This Indenture made the nineteenth day of December Anno Domini one thousand
eight hundred and twenty five Between Jacob Engle of Donegal Township
Lancaster County and State of Pennsylvania (son of Jacob) guardian of two of
the minor children of Henry Musser late of the same township Deceased, Henry
Engle of the same township guardian of two other of the minor children of the
said decd, Jacob Hershey of Donegal township and County of Lancaster aforesaid
and Mary his wife late Mary Musser widow and relict of the said Henry Musser
deceased of the one part, and Jacob Musser of the township of Donegal
aforesaid of the other part, Whereas the said Jacob Musser by his Indenture
bearing date the 26 day of May A.D. 1824 for and in Consideration of sundry
debts therein recited due to the said Jacob Engle Henry Engle and Mary Musser
respectively as follows to wit, the sum of one thousand and sixty five dollars
due by him to the said Jacob Engle the sum of thirteen hundred and twenty
seven dollars and fifteen cents due by him to the said Henry Engle and the sum
of thirteen hundred and twelve dollars and eighty three cents due by him to
the said Mary Musser did grant bargain sell alien enfeoff and confirm unto the
said Jacob Engle Henry Engle and Mary Musser their heirs and assigns all them
two following described tracts or pieces of land situate in Donegal township
Lancaster County aforesaid, bounded and described as follows to wit, the first
thereof Beginning at a corner of land of Alexander Boggs Esq and on the road
leading from Maytown to Marietta thence South sixty nine degrees east seventy
one perches and nine tents to lands of Frances Evans thence by the same and
the suburbs of Marietta south twenty and one fourth degrees west two hundred
and thirty one perches and one tenth to the road on the Bank of the river
Susquehanna thence North seventy seven and three fourth degrees west nine
perches and four tenths thence north eighty four and a half degrees west
twenty four perches and six tenths to the line of Andrew Boggs land thence
North twenty seven and one quarter degrees east two hundred and forty seven
perches, and two tenths to the beginning, Containing one hundred four acres
the second whereof Beginning at a post thence by lands of Thomas Steinway
North eighty six degrees east eighty two perches thence by land of Frances
Evans North twenty seven and one fourth degrees east forty five perches and
two tenths to a corner of lands of Christian Graybill thence by the same South
eighty six degrees west eighty two perches to a line of Henry Hains land and
of Nicholas Clepper thence by lands of the latter south twenty seven degrees
and one fourth west forty five perches and two tenths to the beginning,
Containing twenty nine acres three quarters and ten perches as stated in said
Mortgage but by actual survey only nineteen acres three quarters and ten
perches, to hold the same to them the said Jacob Engle Henry Engle and Mary
Musser their heirs and assigns forever as in and by the said Indenture of
Mortgage recorded at Lancaster in Mortgage book No 5 page 24 relation being
thereunto had appears, And Whereas the said Jacob Musser hath fully satisfied
and paid the said Jacob Engle the said sum of one thousand and sixty five
dollars with the Interest due thereon the said Jacob Engle doth agree to
execute his instrument of writing as a full release of the above mentioned two
tracts of land, And whereas the said Henry Engle and Jacob Hershey and Mary
his
do consider that the first above mentioned and described
tract of land is sufficient security for their respective sums of money so due
to them as aforesaid do agree to execute this instrument or writing as a full
release of the last above mentioned and described tract of land, Now this
Indenture Witnesseth that the said Jacob Engle for and in Consideration of the
payment of the above mentioned sum of money and the interest therein and for
the Consideration of the sum of one dollar to him in hand paid by the said
Jacob Musser the receipt whereof he the said Jacob Engle doth hereby
acknowledge and himself to be fully satisfied contented and paid hath and by
these presents doth give grant bargain sell release enfeoff and confirm unto
him the said Jacob Musser his heirs and assigns To have and to hold the said
two above mentioned and described two tracts of land hereditaments and
premises to him the said Jacob Musser his heirs and assigns forever to his and
their own proper use and behoof and to and for no other use intent and purpose
whatsoever, And the said Henry Engle and Jacob Hershey and Mary his wife for
divers good and valuable consideration them thereunto moving and more
particularly for and in consideration of the sum of one Dollar to them in hand
paid by the said Jacob Musser the receipt whereof they the said Henry Engle
Jacob Hershey and Mary his wife do hereby acknowledge and thereof acquit and
forever discharge the said Jacob Musser his heirs executors and administrators
by these presents, do give grant bargain sell release enfeoff and confirm unto
