containing 106 acres, being the same tract of land devised to the above named devisees by the last will and testament of William C Smith deceased now of Record in the said County of Ohio, And the said John A Smith, John Hosic and Dorcas M Hosic his wife, Thomas Todd and Susan Todd his wife, Elizabeth N Smith and William T Smith doth by covenant with the said James Todd that they will warrant generally the property hereby conveyed. State of Virginia, County of Marshall to wit, I John Jefferson a Justice of the Peace for the County aforesaid in the State of Virginia do certify that John Hosick Thomas Todd, Elizabeth N Smith and William T Smith whose names are signed to the deed hereto annexed, bearing date on the nineteenth day of April 1854, have acknowledged the same before me in my County aforesaid. Given under my hand this 26th day of July 1854, eighteen hundred and fifty four. John Jefferson, J.P.
State of Virginia, County of Marshall, to wit, We John Jefferson and William Keys Justices of the Peace for the County of Marshall in the State of Virginia do certify that Dorcas M Hosac the wife of John Hosic and Susan Todd the wife of Thomas Todd whose names are signed to the deed hereto annexed, bearing date on the nineteenth day of April 1854,personally appeared before us in the county aforesaid, and being examined by us privately and apart from their husbands and having the deed aforesaid fully explained to them, they the said Susan M Hosic and Susan Todd acknowledged the said deed to be their act and declared they had willingly executed the same and do not wish to retract it. Given under our hands this 26th day of July eighteen hundred and fifty four. John Jefferson. William Keys.
State of Ohio, Miami County SS. Be it remembered that on this 12th day of July 1854 before me a Notary Public in and for the County of Miami and State of Ohio, personally came John A Smith and Mary Ann his wife, two of the grantors in the above conveyance, who acknowledged the signing and sealing of the same as their voluntary act and deed for the use and purposes therein mentioned. The said John A Smith executing the same both in his own behalf and as executor of the will of Wm C Smith, late of Ohio County Virginia, decd.
And the said Mary A Smith being at the same time examined by me separate and apart from her said husband, and the contents of the said instrument being by me made known and explained to her, then declared that she did voluntarily sign, seal and acknowledge the same and that she is still satisfied therewith.
In testimony whereof I have hereunto set my hand and affixed my official seal on the day and year last above written. J T Jourin, Notary Public, Miami County, Ohio.
