This Lease, Made the twenty second (22nd) day of April A.D. 1895 between Elizabeth Reed of Liberty District Ohio County State of West Virginia the party of the first part, the Lessor, and the Fisher Oil Company a Corporation under the laws of Pennsylvania the party of the second part, the Lessee, witnesseth that the Lessor in consideration of fifty Dollars one years rental paid in advance in hand paid by the Lessee, the receipt of which is hereby acknowledged and in consideration of the rents and royalties herein contained, has granted demised and let unto the Lessee its successors heirs and assigns, all the oil and gas in and under the following described tract of land, and also the said tract of land for the purpose and with the exclusive right of drilling and operating thereon for said oil and gas together with both the right of way over and the right to lay pipes over this hold and over any part of the farm or land Lessor including water and gas to operate same and the right to erect and maintain oil and gas structures and shanties or dwellings for employees also the right to remove at any time while this lease is in force and thereafter all property machinery buildings and fixtures placed there by the Lessee, which lease and tract of land situated in Liberty District Ohio County State of West Virginia bounded an described as follows, to wit, on the North by land of Adam Blayney, on the East by lands of William Gibson and John Humphrey on the South by lands of William Moore and Thomas Ralston Estate on the West by land of Edward Blayney containing two hundred acres more or less, To have and to hold the said premises unto them the said Lessee its successors heirs and assigns for a term of five (5) years from the date hereof, and as much longer as oil and gas may be produced on the premises, and the rental paid thereon, but not to exceed ten years unless oil or gas is then produced in paying quantities. The Lessee shall deliver one eighth part of the oil produced and saved in tanks or pipe lines to the Lessor's credit, and should gas be produced and used off the premises the Lessor shall be paid at the rate of two hundred dollars annually so long as the gas is so used and sold and gas for one house if a surplus beyond the want of the lease. This lease is made to have a test well drilled in the vicinity, and this is to be one of several leaseholds in the vicinity to make a group held by the Lessee on adjoining or adjacent farms, or within one mile upon either of which if a well is drilled and completed as hereinafter provided while this lease is in force, it shall comply with the terms of this within described leasehold the same as if the first well was drilled thereon. No wells shall be drilled within four hundred feet of the buildings now on the farm by either party. Pipe lines on tillable ground shall be buried if desired. Damage to growing crops shall be paid, provided, however, that this lease shall become null and void and all rights hereunder shall cease and determine unless drilling shall be commenced on said premises, or on another premises herein provided, within one year from the date hereof, unavoidably accidents and delays excepted, and unless the Lessee shall pay at the rate of fifty dollars rental annually in advance for each succeeding year such drilling is delayed from the time mentioned for the commencing of a well until drilling is commenced, such payments may be made direct to the Lessor or by check payable to the order of Elizabeth Reed and mailed to her at West Alexander Washington County Pennsylvania. When drilling is commenced it shall be prosecuted with due diligence to completion of a well to the least depth required for oil or gas in the nearest producing field to this leasehold. It is agreed that all the foregoing terms and conditions shall extend and apply to the respective heirs and assigns of the parties.
