This Indenture Tripartite made the first day of October in the year of our Lord one thousand seven hundred and fifty one, Between Catherine Vity of the County of Lancaster in the province of Pennsylvania widow and relict of Christian Vity deceased and who was before her intermarriage with the said Christian Vity the widow and relict of John Witmer late of the said county yeoman deceased of the first part, Christian Swartz of the said county yeoman and Elizabeth his wife on eof the daughters of the said John Witmer by the said Catherine and George Kendrick of the said county yeoman and Barbara his wife the other daughter of the said John Witmer by the said Catharine of the second part, and Michael Witmer of the said county yeoman only son of the said John Witmer by the said Catharine of the third part, Witnesseth that for and in consideration of the sum of two hundred and fifty pounds lawful money of Pennsylvania to them the said Catharine Vity Christian Swartz and Elizabeth his wife and George Kendrick and Barbara his wife some or one of them by the consent of the other of them in hand well and truly paid by the said Michael Witmer at or before the execution hereof the receipt and payment whereof are hereby acknowledged and also for and in consideration of the natural love and affection which she the said Catherine Vity hath for and doth bear unto the said Michael Witmer her son she the said Catherine Vity hath given granted bargained sold released and confirmed and by these presents doth give grant bargain sell release and confirm and the said Christian Swartz and Elizabeth his wife and George Kendrick and Barbara his wife have and each and every of them hath granted released remised ratifyed and confirmed and by these presents do and each and every of them doth grant remise release ratify and confirm unto the said Michael Witmer his heirs and assigns all that certain tract or piece or parcel of land situate on a branch of Little Conestoga Creek now in the township of Manor in the said County of Lancaster whereon the said John Witmer some time dwelt beginning at a white oak in a line now or late of Andreas Coffman's land thence by vacant west south west two hundred and fourteen perches to a hickery thence by vacant land and by land now or late of Christian Pelman north two hundred and twelve perches to a hickery thence by the same land and by land now or late of Henry Pare east north east one hundred and thirty four perches to a post thence by the said Andreas Coffman's land south east one hundred and ninety five perches to the place of beginning, Containing two hundred acres and the allowance of six acres on each hundred for roads and highways, Being the same tract of land which in and by a certain patent bearing date the eighteenth day of November in the year of our Lord one thousand seven hundred and thirty five was granted unto the said Catherine Vity her heirs and assigns forever as by the same patent recorded in the office for recording of deeds for the city and county of Philadelphia in patent Book A Vol 7 page 505 etc the twenty first day of April 1736 relation being thereunto had will more fully and at large appear, Together with all and singular the houses outhouses edifices buildings barns stables fields gardens orchards meadows leasows(?) pastures feedings woods underwoods ways waters watercourses hedges ditches trees fences profits priviledges advantages communities hereditaments rights members improvements and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversion and reversions remainder and remainders thereof and all the estate right title interest use trust property possession claim and demand whatsoever both at law and in equity of them the said Catherine Vity Christian Swartz and Elizabeth his wife and George Kendrick and Barbara his wife or any or either of them of in and to the same and every part and parcel thereof together also with the above in part recited patent to have and to hold the said tract or piece or parcel of land hereditaments and premises hereby granted and released or meant mentioned or intended so to be with the appurtenances unto the said Michael Witmar his heirs and assigns to the only proper use and behoof of the said Michael Witmer his heirs and assigns forever at and under the yearly quit rent therefore reserved and to become due and payable to the chief Lord or Lords of the fee thereof and the said Catherine Vity for herself her and her heirs doth grant that she and they the said tract of land hereditaments and premises hereby given and granted with the appurtenances unto the said Michael Witmer his heirs and assigns against her the said Catherine Vity and her heirs and against all and every other person and persons whomsoever lawfully claiming or to claim the same by from or under her or them shall and will warrant and forever defend by these presents. In witness whereof the said parties to these presents their hands and seals have hereunto interchangeably set the day and year first above written. Catherine (X) Vity, Chris. Received the day and year first within written of and from the within named Michael Witmer the sum of two hundred and fifty pounds being the full consideration money within mentioned to be paid to us C.S.D. 250.0.0. Chris Swartz, George Kendig, Catharine (X) Vity.
Acknowledged the 26th October 1751 by the said Catharine Vity Christian Swartz and Elizabeth his wife and George Kendrick and Barbara his wife Before Tho Cookson.
Recorded the 15th day of Jany, 1752.
