The Last Will and Testament of Jacob Mofser deceased being wrote in the
German language could not be recorded but thereon is indorsed as follows viz,
Lancaster County SS. December the 13th Before me the Subscriber came
Benjamin Hershy, Christian Marti and Abraham Hostetter the Witnesses to the
foregoing Will and on their Solemn Affirmations according to Law did declare
and say that they were present and saw and heard Jacob Mosser the Testator
above named Sign Seal publish pronounce and declare the foregoing Writing as
and for his last Will and Testament and that at the doing thereof he was of
sound and disposing Mind Memory and Understanding to the best of their
Knowledge Observation and Belief. Edward Shippen.
Be it Remembered that on the 13th day of December 1756 The last Will and
Testament of Jacob Mosser deceased was proved in due form of Law and probate
and Letters Testamentary were granted to Jacob Hostetter and Peter Mosser the
Executors in the said Testament named they being first duly Qualified well and
truly to Administer the said Decedents Estate and to bring an Inventory
thereof into the Registers Office at Lancaster on or before the thirteenth Day
of January next and also to render a true and just Account of their said
Administration when thereto lawfully required. Given under the seal of the
said Office, Edward Shippen, Dep Register. [Ref: LancasterCoPA Wills B-150]

in Lancaster County Court House in Book Y-2 p448 (note confusion regarding X-2
and Y-2 -- when these books were photocopied the covers were put on the wrong
books, so indexes based on the original filings are wrong when compared to the
County Courthouse):
Whereas the Lord God have appointed for all men once to dye and I Jacob
Mosser being very sick and weak of Body But of perfect mind memory and
understanding Thanks be given unto God therefore and if the Lord should call
from this world I praying out Grace for an everlasting Life and make and
ordain this my Last will and Testament how it shall bedin(?) with all my
estate and with my wife and children after my decease in the following manner
and form. First it is my will and I do order that after my decease all my
just debts and funeral charges shall be paid and satisfied. Item it is my
will and I do order that my beloved wife Mary Musser shall have after my
decease all and singular what she brought to me and shall be paid to her as
Reasonable and shall be all her own again. Further it is my will and order
that my wife shall have in forehand for the time she kept house with me from
just what use again together the sum of eighty five pounds and she shall sleep
in the place as long as she remains a widow and to bring up the children in
the Laws of God and to do with the Plantation how she pleases as long as she
remains a widow and the children shall have no power to Master or Humble her
and the Children shall be brought up and clothed and be sent to school from my
estate and Plantation. Further it is my will and order that all my Estate
shall be equally divided among all my Children share alike and that my son
John Musser shall have no more than one other child but it should be equally
divided in share and share alike. Item it is my will and I order that my land
and Plantation shall be divided in two equal parts one part as much as the
other at the time when my two sons John Musser and Benjamin Musser being of
age and shall be given to them if they be just and obediently but if they be
unobedient Riotious or one wills slanders unjust and the Church unobedient
that then my appointed executors which I appointed for my Children shall have
full power from me to give the same to the others of their sisters and the
land shall be valued the same time from the Executors and other trusted men as
reasonable but the others which have no land of me not fall too Runt(?) and
they shall after the valueing be all alike heirs. Item I give to the
appointed Executors Full Power to give to Children in my name Good and lawful
Deeds which shall be as good and lawful as if I myself had signed and
delivered the same to this and all my estate. I constitute make and appoint
Executor my Brother-in-Law Jacob Hostetter and my brother Peter Musser and if
one of them should die then it shall be ordered another in his place and it
shall be given to them full power as above mentioned. Item it is my will that
when the Land and Plantation will be given to the Children that the Mother
shall have and to hold the widowhood in my house to her will and when she
please in the stove room Bath(?) room Kitchen cellar and Loft and stable and
garlira(?) and fruit of the orchard as much she pleases and she shall
according the English Law have the third part of the rent from the Land during
her life or will have the same and no child shall have Power to command her.
Item I give to the poor the sum of Ten pounds and the Executor shall take care
that the land and the timber not will be split. Further is my desire of the
Executors that whereas my children yet young and if they should come up and
would be unobedient against her that they shall help her to keep them in the
Fear and Sobriety and reiusle(?) and doctrine and to keep them from such. To
this my Testament I have hereunto set my hand and seal the 27th day of
