At LCCH this book of deeds is available as both a book and on microfiche, but the first several pages of the book are torn and missing. So the only copy of page 1 is microfiche, and due to lens magnification problems I was unable to make a copy (or, if I had, it would have been ten shots per page). Further, the first pages in the fiche version were also torn and sort-of placed side-by-side, but (1) page 1 has a missing strip between the two remaining pieces, and (2) page 2 has part missing from top and bottom and was mis-aligned before capturing for the fiche. So this deed is an approximation, best available by me.
This Indenture made the second day of the fourth month in the year of our Lord one thousand seven hundred and ninety eight, between Henry Hartman of Lampiter Township in Lancaster County and Commonwealth of Pennsylvania Yeoman and Mary his Wife of the one part and Jacob Musser of said Township and County Yeoman of the other part, Witnesseth that the said Henry Hartman and Mary his Wife for and in consideration of the sum of Two thousand one hundred and sixty four pounds and ten pence half penny in gold and solver coin current money of said Commonwealth to them in hand paid by Jacob Musser at and before the ensealing and delivery of these presents the receipt and payment whereof they do hereby acknowledge and thereof acquit and discharge the said Jacob Musser his Heirs Executors and administrators by these presents, have and each of them hath granted bargained sold aliened enfeoffed released and confirmed and by these presents Do and each of them Doth grant bargain sell alien enfeoff release and confirm unto the said Jacob Musser and his heirs all that Messuage Plantation and Tract of Land on which the said Henry Hartman dwells situate in Lampeter Township and County aforesaid bounded as follows, to wit, Beginning at a stone in a lien of George Gressters Land thence up and crossing Mill Creek North seven degrees East twenty six perches to a Wild Cherry Tree on the south west side thereof thence up the same the several courses thereof and about one perch distant therefrom one hundred and four perches to a post on the old line of said James Gibbons land, thence by the same North seventy three degrees and one quarter East one hundred and thirty two perches to a stone corner of Theophilus Hartmans Land, thence South three degrees and a half west seventy five perches and eight tenths of a perch to a cherry tree near the Provincial Road, thence up the same South eighty four degrees and one quarter East twenty five perches to a post in a line of Friends Meeting House land, thence by the same and crossing the Public Highway South seven degrees East three perches and one tenth of a perch to a stone George Tosslers Land thence by the same South Seventy three degrees and one quarter West one hundred and eighty five perches to the place of Beginning, Containing seventy two acres and forty seven perches, also all that lot of Timer Land situated in Leacock Township County aforesaid Beginning at a post in a line of lands of John Whit East division South seven perches to a post and South thirty nine perches of George Bressers Land thence by the same East fifty four perches to a hickory tree by the same, North sixteen degrees and a half west thirty eight perches and four tenths to the place of Beginning, Containing fourteen acres forty three perches of land (they being part of a larger tract and the whole of a lesser tract of timber land which Ann Hartman Tobias Cryder and Henry Musser who by their Indenture of Conveyance of the thirtieth of January 1768 did grant release and confirm unto the said Henry Hartman in fee as in and by the same Indenture Recorded in the Office for Recording of Deeds in and for the County of Lancaster in Lib C vol 3 page 147, may at large appear, Together with all and singular the Houses Buildings Improvements Ways Woods Waters Water courses Righte Liberties Privileges Hereditaments and Appurtenances whatsoever thereunto belonging or in any wise appertaining, and the reversions and remainders rents issues and profits thereof, and all the Estate Right Title Interest Property Claim and Demand whatsoever of them the said Henry Hartman and Mary his Wife in Law or Equity or otherwise howseoever of in to or of the same, To have and to hold the said messuage or Tenement and Two tracts and Parcels of lnad containing both together and in the whole Eighty six acres and ninety perches of land Hereditaments and Premises hereby granted with the appurtenances unto the said Jacob Musser his heirs and assigns, to the only proper use and behoof of him the said Jacob Musser his Heirs and Assigns forever, Under and Subject to a proportional part of the yearly quit rent hereafter accruing to the Chief Lord of the fee thereof, and the said Henry Hartman for himself his heirs executors and administrators doth covenant promise grant and agree to and with the said Jacob Musser his heirs and assigns by these presents that he the said Henry Hartman and his Heirs the said above mentioned and described Messuage or Tenement and two Tracts and parcels of Land containing both together and in the whole Eighty six acres and ninety perches of land hereditaments and Premises hereby granted (or mentioned or intended so to be) with the appurtenances unto the said Jacob Musser his Heirs and assigns against him the said Henry Hartman and his Heirs and against all and every other Person and Persons whomsoever lawfully claiming or to claim by or any or either of them shall and will warrant whereof the said Henry presents set their hands and seals dated the day and year first above written. Sealed and delivered in the presence of Jacob Johns, J Gibbons.
Received of Jacob Musser before the execution of the within Indenture full satisfaction for the consideration money within mentioned to be paid.
Lancaster Co SS. Personally appeared before me the Subscriber one of the Justices of the Peace in and for said County Henry Hartman and Mary his Wife and acknowledged the above Indenture to be their act and deed and desired the same might be recorded as such the said Mary being of full age and by me privately and apart examined voluntarily thereto did consent the contents being first made known to her. In Testimony whereof I have hereto set my hand and seal this second day of April A.D. 1798. Jacob Johns.