the said Jacob Musser his heirs and assigns all that the second above
mentioned and described tract or piece of land Containing (as said in said
Mortgage) twenty nine acres three quarters and ten perches of land but by
actual survey only nineteen acres and three quarters and ten perches as
aforesaid, To have and to hold the said second above mentioned and described
tract of land hereditaments and premises to him the said Jacob Musser his
heirs and assigns forever to his and their only proper use and behoof and to

This Indenture made the fifteenth day of June in the year of our Lord one
thousand eight hundred and thirty two between Henry Musser and Jacob Hosteter
administrators of Jacob Musser late of East Donegal Township decd of the one
part and Abraham Stauffer of the county of Cumberland of the other part,
Witnesseth whereas at a Court of common Pleas held at Lancaster for the County
of Lancaster on the fifty day of June in the year of our Lord one thousand
eight hundred and thirty two on the petition of Henry Musser and Jacob
Hostetter administrators of Jacob Musser late of East Donegal township
deceased setting forth that the decedent in his lifetime made a parol contract
with Abraham Stauffer by which he agreed to sell and convey to the said
Abraham his heirs and assigns the right title and interest which he had and
held and which he would be entitled to hold at the decease of his mother
Magdalena in a certain tract of land containing one hundred and fifty nine
acres three quarters and fifteen perches situated in Donegal township in said
county and adjoining lands of Alexander Boggs John Longnecker and other as
well as the dower or his right title and interest therein and to the third
part charged upon the said land during the life of the said Magdalena the
widow of Abraham Stauffer deceased the said right interest and claim having
been sold to the said Abraham for the sum of two hundred dollars which sum of
two hundred dollars was paid as stated in the petition of the said Abraham
Stauffer that the said Contract has been proved before the court by the said
Abraham Stauffer and the probate adjudged to be sufficient that the same has
been duly certified and recorded according to law, and praying the court to
grant them leave to make and execute a deed conveying the estate interest and
property aforesaid to the said Abraham Stauffer his heirs and assigns which
Petition and depositions of witnesses being read and filed among the records
of this court it is ordered and adjudged by the court that the said Henry
Musser and Jacob Hostetter administrators of Jacob Musser deceased make and
duly execute a deed conveying to the said Abraham Stauffer his heirs and
assigns the estate interest and property described in the petition aforesaid
agreeably to the terms of the contract before stated, and the petition
aforesaid, Now this Indenture Witnesseth that the said Henry Musser and Jacob
Hostetter in consideration that the sum of two hundred dollars was paid by the
said Abraham Stauffer to Jacob Musser in his lifetime as stated in the
petition of the said Abraham Stauffer presented to the court of common Pleas
of Lancaster County on the fourth day of June A.D. one thousand eight hundred
and thirty two have as administrators aforesaid granted bargain sold aliened
released and confirmed and by these presents and in pursuance of said decree
do grant bargain sell alien release and confirm unto the said Abraham Stauffer
and to his heirs and assigns all the estate right title interest property
claim and demand of the said Jacob Musser of in to or out of a certain tract
of land containing one hundred and fifty nine acres three quarters and fifteen
perches situated in Donegal Township Lancaster County and adjoining lands of
Alexander Boggs John Longenecker and others and also all the estate right
title and interest which the said Jacob Musser would be entitled to under a
certain Indenture dated the sixteenth day of November AD one thousand eight
hundred and twenty four by which the said Abraham Stauffer and Hannah his wife
sold released and conveyed to the said Jacob Musser his heirs and assigns all
the right title interest in the tract of land aforesaid and all the right
claim and demand which the said Abraham Stauffer would be entitled to at the
decease of Magdalena the widow of Abraham Stauffer deceased being his interest
in the one third part of the purchase money of the said tract sold under an
order of the Orphans Court and the sale duly confirmed on the twenty fourth
day of January AD eighteen hundred and twenty four the said one third part
remaining charged upon the said tract of land and the interest thereof to be
paid yearly to the widow of the said Abraham Stauffer deceased and after the
decease of the said widow then the one third part of the purchase money to be
paid to the heirs of the said Abraham Stauffer deceased as by reference to
said Indenture will more fully and at large appear. In witness whereof the
parties to these presents have hereunto set their hands and seals on the day
