----- Lancaster County PA Orphans Court Miscellaneous Books, 23 Nov 1810:
On the Petition of Henry Riegel one of the sons of Michael Riegel late of Hempfield township in the County of Lancaster deceased, Setting forth, "That the said Michael Riegel in his lifetime, to wit, on the 6th day of January 1805, made and published his last will and Testament in writing, after which he purchased of a certain a piece or parcel of land situate in the said township of Hempfield, adjoining lands of William Camber, John Leman and others, containing about eleven acres, of which the said Michael Riegel died intestate, seized and possessed, in Fee, leaving a widow named Magdalena and six children, to wit, Christian, Henry, Martin and David his sons, and Barbara and Magdalena, who is married to John Otto, his daughters, and three grand-children, named John, Susanna and Elizabeth the children of his late son John Riegel who died before the death of his said father Michael Reigel, and for which grandchildren who are yet in their minority, Peter Summy was duly chosen and appointed guardian by the Court. That the said Michael Riegel died about a year ago." And praying the Court to award an Inquest etc. It is Ordered by the Court, that the Sheriff of this County do forthwith, summon an Inquest to view said piece or parcel of land with its appurtenances and make partition thereof to and amongst the widow and children and grandchildren of the said deceased if the same can be done without prejudice to and spoiling of the whole, but if the same cannot be so divided, that the said Inquest do enquire whether the said premises will conveniently accommodate more than one of the said children and grandchildren without prejudice to and spoiling of the whole, and if they so find that they ascertain how many the same will so accommodate describing each purport by metes and bounds and putting a just valuation and appraisement on each part thereof; But in case partition cannot be so made amongst all the legal representatives of the said deceased, nor the said premises accommodate more than one of said children, that they then value and appraise the whole of said premises agreeably to law, that they estimate the widow's part therein and in each purport if divided, that legal notice be given of the time and place of holding such Inquisition to all the parties interested or their legal representatives, that they may be present if they think proper and that report of said proceedings be made to the next Orphan's Court.
