In the name of God, Amen. I Mathias Mosser of Brecknock township Lancaster
County, and state of Pennsylvania, yeoman, being in the enjoyment of tolerable
health, and of sound mind memory, and understanding, praised be God, for the
same, but considering the uncertainty of this transitory life, do make and
publish this my last will and testament, in manner and form following, to wit.
First and principally I commit my soul into the hands of Almighty God, and my
body to the earth, to be decently interred at the discretion of my executors
herein after named. And as to such worldly estate, as it has pleased God, to
entrust me with, I dispose thereof, as follows. It is my will, that all my
just debts and funeral expences be paid out of the whole estate. Item, I give
and bequeath unto my dear wife Esther, for and during her natural life, or as
long as she remains my widow, her home and widow seat, in my present dwelling
house, with all its appertencances, and the free use of the spring, pump,
cellar, and other conveniences, to be enjoyed, and used in common with the
owner or possessor of my house and plantation, otherwise the owner or
possessor as aforesaid, shall be obliged, at his own expenses, to build a
suitable house for her, to the northern gable end of my present dwelling
house. And the owner or possessor of my plantation, shall yearly give and
deliver to my said wife twelve bushels of good wheat and twelve bushels of
good rye, and six bushels of Indian corn, and one bushel of buckwheat, and six
bushels of portatoes, Her grain shall at her desire be taken to the mill, and
when ground be brought back again in to her house, In any year, when
sufficient fruit is growing on the premises, she shall have a sufficiency of
the different kinds thereof, for drying, boiling applebutter, and other common
purposes, sufficient for her own use, she shall also yearly have the third
part of all the fowls and eggs, kept and laid on the premises, good and
sufficient firewood, shall at all times be placed near her house, made small
for her use, two cows of hers shall be kept on the plantation for her, summer
and winter, in good pasture, fodder, and stabling; she may also keep a hog of
her own on the premises, which, however, she must keep penned up. And she
shall also have delivered to her, yearly, one fat hog, killed and dressed, of
one hundred and fifty pounds weight, at least, besides the lard and entrails,
and also seventy pounds of good fat beef, all killed and delivered in proper
season for winter store. And also yearly, ten pounds of good heckled flax, and
ten pounds of flax tow, and five pounds good clean wool, and she shall also
have the third part of the garden, which shall yearly be well manured for her
and in case she gets sick, or through old age, or otherwise becomes inform and
helpless, she shall be kept, nursed, and maintained in a becoming Christian
like manner. All which foregoing articles, shall be done, given, and
delivered, and be allowed of, to and for my said wife, for and during her
natural life, or as long as she remains my widow, by the owner, possessor, or
occupier of my aforesaid house and plantation. Item, It is my will, that in
case my said wife, through old age, or otherwise should become so inform and
helpless, as to be unable to provide for herself, the owner, or possessor of
my plantation shall and may take her to his own room and table, or otherwise
procure her proper attendance at his own expense, and in that case, they early
gifts to her herein bequeathed, shall cease, and the expenses of her
maintenance be considered in lieu and satisfaction thereof. Item, I give and
bequeath unto my said wife, for and during her natural life, or as long as she
remains my widow (and not absolutely) my stove with the pipes, the clock and
case, the choice of three beds and bedsteads, table, chest, kitchen dresser,
the copper and iron kettles, large tub, churn, all the books, all the linen
and woolen cloth and clothes, and the choice of my two best cows, the clothes
press, spinning wheel, reel, and wool wheel, and as many other articles of
household stuff, implements, and furniture, as she may choose to take, as
necessary for her use. Item, I give, devise, and bequeath unto my son Daniel
Mosser, and to his heirs and assigns forever, all my messuage, tenement, and
several tracts of land, whatsoever I hold, own, and possess, being all
situated in the said township of Brecknock and county of Lancaster aforesaid,
containing together about one hundred and forty two acres, and some allowance,
as by my several deeds and titles respectively may appear, be the same more or
less, at and for the sum of two thousand two hundred and seventy two dollars,
lawful currency, eight hundred dollars, part of said sum, to be paid
immediately after my deceased, and the remainder to be paid in yearly payments
of seventy dollars each, in successive years, the first payment of seventy
dollars to be due in one year after my decease; and if my said son Daniel,
accepts of said premises (under and subject always to the several bequests,
grants, and privileges to my said wife, as afore herein contained) then it is
my will that after he has paid the said purchase sum, and maintained my said
wife as before directed in proper manner, that he my said son Daniel shall
have, hold, and enjoy the said premises, and appurtenances, as fully as I had
and held the same, to him, his heirs and assigns forever, Of the said sum of
eight hundred dollars however (mentioned to be paid on my decease) it is my
will that two hundred dollars, part thereof, shall remain a lien on said
premises during the natural life of my said wife, or as long as she remains my
widow, the interest whereof, at five per cent, shall yearly be paid to her,
and on her decease, or re-marriage, the said principal of two hundred dollars,
shall be paid to all my children or their proper representatives, in equal
shares. Item it is my will, that the several bequests herein made to my wife,
shall be in lieu of her dower out of my whole estate. Item, Is my will, that
in case, should my son Daniel, refuse to take said premises under the
foregoing conditions, that then my executors shall sell my land to best
advantage at public or private sale, and I do hereby empower and authorize my
executors, to make, sign, seal, execute, and acknowledge all such deed or
deeds, and to deliver them, unto the purchaser or purchasers thereof, as may
be requisite or necessary for the absolute granting, assurance, and conveyance
thereof, unto the purchaser or purchasers thereof, under and subject to the
several provisions and bequests to my said wife, as aforesaid. Item, It is my
will, that my children shall inherit my whole estate, real and persona, in
equal shares, therefore my executors, after my decease, shall of all the
monies coming into their hands, out of my estate, first equalize the
respective heirs to the standard of the sum, which may appear highest in what
some or all may have received of me in my lifetime, and after they are all
made equal, then the yearly payments out of the land shall be paid, to the
heirs in regular rotations in due preference of age. Item, I do hereby appoint
my son Daniel to be guardian over the body and estate of my daughter
Magdalena, who is non compos mentis. And Lastly, I do hereby nominate,
constitute, and appoint as executors to this my last will and testament, my
said son Daniel, and my son in law Christian Bowman; Hereby revoking all
former wills and testaments by me heretofore made; ratifying this and none
other to be my last will and testament. In witness whereof, I have hereunto
set my hand and seal, the twenty third day of may, in the year of our Lord,
one thousand eight hundred and thirty, 1830. Mathias Mosser.

within named testator, as and for his last will and testament, in the presence
of us, who at his request, have subscribed our names as witnesses thereto.

Lancaster County SS. On the 8th March, 1834, Before me the subscriber
personally appeared Daniel Bowman and Benjamin Mosser, the witnesses to the
preceding will, and on their affirmations, do say, that they were present, and
did see and hear Mathias Mosser, the testator therein named, sign, seal,
publish, pronounce, and declare the same, as and for his last will and
testament, and at the doing thereof, he was of sound and well disposing mind,
memory, and understanding, to the best of their knowledge, observation, and

March 8th 1834. Letters testamentary granted to Daniel Mosser, and Christian
Bowman, the executors, they being duly affirmed, to administer the estate, and
exhibit an inventory thereof, in to the Register's Office at Lancaster, within
thirty days, and an account of their executorship, in one year, or when
thereto required; also to comply with the act of Assembly relating to
