This Indenture Made the twentieth day of June in the Year of our Lord one thousand eight hundred and Sixty four Between Thomas A McKenney Administrator de bonos Non with the will Annexed of Samuel Bowman deceased of the One part and Jacob B Seitz of West Pennsborough Township Cumberland County of the Other part, Whereas Samuel Bowman lately of the Township of West Pennsborough and County of Cumberland died seized of several tracts and parcels of land in the said County of Cumberland having first made his last will proved and registered the 15th June 1847 by which he did direct that his real Estate comprised of his Mansion farm Containing about 102 acres and an other tract adjoining which he purchased from Robert McFarlane Containing about 16 acres and also a tract of land in Franklin Township adjoining Jacob Bartholder Mrs Sharp Randolph Heberleny and the Canadoquin Creek Containing two hundred acres and allowances Should be rented out by his Executors until the Youngest child of his daughter Susanna should arrive at the age of Eighteen years and then the places to be appraised by five reputable freeholders upon oath or affirmation and that any of his grand children who are the Children of his Said daughter Susanna May take the same at the appraisement giving to Jacob Sites One of them the preference and the Testator Appointed Isaac Lefevin and Jacob Bowman to be his Executors Who settled their accounts and are discharged by the Court and on the 15th August 1863 letters of Administration De bonis Non with the Will annexed were issued in due form of law to the said Thomas McKinney who on the 23 February 1864 Appointed with the Approbation of the Parties in interest Isaac Lefever Jacob Mailin James L Elliot Matthew Boyd and Wm A Lehman to make the said appraisement who having been first duly sworn did value and appraise the said Mansion Farm at and for One Hundred and twenty Dollars per acre and the tract Containing about 16 acres at one hundred and fifteen Dollars per acre and the tract in Frankford Township Containing 223 Acres 122 perches as and for the price of thirty three dollars per acre which appraisement is dated the 14th April 1864, And whereas afterwards to wit on the 14 May 1864 the said Jacob B Sites did declare and Make his Election in pursuance of the privilege given to him by the will of his said Grandfather that he would take all the said Lands at the Valuation so past upon them by the said Freeholder all of Which Appraisement of them their around and Election of the said Jacob B Seitz and in Entering and duly Acknowledged and Recorded in Office for Recording of Deeds in and for Cumberland County, Now this Indenture Witnesseth that the said Thomas A McKinney Administrator de bonos non with the will of Samuel Bowman deceased annexed, for and in consideration of the sum of Twenty one Thousand six hundred and Twenty three dollars sixty eight cents lawful money of the United States to him in hand paid by the said Jacob B Seitz at and before the sealing and delivery hereof, the receipt whereof is hereby acknowledged hath granted bargained sold aliened released and confirmed and by these presents doth grant bargain sell alien release and confirm unto the said Jacob B Seitz and to his heirs and assigns all three aforementioned tracts of land, one, All the said Mansion Tract of Land situate in the township of West Pennsborough and Conty of Cumberland Bounded by land of Dr Charles F Jitzer, Jacob Dorn, Henry Donice, William Kerr, Samuel Abrahs and John Dillen Containing One hundred and three acres and twenty nine perches be the same more or less, Two, All that tract of Land situate and being in the Same Township and County Bounded by land of Dr Charles F Zitzer Alexander Logan and the Conodrquonniett Creek Containing Sixteen acres and twenty nine perches be the same more or less, three, All that tract of land situate and being in the Township of Frankford and West Pennsborough Bounded by lands of Dr William Sharps heirs, Abraham Burkhart, Benjamin Burkholden heirs, Frances Diller, Peter Ahl, and the Conudoquinnett Creek and Which includes Eleven Acres and Seenty eight perches on the South side of the said Creek, Containing in the whole two hundred and twenty three acres and one hundred and twenty three perches be the same more or less, they being the same tracts of land which the said Samuel Bowman died seized and which he directed to be appraised as before recited and taken by his Grandson the said Jacob B Seitz in pursuance of the provisions of his Will as by reference to the said appraisement and Election duly recorded will more fully and at large appear, Together with all and Singular the Buildings and Improvements Ways Waters Water Courses rights liberties Privileges hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversions and remainders rents issues and profits thereof and also all the estate rights title interest use trust property possession claim and demand whatsoever of the said Samuel Bowman at the time of his death or his heirs since in law Equity of otherwise howsoever in to or out of the same, To have and to hold the said three Several tracts of land hereditaments and premises hereby granted and released or mentioned and intended so to be with the Appurtenances unto the said Jacob B Seitz and his heirs and assigns to and for the only proper use and behoof of the said Jacob B Seitz and his heirs or assigns for ever, And the said Thomas A McKinney for himself and his heirs doth Covenant promise and agree to and with the said Jacob B Seitz and his heirs and assigns by these presents that he the said Thomas A McKinney hath not done Committed or Knowingly Suffered to be done or committed any act matter or thing whatsoever whereby the premises hereby granted or any part thereof is or shall or may be impeached or encumbered in title Churgereitate(?) or Otherwise howsoever.
