In the name of God, Amen. I Martin Musser of West Hempfield township,
Lancaster County and State of Pennsylvania, yeoman, being weak in Body but of
sound mind, memory and understanding, do make and publish this my last Will
and Testament in manner and form following, to wit. First and principally I
commend my immortal soul into the hands of my Creator who gave it to me, and
my body to the earth to be buried in a decent and Christian like manner at the
discretion of my friends and Executors herein after named. But as touching
such worldly estate with which it has pleased Divine Providence to bless me
with, I give and bequeath the same as follows, to wit. Item I give and
bequeath unto my dear Wife Feronica the following household property, to wit:
One eight day clock with mahogany case, one stove and pipe, one case of
drawers, one Kitchen dresser, one table, six chairs and one rocking chair,
three good beds and bedsteads, two chests, one Cow, one carriage and harness,
and such other linen and woolen goods, including carpets and household and
kitchen furniture, as she shall choose for her own use. I also give and
bequeath unto my said Wife the House and Tract of land whereon I now live,
situate in the Township of West Hempfield aforesaid, adjoining lands of Andrew
Hershey, Jonas Nott deceased, and my son Christian's land, containing eight
acres fore or less, together with the appurtenances and together with the
chestnut timber lot containing four acres and a half more or less adjoining
lands of Andrew Hershey, Christian Musser widows Nott and others, to hold the
same to her during her natural lifetime, Excepting however two rooms below and
one above the brick kitchen attached on the north side of the house which I
now occupy and privilege to the pump for water in the cellar and sufficient
room in the cellar for household uses, the garden on the north side of said
house, which I give unto Anna Nissley for a home so long as she remains a
widow. I also order and direct that the sum of One hundred dollars shall be
paid annually out of my estate to my Wife Feronica during her lifetime by my
hereinafter named Executor or the Survivor of them. Further I give and
bequeath unto my son in law Jacob Hostetter and my daughter Elizabeth
intermarried with him, all the remainder of that Plantation or Tract of land
which I lately purchased form Michael Moore, with the appurtenances, situate
in the Township of West Hempfield aforesaid, adjoining lands of Michael
Musser, John Stauffer deceased, Jacob Nolt and others, containing One hundred
acres more or less, to hold the same to them jointly as tenants in common,
their heirs and assigns, and I charge the same to them at one hundred dollars
per acres, payable in annual payments of four hundred dollars each without
interest. The Lien of four thousand dollars charged on said premises I do
order and direct to be paid out of the proceeds of my Estate. Further I do
order and direct that the whole of my Estate, real and personal, not
hereinbefore disposed of, shall be sold by my hereinafter named Executors at
public or private sale, and the net proceeds of my whole estate shall be
equally divided amongst my nine Children, share and share alike, as the same
becomes due, but the shares coming to my three daughters, viz Mary, Anna, and
Fanny, shall remain in the hands of my Executors and the interest thereof must
be paid to them annually at the rate of five per cent per annum during their
lives, and the principal to their heirs as soon as can be after their or any
of their decease, but five hundred dollars of each of their shares shall be
paid to them as soon as can be after my deceased, in which the advancements
that I have them charged with shall be included, but in case any of them or
their husbands should purchase land and they or any of them should wish to
have their share invested in such land the same shall be so invested provided
the same can be secured for their Children or to the rest of my heirs, in case
any of them should die childless, such one's share shall fall back to my
estate and be divided equally amongst my other heirs share and share alike,
and I do hereby empower my hereinafter named Executors to execute titles for
all my Lands sold by them, and for the lands hereinbefore bequeathed for which
I have not given titles in my lifetime, and those of my Sons who have got
their titles for their lands and have given their bonds to me for the payment
thereof shall retain their share or shares out of such bonds, beginning with
the bond last due and receding back towards the first, but no discount shall
be made on such bonds, retained. And lastly I do hereby nominate and appoint
my three sons Michael Musser, John Musser and Martin Musser Jr to be the
Executors of this my last Will and Testament, hereby revoking all former Wills
by me heretofore made. In Witness whereof I the said Martin Musser senr and
testator have hereunto set my hand and seal this nineteenth day of August in
the year of our Lord eighteen hundred and fifty eight (1858). Martin Musser.

as and for his last Will and Testament in the presence of us, who at his
request and in his presence have subscribed our names as witnesses thereto. P.

Lancaster County SS. One the nineteenth day of February Anno Domini 1859
Before me the Subscriber personally appeared P. H. Summy and Abraham Lenhard
Senr, the subscribing witnesses to the preceding Will, and on their solemn
Affirmations did depose and say that they were present and saw and heard
Martin Musser the testator therein named sign seal publish pronounce and
declare the same to be his last Will and Testament, and that at the doing
thereof he was of sound and disposing mind memory and understanding to the
best of their knowledge observation and belief. Jos Ehrenfried, Dep Regr.
February 19, 1859. Letters Testamentary granted to Michael Musser, John
Musser and Martin Musser, the Executors they being duly affirmed well and
truly to administer the goods and chattels rights and credits of the Testator
according to law, and also that they will diligently and faithfully regard and
well and truly comply with the provisions of the Laws relating to Collateral
