Will of Henry Hersh, Deceased
Be it remembered that heretofore, to-wit, at a Court of Common Pleas began
and held at the Court House in Carrolton, within and for the Couty of Carroll
and State of Ohio, on Monday, the 25th of February, A.D. 1839, before the Hon.
George W. Belde, President, Robert George Reynolds, and Robert McEldeny, Esqs,
Associate Judge of said Court, within and for said County of Carroll.
The last will and testament of Henry Hersh dec'e was brought into the said
Court, the two subscribing witnesses thereto, being sworn, say that they saw
the testator sign said will, that they signed said will as witnesses, in the
presence, and at the request of the Testator, that the Testator when he signed
said will was of sound mind and memory, of full age, and under no restraint,
thereupon the same was approved, and ordered to be recorded with the proff
taken. Which will, is in the words and figures following to-wit:
Know all Men by these Presents, that I, Henry Hersh, now of the Township of
Washington, County of Carroll, and State of Ohio, Knowing the uncertainty of
life, and the certainty of death, and being of sound mind and memory, do make,
constitute and ratify, this as my last will and testament, hereby making and
disannulling any and every will or testament, by me heretofore made either
written or spoken.
First I give and bequesth to my beloved wife, Margaret Hersh, the farm on
which I now live containing, One Hundred acres, be the same more or less,
bounded on the north by land of John Ebersole, on the south by land of George
Abrahims, on the west by lands of George Hewitt, and on the east by lands of
Rebecca Crawford, together with any and every the buildings and appurtenances
thereunto belonging, to and for the sole use and support of her the said
Margaret Hersh, my wife, during her natural lifetime, but not to be by her
either incumbered or sold.
And whereas there is due to me, the said Henry Hersh, at the writing of this
will, notes and obligations are individually to the amount of one thousand
dollars; it is my will that all the interest that may accrue on the unexpended
balance of said thousand dollars (if any part of said sum of one thousand
dollars shall remain unexpended at my decease) shall be paid annually by my
executors to my said wife Margaret Hersh for her own use and behoof, but
should said interest be insufficient to support my said wife, after my
decease, together with the bequeath first above specified, then and in that
case it is further my will, that so much of the principal together with the
aforesaid interest shall be annually applied by my executors, for her support,
as they may deem prudently necessary.
Secondly, It is my will that such portion of my personal estate, not
heretofore named, as shall be necessary to pay any and every just claim, that
shall remain unpaid at my decease, together with my funeral expenses and costs
of executorship, shall be sold by my executors, at such time after my decease
as they may think proper, and the balance of my personal estate, after selling
so much as shall pay said claims, shall belong to my said wife, Margaret
Hersh, to and for her own use and behoof and at her own disposal in any way.
Third, it is my will that after the decease of my wife, Margaret Hersh, the
land first mentioned in my will, containing one hundred acres, be the same
more or less, being a part of the south west quarter of Section twenty-nine,
Township fourteen, Range five, in the Steubenville Land District, shall be
sold by my executors, at such time as to them may be thought best, and all the
proceeds arising from the sale of said lands after defraying any and every
legal expense, shall be equally divided among my children of the first wife,
Magdalena Hersh, viz Dorothy, Mary, Simon, Jacob, Elizabeth, Barbara, Sarah,
Henry, Molly, Solomon, Frand, and Catharine, or to their heirs or legal
representatives, share and share alike.
Fourth it is my will that any and every, the balance of the said one
thousand dollars, mentioned in my first bequeath that shall remain unexpended
after the decease of my said wife, Margaret Hersh, shall after her decease be
collected by my executors, as soon as practicable, and be by them equally
divided among the children of my second wife, Margaret Hersh, to wit, John,
Esther, Peter, Margaret, and Anne, or their heirs or legal representatives,
share and share alike.
Fifth I do hereby constitute and appoint my true and trusty friends, Solomon
Hersh my son and George Hewett, sole executors of this my last will and
testament.
In testimony that this is my last will and testament, I have hereunto set my
hand and affixed my seal, this eighth day of June in the year of our Lord one
