In the name of God, amen. I Henry Musser of West Hempfield township in the
county of Lancaster and State of Pennsylvania farmer being considerably
advanced in years considering the certainty of death and the uncertainty of
the time thereof, and to the end of being the better prepared to leave this
world whenever it may please God to call me hence, being of sound and
disposing mind and memory do make and declare this my last will and testament
in manner following, that is to say, First and principally I commend my
immortal soul into the hands of Almighty God my Creator, hoping for free
pardon and remission of all my sins, and to enjoy everlasting happiness in the
heavenly regions through Jesus Christ my savior my body I commit to the earth
at the discretion of my Executors hereinafter named, and as to such worldly
estate wherewith it hath pleased God to bless me in this life I give and
dispose of the same as followeth, Imprimis It is my will and I order that all
my just debts and funeral expenses be duly paid off and satisfied as soon as
conveniently may be done after my decease by my Executors hereinafter named.
Item I give and bequeath unto my beloved wife Anna the sum of four hundred
dollars in specie, to be paid her immediately after my decease, and I further
give and bequeath unto her yearly and every year the sum of two hundred
dollars in specie during her natural life or as long as she remains my widow,
to be paid her out of my land or real estate by the owner or possessor
thereof, the first payment to be made at the end of one year next ensuing
after my decease. Item I further give and bequeath unto my said beloved wife
Ann one riding horse or mare and one milk cow which she may choose from among
my horses and cows, two beds and bedsteads, one house clock and case, and of
my other household goods, kitchen furniture and implements of household
whatsoever as much and as many as she may think proper or choose to have. And
I further give and bequeath unto her during her natural life or as long as she
remains my widow the easterly front room on the lower story, and the room
immediately above the same on the second floor in my dwelling house in west
Hempfield township aforesaid, for her use also right and privilege in the
kitchen at the hearth at the bake over, in the garret and cellar, in the yard,
to the pump and spring of water, also the one half part of the garden, And I
order and direct the owner or possessor of my lands or real estate to find
furnish or provide for my said wife Anna during her natural life or as long as
she remains my widow yearly and every year in due season good and sufficient
hay, pasture and stabling for one horse or mare and one cow, and also good and
sufficient firewood, cut in manner of chord wood and hauled home into the yard
convenient to her door, as much as she has of for her use and consumption. All
the monies goods articles rights and privileges herein before given bequeathed
allowed or ordered unto my said wife Anna shall be deemed and considered in
lieu and full satisfaction of her dower, thirds, claim and demand whatsoever,
at common law of in to or out of my estate real as well as personal. Item All
my real estate consisting of this my plantation or tract of land in West
Hempfield township aforesaid, containing one hundred and twenty five acres
(more or less) and a piece or tract of land lying on the Chesnut hill in the
township aforesaid, containing thirty five acres (more or less) amounting
together to one hundred and sixty acres (be the same more or less) I order my
Executors hereinafter named to rent out I such manner that it shall be kept in
a good state of cultivation and the buildings improvements fence and other
appurtenances thereof in good order and repair and the same shall be rented
out for and during such term of time until both the children of my deceased
daughter Barbara (who had been intermarried with Abraham Stauffer) or the
survivor of them hath attained the age of twenty one years. Item Immediately
after they the said two children of my said deceased daughter Barbara, or the
survivor of them, hath arrived at the age of twenty one years, then and from
thence forth I give devise and bequeath all my real estate, consisting of the
aforesaid two tracts of land containing together one hundred and sixty acres
(be the same more or less) unto my daughter Anna and her husband Daniel
haymaker, and unto Henry Stauffer and John Stauffer the two sons of children
of my said daughter Barbara deceased, in manner following, that is to say, one
undivided moiety or half part thereof I give devise and bequeath unto the said
Daniel haymaker and Anna his wife, in right of the said Anna, and to their
heirs and assigns forever; one undivided fourth part thereof I give devise and
bequeath unto the said Henry Stauffer and to his heirs and assigns forever,
and one other undivided fourth part thereof I give devise and bequeath unto
the said John Stauffer and this heirs and assigns forever, subjecting however
these several devised or bequests to the sundry articles rights and privileges
hereinbefore given and allowed or ordered out of my real estate unto my said
wife Anna. Item I give and bequeath unto Abraham Stauffer (who had been
intermarried with my daughter Barbara) the sum of one dollar in specie, which
together with what he has heretofore had and received from me, shall be deemed
in full of all his portion, dividend, claim and demand whatsoever, in right of
his said wife Barbara deceased or otherwise of in to or out of my estate both
real and personal. Item All the residue of my moveable property goods and
chattels not hereinbefore particularly bequeathed I order to be sold by public
vendue and the monies arising from such sale together with all my other monies
and the monies arising from time to time as rent of my real estate (during the
term that the same is rented out) I order the whole to be divided into four
equal shares or portions; one share or portion thereof I give and bequeath
unto my said Grandson Henry Stauffer and to his heirs executors administrators
and assigns forever; one other share or portion thereof I give and bequeath
unto my said Grandson John Stauffer and to his heirs executors administrators
and assigns forever; and the two other or remaining shares or portions I give
and bequeath unto my said son in law Daniel haymaker and to his wife Anna in
right of the said Anna and to their heirs executors administrators and assigns
forever. And lastly I nominate constitute and appoint my beloved son in law
Daniel Hamaker and my trusty friend John Nissly of Raphoe township and the
survivor of them and the executors and administrators of such survivor as well
as and for the Executors of this my last will and Testament, as also to be the
Guardians of my said Grandson Henry Stauffer and John Stauffer during their
respective minorities for the several devises and bequests hereinbefore given
and bequeathed to them respectively. And I renounce revoke and declare null
and void all former and other wills and Testaments by me at any time
heretofore made ratifying allowing and confirming this and no other to be my
last will and testament. In Witness whereof I Henry Musser the Testator have
to this my last will and Testament set my hand and Seal the Seventeenth day of
July in the year of our Lord one thousand eight hundred and nineteen. Heinrich

Will and Testament in the presence of us, who at his request and in his
presence have subscribed our names as witnesses thereunto. Christian Smith,

I Henry Musser the aforesaid Testator do make this codicil to be taken as
part of my last Will and Testament as follows, that is to say, I give and
bequeath unto my beloved wife Anna yearly and every year as long as she lives
one barrel of cider and apples, and such like fruit from my orchard, as she
may want or choose for her use and consumption, to be given and allowed to her
by the owner or possessor of my mansion place. In Witness whereof I have to
this codicil annexed to my said will set my hand and seal the Ninth day of
June in the year of our Lord one thousand eight hundred and

Subscriber personally appeared Christian Smith and Jacob Flare the subscribing
witnesses to the within will and codicil and on their solemn affirmations
according to law did severally declare and say that they were present and saw
and heard Henry Mosser the Testator therein named sign seal publish pronounce
and declare the same as and for his last Will and Testament and codicil, and
that at the several times of the doing thereof he was of sound and well
disposing mine memory and understanding according to the best of their

Be it remembered that on the 26th day of April Anno Domini 1826 the Last
Will and Testament and codicil of Henry Mosser deceased were proved in due
form of law, and Letters Testamentary thereon were granted to Daniel Hamacher
and John Nissly, the Executors in the said will named, they having been first
duly affirmed well and truly to administer the estate of the said Deceased,
and especially to exhibit a true and perfect Inventory thereof in to the
Registers Office at Lancaster within one month and to render a true and just
account of their Executorship on said estate in one year or when thereto
