----- Feb 22 1940 newspaper article about will, Contest over Will brings Washington's time closer to today:
To the average youth of today the era in which George Washington lived seems to take its place in history just a little this side of Columbus's discovery of America, and anything which happened before the last World War belongs to pioneer history. The relative nearness of Washington's time to the present is impressed upon one, however, by the realization that there is now pending in common pleas court here a will contest case involving property owned by a man who was eight years old when Washington died in 1799. The man was Elias Peabody, Sr., who died in 1881 at the age of 90, and who left to his son, Elias, Jr., the life use of an 80 acre farm in Russia township, with the further provision that after his son's death, the farm should then go to his grandson, Vernon Peabody, who also had life use of the property. WILL DRAWN IN 1878. The will, which was drawn on March 11, 1878, provided that if Vernon should die without legal heirs, the property then should be distributed between his other three children or their heirs. As it happened, Vernon married but had no children. He died in 1937 at the age of 73, leaving his widow, Eva Peabody, who claims the farm as the legal heir of Vernon. Her claim is being contested however by Aurelia Clyffe Knisley of Windfall road, Henrietta township, a granddaughter of Elias Peabody, Sr., who alleges that that was not the intention of Grandfather Peabody when he made his will. John W. Dilgren, attorney handling the case, said that there are 19 descendants of Peabody Sr. who are named as defendants in the case because of their interest in the estate.
