In the name of God Amen. I John Musser of West Hempfield township in the
County of Lancaster and State of Pennsylvania, being no win perfect health and
of sound mind memory and understanding, blessed be God for the same, and
considering the uncertainty of this mortal life, do make and publish this my
last will and Testament, in manner following, to wit, Principally and first of
all I recommend my immortal soul into the hands of God who gave it and my body
to the earth to be decently buried at the discretion of my son and daughter
named Peter Musser and Andrew Shallenberger being my Executors of my last Will
and Testament, and as to such worldly estate as it has pleased God to bless me
with, I dispose of the same as follows, viz, It is my will and I do hereby
order and direct that all my just debts and funeral expenses be duly paid and
satisfied as soon as conveniently can be after my decease. It is my will and I
do hereby order and direct that my dear wife Mary Musser shall have the one
half part of all the produce of my farm, during her natural life after my
decease, and before my decease my son Peter shall every year during my life
deliver to me in the bushel on my farm the one half of all the grain
vegetables etc that will be raised on all the land now owned by me and that I
have given to my said son Peter. Item I do hereby reserve for my own use and
the use of Mary my wife the privilege of storing our one half part of the
grain aforesaid in the house and barn I now occupy during our natural lives,
together with garden sufficient for our use. Item I give and bequeath unto my
son Peter seventy seven acres of land, more or less, the same he has a deed
form me for, in fee simple. And I further bequeath unto him the one half of
the cleared land, and two thirds of the woodland or the uncleared land, and
the meadow and orchard all out of the forty nine acres and forty eight perches
of land that my said son Peter reconveyed to me. Item I give and bequeath unto
my daughter Mary, intermarried with Henry Weller during her natural life and
at her decease to her children share and share alike, the other one half of
the cleared land and the one third of the uncleared or woodland reconveyed to
me by my son Peter. And I further bequeath unto my said daughter four acres of
cleared land and two acres of woodland for which the said Henry Weller has
received of me a deed for. And also bequeath unto my said daughter the five
and a half acres of woodland reconveyed to me by my son Peter, and the said
Henry Weller is only to have the occupancy of the said bequeaths during his
natural life he nor his wife Mary nor her heirs shall and are hereby
prohibited from turning or diverting the water from running its present
natural course that runs through the land bequeathed to my said daughter Mary.
Item Of the land bequeathed to my son Peter and to my daughter Mary of that
reconveyed to me by my son Peter as in the two last items they may make the
division as I have bequeathed to them, with the assistance of my Executors
hereinafter named, and of the seventy seven acres conveyed to my son Peter I
reserve the right for myself and wife live in the dwelling house thereon, the
right to cut down timber and possession in common with my son aforesaid during
out natural lives of all things on the same. Item, I give and bequeath unto my
son Peter my clock at my decease, and the residue of my household and kitchen
furniture, I give my son Peter and to my daughter Mary Weller and to her
children to be appraised by three reputable neighbors, chosen by my Executors
and to be divided equally between them, after my wife's decease. And lastly I
nominate and appoint my son Peter and Andrew Shallenberger Executors of this
my last Will and Testament. In Witness whereof I the said John Musser have
hereunto set my hand and Seal this Ninth day of April Anno Domini one thousand
eight hundred and twenty five 1825. John (X) Musser.
Signed Sealed published and declared by the said Testator to be his last
Will and Testament in the presence of us, who were requested to be his
witnesses, the interlining made by request before signing. Thomas Lloyd, Peter
Musser.
Lancaster County SS. On the 10th day of April Anno Domini 1826 Before me the
Subscriber personally appeared Thomas Lloyd Esq and Peter Mosser the
subscribing witnesses to the within will and on their solemn affirmations
according to law did severally declare and say that they were present and saw
John Musser the Testator therein named make his mark thereto and heard him
publish pronounce and declare the same as and for his last Will and Testament
and that at the time of the doing thereof he was of sound and well disposing
mind memory and understanding, according to the best of their knowledge

Be it remembered that on the 10th day of April Anno Domini 1826 the last
will and Testament of John Musser deceased was proved in due form of law, and
Letters Testamentary thereon were granted to Peter Musser and Andrew
Shallenberger the Executors therein named, they having been first duly
affirmed, well and truly to administer the estate of the said deceased, and
especially to exhibit a true and perfect Inventory thereof into the Register's
Office at Lancaster within one month, and to render a just and true account of
their Executorship on said estate in one year or when thereto lawfully
